Peter Burke: It is provided for in the Act that you do not need to amend the Act to change the register if the registration body is not performing the tasks as are specifically set out within the Act.

Peter Burke: The committee has clear boundaries in terms of how it would adjudicate on the performance of the registered body once it has been appointed.

Peter Burke: Section 9 states "The Minister shall appoint a person to carry out periodic inspections, reviews and audits in relation to the performance by the registration body". It is therefore essentially up to the Minister to decide what the review period should be. That is provided for in the Act.

Peter Burke: First, the board will be holding the body to account under the parameters that they are operating under and for good practice. Every Government would be of the view that there should be reviews to ensure how they get the prima facieevidence that it is performing to standard. That is done by having reviews and by having mechanisms to do that in the Act, and those are in place.

Peter Burke: Yes. Section 3(1) of the Act provides details of the definition of a builder. Essentially, it is the provider of building services under the Building Control Act. It is governed by the Building Control Act.

Peter Burke: We had Second Stage in the Dáil last week and on foot of that we forwarded a draft copy of the regulations to the Oireachtas Joint Committee as well for its deliberations. Next week, I hope to have Report Stage in the Dáil on Wednesday and then in the Seanad on Thursday to complete the Bill. Peter Burke: It is in line with the commitment in the Moorhead report. A survey was conducted by, I think, the Association of Irish Local Government, AILG, on the average working week of a councillor and it was taken pro ratato that of the support provided to an Oireachtas Member.

Peter Burke: I think it is only set at 13 hours. It is an allowance as opposed to a formal employee arrangement where there would be overtime. We have a mechanism to review these proposals. If it is a case that there are limitations or the scheme does not work into the future then we can review and obviously make changes, if needed.

Peter Burke: In the first instance, that is what we put into the legislation so specifically they would have regard to the individual woman's choice who is leaving and I think that is a strong statement.
