Joint Oireachtas Committee on Agriculture, Food and the Marine: Farm Safety: Discussion (3 Nov 2021)

Paul Daly: I welcome the Minister of State, Mr. Moloney and Mr. Leonard. I am delighted to get the opportunity to speak on a topic that is close to my heart and in which I have invested much time and done much work. I have a Farm Safety Agency Bill in the system in the Seanad. I thank the Minister of State for his engagement on that and I look forward to continuing our engagements on it. Who knows...

Joint Oireachtas Committee on Agriculture, Food and the Marine: Farm Safety: Discussion (3 Nov 2021)

Paul Daly: I welcome Norma, Brian and Catherine. Like other speakers, in preparation for meetings I read through the submissions in order that I could prepare questions for the witnesses. However, following on from the submission given today, the questions I had intended to ask have been already answered. It was one of the best and most moving submissions I have ever heard at this committee. By...

Joint Oireachtas Committee on Agriculture, Food and the Marine: Farm Safety: Discussion (3 Nov 2021)

Paul Daly: I am aware circumstances demanded differently but it is unfortunate we did not meet Embrace before we met the Minister of State today. I know it could not be helped.

Seanad: An tOrd Gnó - Order of Business (21 Oct 2021)

Paul Daly: I join with Senator Gavan in lending my support to the Leader on the email we have been receiving. I stress the singular "email", although we may have been receiving multiple copies of it. Where would we be without the convenience of being able to copy and paste in the world we live in? I wish to raise an issue that has no doubt been raised here previously, regarding scam calls and text...

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: To tease it out a little further, I get the strong impression from Mr. McHugh's response that he sees the CCPC's role as being reactive. There has to be an issue and then the CCPC will analyse it, forensically examine it and decide what action could be taken to reverse it. We are legislators and we are trying to be proactive. Can Mr. McHugh see where the difference in our opinions is,...

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: I thank the representatives of the CCPC for being here. Deputy Cahill and the previous speaker have covered many of the areas of interest for me with regard to the proposed amendment to legislation and the opinion of the CCPC. I will seek clarification on a few points, ask a few questions and make an observation. Would I be correct in saying that competition law and the CCPC's opinion are...

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: I welcome the witnesses from the VCI. If they will bear with me for a moment, I will quote from its code of professional conduct, prior to its amendment. It is very specific in saying "Any veterinary practice established in commercial premises must be wholly owned by a veterinary practitioner or group of veterinary practitioners who must be fully responsible for the conduct and practice and...

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: The council had a code of professional practice which was basically not worth the paper it was written on because it did not have the power to enforce it. However, the council did interpret the Act to mean that it was its role to enforce it by virtue of the fact that it was included in its code of professional practice.

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: That was the council's previous interpretation. It did understand that to be the case because it would not otherwise have had it in its code of professional practice. Am I safe in saying that?

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: The council then moved on and, for whatever reason, decided to change its interpretation. As far as I can see, it effectively deregulated the ownership of veterinary practice. Deputy Cahill is now trying to regulate it again. The council moved off the field. It actually usurped the function of the Oireachtas. It deregulated ownership because, based on its own code of practice, it was the...

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: Were there any corporate-owned veterinary practices prior to the amendment of the code of professional practice?

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: Were we to be having this meeting before 2018, Ms Muldoon would not have been able to tell me then either, although the code-----

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: I know I am repeating myself but the VCI's code of professional practice stated what I have just read out.

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: That was the VCI's code of practice but it was not enacting that.

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: Perception is dangerous but because of the VCI's code of professional practice it was perceived that it was the regulator of ownership. Does Ms Muldoon see where I am coming from when I say that the VCI deregulated ownership by changing its code of professional practice? There is nobody there to regulate it now and the VCI previously had it in its code of practice. Rightly or wrongly it...

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: Does Ms Muldoon appreciate the need for the regulation of ownership, irrespective of what that regulation says? Is there a need for the regulation of owners, aside from the professional practitioners the VCI regulates?

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Veterinary Practice (Amendment) Bill 2021: Discussion (Resumed) (20 Oct 2021)

Paul Daly: Has the VCI had any issues with the area it regulates; with practitioners, nurses or vets, who are employed by corporate practices?

Seanad: An tOrd Gnó - Order of Business (19 Oct 2021)

Paul Daly: I second Senator Murphy's proposed amendment to the Order of Business. In doing so, I compliment him on the great work he has put into that issue. He has come up with a very common-sense approach to what is an ongoing issue. I will raise an issue that both the Leas-Chathaoirleach and the Cathaoirleach will possibly tell me before I am finished is more appropriate to a Commencement matter,...

Joint Oireachtas Committee on Agriculture, Food and the Marine: Nitrates Directive, Water Quality and Pollution: Discussion (13 Oct 2021)

Paul Daly: I thank the representatives from the EPA for attending the meeting today and for their submission to the committee. Many of the issues I was curious about at the start of the meeting have been addressed by other members, so I will not go back over old ground. I have two questions. The second is one I will probably have to make a statement on to explain what I am coming at, but I stress I...

Joint Oireachtas Committee on Agriculture, Food and the Marine: Nitrates Directive, Water Quality and Pollution: Discussion (13 Oct 2021)

Paul Daly: I welcome the officials from the Departments. I have a few brief questions. The first requires a "Yes" of "No" answer and that will determine where I go from there. In the draft nitrates programme we have at present, is the condition regarding the short-term rental of land over 30 km from home only for derogation farms or is it across the board, if it were included in the final document?
