Seanad: Order of Business (14 Jan 2016)

Trevor Ó Clochartaigh: The issue is not the individual but the method of the appointment.

Seanad: Order of Business (14 Jan 2016)

Trevor Ó Clochartaigh: I note that the Minister for Children and Youth Affairs is this morning facing questions before a United Nations committee on Ireland’s children's rights record. Senator Bacik has been talking about the Labour Party’s child care initiative, which I look forward to reading. The issues being raised today in Geneva, however, point to a failure by this Government to implement many...

Seanad: Commencement Matters: Seirbhísí Farantóireachta (17 Dec 2015)

Trevor Ó Clochartaigh: Cuirim fáilte roimh an Aire Stáit. Tuigim nach raibh sé ar chumas an Aire Stáit, an Teachta McHugh, bheith i láthair agus go bhfuil freagra ag an Aire Stáit, an Teachta Ó Ríordáin, dúinn. Baineann an cheist phráinneach atá á n-ardú agam ar maidin leis an tseirbhís farantóireachta a théann go hÁrainn....

Seanad: Commencement Matters: Seirbhísí Farantóireachta (17 Dec 2015)

Trevor Ó Clochartaigh: Táim buíoch don Aire Stáit as ucht an freagra sin a léamh. An rud nach bhfeicim mórán tráchta air anseo ná pobal Árann agus na mianta atá acusan. Deir an tAire Stáit go bhfuil sé sásta aon chéim réasúnta a thógáil leis an gceist seo a réiteach. Táim ag iarraidh air céim...

Seanad: Commencement Matters: Rural Social Scheme Administration (16 Dec 2015)

Trevor Ó Clochartaigh: Cuirim fáilte roimh an Aire Stáit. Tá na saoistí ar na scéimeanna sóisialta tuaithe ag obair an-mhaith ar fud na tíre. Dar leo, tá easpa cothromaíochta idir na coinníollacha oibre ata acu féin agus na coinníollacha atá ag saoistí ar na scéimeanna eile. I am sure the Minister of State will be well aware of the...

Seanad: Commencement Matters: Rural Social Scheme Administration (16 Dec 2015)

Trevor Ó Clochartaigh: I thank the Minister of State for his response, but it was splitting hairs. The communities on the ground do not see a major difference between the schemes. The Department and various agencies do not see a difference when they ask people to work with the other organisations that have been mentioned. According to the Minister of State, he is "aware that the work of supervisors and...

Seanad: Order of Business (16 Dec 2015)

Trevor Ó Clochartaigh: Senator Coghlan should never believe anything he reads in the Irish Independent.

Seanad: Order of Business (16 Dec 2015)

Trevor Ó Clochartaigh: The Senator should stop buying it then.

Seanad: Order of Business (16 Dec 2015)

Trevor Ó Clochartaigh: I am concerned about the amount of time being allocated to discuss the Prisons Bill 2015 which, I understand, will only be 15 minutes. We welcome the Prisons Bill because it seeks to close St. Patrick's Institution, but the Department of Justice and Equality, during the Dáil debates, sneaked in a provision on certain persons who are serving sentences of imprisonment for the purposes of...

Seanad: Order of Business (16 Dec 2015)

Trevor Ó Clochartaigh: Boycott the Irish Independent.

Seanad: Order of Business (16 Dec 2015)

Trevor Ó Clochartaigh: Yes.

Seanad: Garda Síochána (Policing Authority and Miscellaneous Provisions) Bill 2015: [Seanad Bill amended by the Dáil] Report and Final Stages (16 Dec 2015)

Trevor Ó Clochartaigh: I welcome the Minister and thank her for coming in. She might clarify an issue raised with me again and again by local gardaí, which is rostering and the change in Galway - as a result of the working time directive - from four rosters to five. I am informed that has had the knock-on effect of having gardaí available for fewer hours, which, in turn, has had an impact on rural Garda...

Seanad: Prison Bill 2015: [Seanad Bill amended by the Dáil] Report and Final Stages (16 Dec 2015)

Trevor Ó Clochartaigh: It seems strange to insert this miscellaneous provision in a Bill that has closed St. Patrick's Institution. It seems a little bit out of place. The Minister said it was a convicted prisoner who was to be deported. How serious a case was this? Is there a danger that, for people seeking asylum, the process could be deemed to be exhausted because of a deportation order against them? Is...

Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)

Trevor Ó Clochartaigh: Cuirim céad fáilte roimh an Aire Stáit arís. It is a good day to be debating the Bill and I hope we will get through it in an expedient manner.I concur with Senator Jillian van Turnhout on the issues she is raising because I note that a number of organisations, such as Inclusion Ireland, have raised this as a particular issue. The thought of placing the decision support...

Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)

Trevor Ó Clochartaigh: It is corrected now.

Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)

Trevor Ó Clochartaigh: In principle this group of amendments make a lot of sense. The only concern I would raise is that as we have seen with the Legal Aid Board, there is a huge backlog and the resources available for free legal aid are grossly underfunded. There is a huge waiting list and people find it very hard to access. The principle is good but the resources have to be made available if it is to work....

Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)

Trevor Ó Clochartaigh: It has more to do with the free legal aid service itself.

Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)

Trevor Ó Clochartaigh: I thank the Minister of State for her explanation. We were moving the amendment because the UN Committee on the Rights of Persons with Disabilities has stated in general comment No. 1 that "[u]nder article 12 of the Convention, perceived or actual deficits in mental capacity must not be used as justification for denying legal capacity". Since this Bill is being developed as part of...

Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)

Trevor Ó Clochartaigh: They are always good. Senator Keane just does not see the merit in them often enough.

Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)

Trevor Ó Clochartaigh: I thank Senator Conway. It is a very important amendment and we appreciate that the Minister of State has taken it on board. We will not be pressing amendment No. 33.
