Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) and Final Stage (5 Dec 2006)

Seán Power: It is not a script.

Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) and Final Stage (5 Dec 2006)

Seán Power: The Deputies ask questions they do not want me to answer. The purpose of the Bill is to include in primary legislation a scheme introduced by way of regulation. We do not seek to restructure the scheme.

Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) and Final Stage (5 Dec 2006)

Seán Power: We are passing legislation based on what already exists.

Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) (5 Dec 2006)

Seán Power: When he saw others speaking for a second time, he assumed he could do the same.

Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) (5 Dec 2006)

Seán Power: It was very memorable too. We have never sold this legislation as making a major change to the way the subvention scheme operates. The scheme operates under the 1993 regulations. On the advice of the Attorney General, it was decided to provide for it in primary legislation. There will be no real change in how the scheme will be administered. It will be administered on a standardised...

Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) (5 Dec 2006)

Seán Power: A person could win the lotto. There is only a certain amount of money that can be put into the scheme. In the first year €5 million was provided for it. This year up to €160 million will be spent. It is prudent to ensure the money is targeted at those who need it most. A person in receipt of a subvention could inherit money or have a substantial win on the pools.

Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) (5 Dec 2006)

Seán Power: It is prudent for the HSE to be in a position to carry out a review if circumstances change dramatically or significantly. This provision represents no change from the position as laid out in the 1993 subvention regulations. Deputy Ó Caoláin spoke about the trauma and difficulties experienced by dependants and their families. With Deputy Wall, I am familiar with them. I have said before...

Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) (5 Dec 2006)

Seán Power: It is a Government priority.

Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) (5 Dec 2006)

Seán Power: There is no bottomless pit in any scheme where money is provided. When the scheme began in 1993, €5 million was provided. It was a Labour Party Minister who introduced the clause concerning the primary residence. At the time it did not seem to cause any difficulty for Opposition Members when they were on this side of the House.

Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) (5 Dec 2006)

Seán Power: The scheme was introduced in 1993. We realise it is in need of a major overhaul.

Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) (5 Dec 2006)

Seán Power: No, because this legislation is not about changing the subvention scheme. It is about grounding it in primary legislation.

Health (Nursing Homes) (Amendment) Bill 2006: Report Stage (Resumed) (5 Dec 2006)

Seán Power: The argument has been made for excluding the family home. It is not possible to agree to this proposal on this occasion. I am not in a position to accept the amendment.

Nursing Homes. (5 Dec 2006)

Seán Power: The Health Service Executive recently published Review of Deaths at Leas Cross Nursing Home 2002-2005 that was commissioned by the HSE and written by Professor Des O'Neill. Separately, the HSE's complaints review group for Dublin north-east has written a report for HSE management on foot of complaints received from concerned families of patients at Leas Cross since May 2005. That report has...

Nursing Homes. (5 Dec 2006)

Seán Power: On the one hand we had the Leas Cross report written by Professor Des O'Neill and separately the HSE complaints review group for Dublin north-east has written a report for HSE management on foot of complaints received from concerned families of patients at Leas Cross since May 2005. That report has not been published because it relates to the individual complaints that were received by the...

Nursing Homes. (5 Dec 2006)

Seán Power: I am aware that Dr. Dermot Power was commissioned by the HSE to compile a report. I understand that this report relates to——

Nursing Homes. (5 Dec 2006)

Seán Power: There are a number of reports involved, the main one of which relates to Leas Cross. The HSE sought that the review group for Dublin north east compile a report and it relates specifically to individual complaints received and, for that reason, it has not been published. Dr. Dermot Power's report has not come into my possession. I am aware that he was asked to compile a report by the HSE....

Nursing Homes. (5 Dec 2006)

Seán Power: To the best of my knowledge, the Power report is specific to Leas Cross. From what the Deputy stated, one would think that we were trying to cover up something.

Nursing Homes. (5 Dec 2006)

Seán Power: The main report that was commissioned was that which relates to Leas Cross. On the previous occasion on which this matter was dealt with on Question Time, the general view put forward by the Opposition was that we were trying to keep a lid on that report and that we did not want it to be published.

Nursing Homes. (5 Dec 2006)

Seán Power: We did not. I have just explained the reasons for the delay in publishing the report. We were satisfied to have the report published. The Minister for Health and Children indicated that we had made every effort to encourage the HSE to publish the report. It was the HSE that commissioned the report. It is important that lessons are learned from this matter.

Nursing Homes. (5 Dec 2006)

Seán Power: The Deputy should allow me to answer the question he asked. Reports have been compiled in respect of this matter. The Leas Cross report was published. Even before the latter emerged, a number of measures were taken in respect of how the inspection process works and we are putting in place a proper training system in respect of the inspection teams. For the first time ever, we are...
