Joint Oireachtas Committee on Housing, Planning and Local Government: Implementing Housing for All: Discussion (Resumed) (8 Nov 2022)

John Cummins: He will get another opportunity to contribute.

Joint Oireachtas Committee on Housing, Planning and Local Government: Implementing Housing for All: Discussion (Resumed) (8 Nov 2022)

John Cummins: The opportunity is there in the new Croí Cónaithe scheme. I had a response last month that said it was being extended to rural one-off houses and cities in November. I understand that circular is going to be issued to local authorities next week. Given what Mr. Daly has said, I assume he would welcome that. If one takes the €100,000 that would be put into the unit...

Joint Oireachtas Committee on Housing, Planning and Local Government: Implementing Housing for All: Discussion (Resumed) (8 Nov 2022)

John Cummins: Does Waterford City and County Council have the figure for the number that have applied so far?

Joint Oireachtas Committee on Housing, Planning and Local Government: Implementing Housing for All: Discussion (Resumed) (8 Nov 2022)

John Cummins: Are they for one-offs awaiting the November-----

Joint Oireachtas Committee on Housing, Planning and Local Government: Implementing Housing for All: Discussion (Resumed) (8 Nov 2022)

John Cummins: The point that this is another form of affordable housing is an important one. Not everybody wants to own a brand-new, A-rated home in an estate in the city. Some people want to live within their local communities, like what Deputy O'Donoghue referred to. They want to be able to take an older property and bring it back into productive use; that is what the Government is essentially doing...

Joint Oireachtas Committee on Housing, Planning and Local Government: Implementing Housing for All: Discussion (Resumed) (8 Nov 2022)

John Cummins: My understanding from engagement with the Department is that cases can be made on a case-by-case basis as a result of constraints due to gradients or wayleaves, etc. I assume in the case of Ardmore, which is under 35 per hectare and has those constraints, that Waterford City and County Council will be making those cases.

Joint Oireachtas Committee on Housing, Planning and Local Government: Implementing Housing for All: Discussion (Resumed) (8 Nov 2022)

John Cummins: I have asked other local authorities about the enhanced leasing scheme. Both Waterford and Limerick City and County Councils have utilised that as a delivery mechanism; they may have a number in their pipeline. I think the last delivery in Waterford under leasing is in 2024. A decision was made to phase that out. Given the expected reduction in the private rental sector market,...

Joint Oireachtas Committee on Housing, Planning and Local Government: Implementing Housing for All: Discussion (Resumed) (8 Nov 2022)

John Cummins: I made the point on the floor of the Seanad a moment ago that nobody can honestly put their hand on their heart and say it is not better for an individual or family to be in a secure, long-term, 25-year property, in a lease, than it is to have them in a hotel, bed and breakfast accommodation or an unsecured HAP property. Value-for-money considerations must be taken into account, but given...

Joint Oireachtas Committee on Housing, Planning and Local Government: Implementing Housing for All: Discussion (Resumed) (8 Nov 2022)

John Cummins: Cork City Council would be a good point of contact in that respect, given what I would like to see, which is one third of the units being delivered. Waterford City and County Council would get the benefit of that because it is taking those into social housing.

Seanad: Residential Tenancies (Deferment of Termination Dates of Certain Tenancies) Bill 2022: Second Stage (27 Oct 2022)

John Cummins: I thank the Minister of State for being with us, and his colleagues, the Minister, Deputy Darragh O'Brien, and the Minister of State, Deputy Peter Burke, for the speedy passage of this legislation through both Houses of the Oireachtas this week. This emergency Bill seeks to defer the termination dates of certain residential tenancies that fall or would fall during the period beginning on the...

Seanad: Residential Tenancies (Deferment of Termination Dates of Certain Tenancies) Bill 2022: Second Stage (27 Oct 2022)

John Cummins: I did not interrupt anyone.

Seanad: Residential Tenancies (Deferment of Termination Dates of Certain Tenancies) Bill 2022: Second Stage (27 Oct 2022)

John Cummins: I did not interrupt anyone. It is important to say that what I am saying is not my view, but what was stated at the joint Oireachtas committee and I made the preface of that remark in my speech. I would appreciate if I was not interrupted. The Senator should go back to the transcript from the joint Oireachtas committee and read what was said. These are all factors that impact on the supply...

Seanad: Residential Tenancies (Deferment of Termination Dates of Certain Tenancies) Bill 2022: Second Stage (27 Oct 2022)

John Cummins: I thank the Cathaoirleach. The Department must put in quick underwritten finance to local authorities to allow them to actively pursue the acquisition of properties. The local authorities in Cork and Galway mentioned that they have more than 50 and 36 interested applications. If every local authority acquired 50 properties where notices to quit are in place between now and the end of...

Seanad: Residential Tenancies (Deferment of Termination Dates of Certain Tenancies) Bill 2022: Second Stage (27 Oct 2022)

John Cummins: The Irish Property Owners Association, IPOA, and the Institute of Professional Auctioneers and Valuers, IPAV, have done so.

Seanad: Residential Tenancies (Deferment of Termination Dates of Certain Tenancies) Bill 2022: Second Stage (27 Oct 2022)

John Cummins: On a point of order, please.

Seanad: Residential Tenancies (Deferment of Termination Dates of Certain Tenancies) Bill 2022: Second Stage (27 Oct 2022)

John Cummins: The Senator can go back to the comments that I made. I specifically referenced a meeting by the Oireachtas joint committee with the IPOA and IPAV. I wish to clarify that I did not make these comments but the comments were made by both representative organisations. The Senator can paint this in whatever way he wishes but that is not what was said.

Seanad: Residential Tenancies (Deferment of Termination Dates of Certain Tenancies) Bill 2022: Committee and Remaining Stages (27 Oct 2022)

John Cummins: To clarify, does this grouping consist of amendments Nos. 6 to 12, inclusive?

Seanad: Residential Tenancies (Deferment of Termination Dates of Certain Tenancies) Bill 2022: Committee and Remaining Stages (27 Oct 2022)

John Cummins: I assume amendment No. 5 has been ruled out of order because the latter part of Senator Moynihan's amendment relates to a dispute on the value of the property being referred to the board, rather than to the substance of the original point raised during our Second Stage speeches. Can the Minister of State confirm that some mechanism will be put in place so that the RTB can notify the local...

Seanad: Residential Tenancies (Deferment of Termination Dates of Certain Tenancies) Bill 2022: Committee and Remaining Stages (27 Oct 2022)

John Cummins: On amendments Nos. 7 and 12, relating to the non-payment of rent as a ground for a termination notice, we are enabling that to continue given that, on the other side of every tenancy, there is a landlord who has obligations to his or her bank in regard to paying back loans. It is important to point out in this space that this was another item raised at our Oireachtas joint committee by the...

Seanad: Residential Tenancies (Deferment of Termination Dates of Certain Tenancies) Bill 2022: Committee and Remaining Stages (27 Oct 2022)

John Cummins: Shouting is not the way.
