Topical Issue Debate: Legal Costs (13 Dec 2017)

Charles Flanagan: While I appreciate that Deputy Casey would support the provision of civil legal aid to small businesses and enterprises, it is important that we do not lose sight of the enhanced and much more transparent legal cost regime that is being introduced at the moment under the Legal Services Regulation Act 2015. This will impose greater transparency obligations on barristers and solicitors in the...

Topical Issue Debate: Legal Costs (13 Dec 2017)

Charles Flanagan: I acknowledge the important issue raised by Deputy Casey. At its root is the question of the impact of legal costs on small and medium enterprises in terms of their access to the courts and other means of legal redress. As such, the Deputy will appreciate that it is an issue which straddles both the Department of Justice and Equality and the Department of Business, Enterprise and Innovation...

Topical Issue Debate: Crime Levels (13 Dec 2017)

Charles Flanagan: I thank Deputy Broughan for raising this important public safety issue. I join him and other Members in extending my good wishes for a speedy recovery to the garda who was injured in the line of duty last week in Ballymun. Deputy Broughan will recall that I responded to his oral question on that issue on 5 December last. Today, his focus is on the impact of dangerous driving and...

Topical Issue Debate: Crime Levels (13 Dec 2017)

Charles Flanagan: I very much agree with the Deputy that local policing measures to address the issues to which he refers will undoubtedly benefit from the increased level of resources now coming on stream through the Garda recruitment programme. The Government has committed to increasing Garda numbers to 15,000 to provide the Commissioner with the capacity to address the needs of communities throughout the...

Charles Flanagan: I acknowledge the need for new Garda stations at Macroom and Clonmel. It is my intention to have both projects commence at the earliest possible opportunity next year. There are some outstanding conveyancing issues with this bundle of stations, but I expect them to be dealt with in the coming weeks. My intention is that the next bundle of Garda stations will commence construction in the...

Charles Flanagan: The electronic tagging scheme is under way on a pilot basis. The plan is to further expand and develop the scheme in accordance with appropriate resources.

Questions on Promised Legislation (13 Dec 2017)

Charles Flanagan: The legislation providing for electronic tagging is already in place. As regards further legislation, I refer the Deputy to the Criminal Justice Act 2017, which is now in force. I am unsure what further legislation he is referring to as regards the programme for Government. I will be happy to assist if he identifies the legislation.

Charles Flanagan: The position in relation to conviction statistics has already been clarified to the Deputy in the responses to Parliamentary Question Nos. 138 of 21 March 2017, 469 of 26 July 2017 and 556 of 7 November 2017; namely that the Courts Service is not in a position to match the prosecutions specified in the Deputy's question to court results. Written Answers — Department of Justice and Equality: Garda Reports (13 Dec 2017)

Charles Flanagan: I am advised by the Garda authorities that the number of ‘test purchasers’ used in any given test purchasing operation is not centrally recorded on PULSE.  Parental/Guardian consent and agreement forms are required for each operation and are retained locally at each District.  Consequently, An Garda Síochána is not in a position to provide the information...
