Seanad: Road Traffic Bill 2006: Committee Stage (Resumed). (14 Jun 2006)

Pat Gallagher: Perhaps it is a fixed charge we should be looking at. If the companies are prepared to pay the fixed charge, both Senator Brian Hayes and I are at one on this, two penalty points plus a fixed charge. For those who are not prepared to pay the fixed charge, I believe in this regard that it is a matter of enforcement and that the two penalty points and a fixed charge should have the desired...

Seanad: Road Traffic Bill 2006: Committee Stage (Resumed). (14 Jun 2006)

Pat Gallagher: There are delivery dockets that can be used as proof. There should be rigorous enforcement of this, which is a matter for another agency.

Pat Gallagher: Yes.

Seanad: Road Traffic Bill 2006: Committee Stage (Resumed). (14 Jun 2006)

Pat Gallagher: The Minister for Transport has power to declare offences to be fixed-charge offences for the purpose of enforcement under section 103 of the Road Traffic Act. The purpose of these amendments is to amend section 14 of the Bill to extend the range of offences that can be declared to be fixed-charge offences, and to provide that offences under the Road Transport Acts or any statutory instruments...

Seanad: Road Traffic Bill 2006: Committee Stage (Resumed). (14 Jun 2006)

Pat Gallagher: The amendment to section 3 of the Local Authorities (Traffic Wardens) Act is a mirror amendment of that to section 103 of the Road Traffic Act 1961. This amendment relates to the service of fixed-charge notices through affixing of the notices to vehicles by local authority traffic wardens, and the reference to that in any subsequent prosecution of the fixed-charge offence in question.

Seanad: Road Traffic Bill 2006: Committee Stage (Resumed). (14 Jun 2006)

Pat Gallagher: This is a technical amendment which deletes a superfluous reference to subparagraph (b) and leaves the provision as subsection 138(3).

Seanad: Road Traffic Bill 2006: Committee Stage (Resumed). (14 Jun 2006)

Pat Gallagher: The Bill provides that the offence of using a liable vehicle without having a speed limiter fitted will attract penalty points. Section 16(2)(e) of the Bill updates the legislative basis for the application of penalty points for speed limitation device offences. This technical amendment to section 16(2)(e) provides that offences relating to the installation of a non-approved and unsealed...

Pat Gallagher: It limits the speed of the vehicle.

Seanad: Road Traffic Bill 2006: Committee Stage (Resumed). (14 Jun 2006)

Pat Gallagher: It is on trucks and it is like the cruise control in cars.

Seanad: Road Traffic Bill 2006: Committee Stage (Resumed). (14 Jun 2006)

Pat Gallagher: Yes.

Seanad: Road Traffic Bill 2006: Committee Stage (Resumed). (14 Jun 2006)

Pat Gallagher: It is used for buses and goods vehicles, where goods vehicles are limited to 90 km/h and buses to 100 km/h. It does not affect other vehicles.

Seanad: Road Traffic Bill 2006: Committee Stage. (14 Jun 2006)

Pat Gallagher: Possibly not. It does not have to be done on the spot. I want to talk about the stage at which it should be known. While it is necessary for the State to keep a file, it would be a major event in any individual's life. If one loses one's licence it must be a red-letter day and almost as important as one's date of birth. If a person is asked or it is highlighted, it may overcome the...

Seanad: Road Traffic Bill 2006: Committee Stage. (14 Jun 2006)

Pat Gallagher: The reference to the Exchequer is a standard provision used in all Road Traffic Acts where money is received by the Garda Síochána and specifies the arrangement for the payment and disposal of moneys for the benefit of the Exchequer under the Minister for Finance. It would be inconsistent to change the term "Exchequer", which has been in use for many years, to "State".

Seanad: Road Traffic Bill 2006: Committee Stage. (14 Jun 2006)

Pat Gallagher: I appreciate Senator Quinn's motives in bringing forward these amendments and I was interested to hear about the situation in Finland where fines are related to one's income. It may have some merit, not today but in the future. On the proposed fines of €3,000 in amendments Nos. 51 and 91 we should take other factors into consideration. They are disproportionate to the range of fines for...

Seanad: Road Traffic Bill 2006: Committee Stage. (14 Jun 2006)

Pat Gallagher: The proposed new subsection (13) would have the effect of disqualifying a person in advance of a date specified in a notice under subsection (11), which is 14 days from the date of the notice. As the date of disqualification would be dependent on receipt of the notice, such a provision would be difficult, if not impossible, to enforce, it would be unwise to include it in the Bill. The Bill is...

Seanad: Road Traffic Bill 2006: Committee Stage. (14 Jun 2006)

Pat Gallagher: The notice will be issued by ordinary post and this could present a grey area. I will conduct discussions with the officials and legal advisers on this issue.

Seanad: Road Traffic Bill 2006: Committee Stage. (14 Jun 2006)

Pat Gallagher: I will have discussions on this issue and whether it can be proven easily. The Garda will be able to prove a notice was issued, but I take Senator McDowell's point and I will consider it.

Seanad: Road Traffic Bill 2006: Committee Stage. (14 Jun 2006)

Pat Gallagher: This is a drafting amendment.

Seanad: Road Traffic Bill 2006: Committee Stage. (14 Jun 2006)

Pat Gallagher: The Garda did not make a conscious decision that those who were at a level of between 80 mg and 100 mg of alcohol per 100 ml of blood should not be pursued. In the past, legislation stated clearly that a garda had to form an opinion on the level of alcohol consumed. I do not know of any cases of people who were not pursued at the level suggested, however, perhaps Senator McDowell does through...

Seanad: Road Traffic Bill 2006: Committee Stage. (14 Jun 2006)

Pat Gallagher: Any information, not of a sensitive nature, that is available to me will be made available to the House. It would be interesting to have a benchmark against which to measure the effectiveness of the new legislation so that we could compare statistics with those prior to the enactment of this Bill.
