- Joint Oireachtas Committee on International Surrogacy: Potential Double Standards in Protections for Surrogate Mothers in Domestic Arrangements: Discussion (26 May 2022)
Mary Seery Kearney: I suppose I should get down to business. At the age of seven, children are going through a developmental phase where they have, I believe Professor Golombok used the term, a "sophisticated understanding" with regard to their surrogacy. However, I think at that stage they have a more sophisticated understanding of relationships. That tends to be the phase when they do the “I love you...
- Joint Oireachtas Committee on International Surrogacy: Potential Double Standards in Protections for Surrogate Mothers in Domestic Arrangements: Discussion (26 May 2022)
Mary Seery Kearney: I thank both witnesses. I thank Professor Madden for giving us the opportunity to have this discussion. Senator Ruane a number of weeks ago, very early in our meetings, touched on the idea of a paternalistic attitude that women cannot make this decision for themselves because of their socio-economic background or the county in which they live. While I am not ignoring the fact that we need...
- Joint Oireachtas Committee on International Surrogacy: Potential Double Standards in Protections for Surrogate Mothers in Domestic Arrangements: Discussion (26 May 2022)
Mary Seery Kearney: We need to acknowledge that a year longer will be too long for families, in such cases as where a woman cannot sign a consent form and she cannot sign anything to do with a child. Any more kicking this down the road and carving it out is just giving an excuse for what is prohibition by a failure to legislate. This will be a failure to the children of our State.
- Joint Oireachtas Committee on International Surrogacy: Potential Double Standards in Protections for Surrogate Mothers in Domestic Arrangements: Discussion (26 May 2022)
Mary Seery Kearney: With respect, I really do appreciate that Dr. Tobin is setting out a pragmatic response to the situation. Both of the witnesses are doing so. I appreciate that that is not his intention. My concern is that there are flaws and gaps that have been left as a result of the Child and Family Relationships Act, which undermine same-sex couples in particular. On the issue of reciprocal IVF, the...
- Joint Oireachtas Committee on International Surrogacy: Potential Double Standards in Protections for Surrogate Mothers in Domestic Arrangements: Discussion (26 May 2022)
Mary Seery Kearney: Is the term “second-parent adoption” semantics for a bespoke parental order?
- Joint Oireachtas Committee on International Surrogacy: The Verona Principles: International Social Service (26 May 2022)
Mary Seery Kearney: I thank our guests for taking the time to be with us today. We are grateful they are here. At the core of the Verona Principles are the rights of the child. In that context, we want to ensure the child knows who he or she is and that the child has that fundamental right to his or her identity and gestational story. Attendant to that is the circumstances surrounding the birth. We must...
- Joint Oireachtas Committee on International Surrogacy: The Verona Principles: International Social Service (26 May 2022)

Mary Seery Kearney: That was thorough. I thank Ms Woellenstein.
- Joint Oireachtas Committee on International Surrogacy: The Verona Principles: International Social Service (26 May 2022)
Mary Seery Kearney: This has been a very useful engagement. It is worth noting that the principles are aspirational, and until such time as they are embedded in an international agreement, we will have to deal with the imperfect and take the principles as guidance. They will certainly be influential in our thinking as a committee in our recommendations for Irish law, but we must also wrestle with that...
- Joint Oireachtas Committee on International Surrogacy: The Verona Principles: International Social Service (26 May 2022)
Mary Seery Kearney: The integrated birth certificate sounds like a super model for us. How does that preserve a child's right to privacy? For a child to commence school, a birth certificate must be produced. How is the child's right to privacy preserved in that case in order that he or she is not discriminated against? I ask because it is the child's story ultimately whether there is a donor. It is the...
- Joint Oireachtas Committee on International Surrogacy: Preventing the Sale, Exploitation and Trafficking of Children: Discussion (19 May 2022)
Mary Seery Kearney: Good morning to Ms de Boer-Buquicchio. I thank her for giving of her time this morning. Her opening statement well signposts the two reports that she wrote and submitted to the UN General Assembly. In the conclusions to her 2018 report Ms de Boer-Buquicchio states, "Commercial surrogacy could be conducted in a way that does not constitute sale of children", and she goes on to explore that....
