Charles Flanagan: If it were to occur under current legislation, it would be a mere statement of the fact that the recommendation has not been accepted. Under the current amendment, Deputy Ó Laoghaire is going further than that in so far as a reasoned written explanation is concerned. That is where we are getting into constitutionally fraught territory. In fact, it is far more than the current requirement.
