Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Brexit Preparedness and Related Matters: Revenue Commissioners (24 Jan 2019)

Rose Conway Walsh: Okay. Revenue believes there is no need for legislation. Does it accept that, on the basis of the recent tax appeals determination 20-TACD-2018, there is a serious discrepancy between Revenue's published guidelines on the deductibility of travel and subsistence expenses and the strict legal interpretation which Revenue had argued in the course of the determination to which I refer? If...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Brexit Preparedness and Related Matters: Revenue Commissioners (24 Jan 2019)

Rose Conway Walsh: I am trying to get at the fairness around the issue. There are categories where subsistence is allowed and its conditions are set down strictly but for those who do not come within those categories, it must be unfair to not allow them to claim subsistence. How can it be different for two different categories of people?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Brexit Preparedness and Related Matters: Revenue Commissioners (24 Jan 2019)

Rose Conway Walsh: Would it not make sense to take the accumulation of case law and put it into legislation, to give us something modern, up to date and reflective of the working practices of people?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Brexit Preparedness and Related Matters: Revenue Commissioners (24 Jan 2019)

Rose Conway Walsh: This is all an expense to small and medium businesses. If it was put in legislation-----

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Brexit Preparedness and Related Matters: Revenue Commissioners (24 Jan 2019)

Rose Conway Walsh: Yes, but people then have to engage practitioners to interpret it and all of that. Would it not be better to just clear all that up?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Brexit Preparedness and Related Matters: Revenue Commissioners (24 Jan 2019)

Rose Conway Walsh: People just want fairness and consistency. I cannot see how legislation would be detrimental to them getting-----

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Brexit Preparedness and Related Matters: Revenue Commissioners (24 Jan 2019)

Rose Conway Walsh: However, if the Revenue Commissioners are not recommending any changes in legislation, obviously, the Minister will not feel compelled to change it. That can influence his thinking.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Brexit Preparedness and Related Matters: Revenue Commissioners (24 Jan 2019)

Rose Conway Walsh: From looking at all of these cases, it might be. We will submit all of the questions. I would appreciate it if Mr. Cody could come back with full answers as soon as possible. We need to get to the bottom of this because it is impacting on people's lives.

Seanad: An tOrd Gnó - Order of Business (23 Jan 2019)

Rose Conway Walsh: Today I want to talk about the new Bill that will be introduced by my colleague, Deputy Pearse Doherty, in the Dáil tomorrow. It is the no consent, no sale Bill and its central message is quite simple but fundamental. A loan secured by a mortgage of a residential property may not be transferred without the written consent of the borrower. This is already in the voluntary code of...

Seanad: An tOrd Gnó - Order of Business (22 Jan 2019)

Rose Conway Walsh: I want to also extend my sympathies to the wife and family of former Senator, Mr. Mark Killilea. I certainly want to condemn the car bomb in Derry and the other actions and I welcome the fact that it has been condemned by all leadership in the North and every right-minded citizen. There is no support or tolerance for that behaviour. We have a pathway to peace. We have peace and a pathway...

Joint Oireachtas Committee on Agriculture, Food and the Marine: Joint Meeting of the Joint Committee on Agriculture, Food and the Marine and the Joint Committee on Rural and Community Development
Common Agricultural Policy: Discussion
(22 Jan 2019)

Rose Conway Walsh: I apologise for my absence but I had to step out of the meeting. Most of my questions have been answered. However, I have a few questions on the strategic plan. How much will the strategic plan cost? I ask the officials to again outline the following. At what point will we have the first look or draft in order that we can feed into it? Until we have the draft we will be talking in a...

Rose Conway Walsh: It is important to this committee, because the outcome of that review will inform part of the strategic plan. The deadline for that is January 2020, so it really should be considered as part of that.

Rose Conway Walsh: Is Mr. Hayes getting extra resources within the Department to do that? Does he have sufficient resources to meet the deadlines involved in the additional burden of the strategic plan?

Rose Conway Walsh: Mr. Hayes stated that everyone in AEOS had the opportunity to transition to GLAS. Some of them were not suitable for GLAS and that scheme was not an option for many of them. This is quite serious. Mr. Hayes is saying they will have no scheme available to them until after January 2021. They must operate for the whole of this year and next year without anything to replace AEOS.
