State Examinations (19 Apr 2012)

Seán Sherlock: I have full sympathy for the point made by the Deputy. While he makes a logical and cogent case, if I am to be honest, we must speak to the independence of the State Examinations Commission in terms of the role of superintendents and so forth. The Deputy is absolutely right. The Minister for Education and Skills made statements on the role of retired teachers. I respectfully ask the Deputy...

Written Answers — Research Funding: Research Funding (18 Apr 2012)

Seán Sherlock: The Programme for Government contains a commitment to establish a network of Technology Research Centres designed to accelerate the exploitation of new technologies and bridge the gap between research and technology commercialisation. Technology centres are public-private research centres of excellence that connect industry to the higher education sector to increase the generation and...

Thirtieth Amendment of the Constitution (Treaty on Stability, Coordination and Governance in the Economic and Monetary Union) Bill 2012: Second Stage (Resumed) (18 Apr 2012)

Seán Sherlock: I wish to share time with Deputies Paschal Donohoe and Heather Humphreys.

Thirtieth Amendment of the Constitution (Treaty on Stability, Coordination and Governance in the Economic and Monetary Union) Bill 2012: Second Stage (Resumed) (18 Apr 2012)

Seán Sherlock: I welcome the announcement by Mylan Incorporated of 220 jobs in the Gaeltacht in Connemara. This is a testament to the hard work that has been done by the Government in spite of the awful economic morass in which we find ourselves as a result of the previous speaker's Government's actions. In spite of that economic morass in which we find ourselves, we are still winning new business and new...

Written Answers — Proposed Legislation: Proposed Legislation (29 Mar 2012)

Seán Sherlock: The Minister for Jobs, Enterprise and Innovation Richard Bruton T.D established the Copyright Review Committee on 9th May, 2011 to examine the current Copyright legislative framework to identify any areas of the legislation that might be deemed to create barriers to innovation and to make recommendations to resolve any problems identified. The Review will ultimately present a Report with a...

Job Protection (28 Mar 2012)

Seán Sherlock: I thank Deputies Nash, Terence Flanagan and Kirk for raising this matter. This is the second time in the space of a year that Vodafone and its operations have become the subject of a Topical Issue Debate in this House. I am very conscious of the anxiety that the proposed transfer of the 290 agency posts and 27 direct Vodafone posts to Teleperformance creates for the workers and their...

Job Protection (28 Mar 2012)

Seán Sherlock: A number of issues have been raised. I have no problem in principle with the Members from counties Louth and Dublin seeking a meeting with the Minister for Jobs, Enterprise and Innovation, Deputy Bruton, about this matter. In the first instance, there are national and strategic issues in regard to the precarious nature of call centre jobs. There is the issue of the transfer of undertakings...

Job Protection (28 Mar 2012)

Seán Sherlock: If the Members present who raised the issue are willing to meet the Minister, I will make that request of him. Let us see where we go from there. I thank the Ceann Comhairle.

Written Answers — Intellectual Property Rights: Intellectual Property Rights (27 Mar 2012)

Seán Sherlock: As the Deputy is aware, Regulatory Impact Analysis (RIA) is a tool used by Government Departments and Offices for the structured exploration of different options to address particular policy issues and it is used where one or more of these options is new regulation or a regulatory change. This process helps to identify any possible side effects or hidden costs associated with new regulation...

Written Answers — Intellectual Property Rights: Intellectual Property Rights (27 Mar 2012)

Seán Sherlock: I wish to inform the Deputy that the staff at the Department of Jobs, Enterprise and Innovation are aware of the United States of America special report 301, which is an annual review of the global state of intellectual property rights protection and enforcement, conducted by the Office of the United States Trade Representative. As you are aware, counterfeiting and piracy are now serious...

Written Answers — Research and Development Fund: Research and Development Fund (27 Mar 2012)

Seán Sherlock: I propose to take Questions Nos. 276 to 278, inclusive, together. The information sought in relation to Enterprise Ireland research and development and small projects, is taken to refer to Enterprise Ireland's support for in-company Research and Development under the R&D Fund. The total amount approved under Enterprise Ireland's in-company R&D project support funds for each of the past five...

Written Answers — EU Directives: EU Directives (21 Mar 2012)

Seán Sherlock: I will provide the Deputy with a list of all the written representations made to me and to Minister Bruton regarding SI No. 59 of 2012, the European Union (Copyright and Related Rights) Regulations 2012. It should be noted that this information has recently been released by the Department of Jobs, Enterprise and Innovation following a request under the Freedom of Information Act 1997.

Written Answers — Telecommunications Services: Telecommunications Services (13 Mar 2012)

Seán Sherlock: As the Deputy is aware it is prohibited under existing legislation within the State to illegally hack into the wireless internet of a third party. It is a matter for the Garda Síochána to investigate and prosecute any such illegal activity involving the illegal hacking into a third parties' wireless internet. Access to the internet is normally the subject of a contract between an...

Seán Sherlock: Deputy Dooley will have to get up a bit earlier in the morning.

Order of Business (13 Mar 2012)

Seán Sherlock: He had his opportunity.

EU Regulations: Motions (13 Mar 2012)

Seán Sherlock: I move the following motions: That Dáil Éireann approves the exercise by the State of the option or discretion under Protocol No. 21 on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, to take part in the adoption and application of the...

Special Educational Needs (13 Mar 2012)

Seán Sherlock: I thank Deputy Michael McGrath for raising this issue. As the Deputy is aware 10,575 special needs assistant posts are available for allocation to schools for the 2012-13 school year. This is the same number of posts available for allocation in the current school year. Therefore, there has been no reduction in the overall number of SNA posts available for allocation in the coming school...

Special Educational Needs (13 Mar 2012)

Seán Sherlock: I thoroughly respect the fact that the Deputy must advocate for the school in his constituency and I do not doubt the veracity of the case made by him in respect of the school and the good work it carries out. However, the Deputy has admitted an overall cap is in place. A process is under way in respect of SNA allocation and we should have regard to this fact. The Deputy's claim that this...

Industrial Disputes (13 Mar 2012)

Seán Sherlock: I thank Deputy Dowds for raising this matter and for the opportunity to respond. Stobart Ireland is part of the Stobart Group which, I understand, operates from over 40 sites across the UK and Europe. Stobart Ireland began operating in 2008 winning the transport services contract with Tesco in 2010 to distribute all of the products it keeps at depots at Ballymun and Donabate in Dublin. On...

Industrial Disputes (13 Mar 2012)

Seán Sherlock: I take the Deputy's point. In response, I contend that the legitimacy of the Labour Relations Commission, which has opened its doors to facilitate a process, is one the State, Irish workers and most employers buy into. That is the right way to proceed on this issue. I hope the Stobart organisation will have due regard to that process.
