Seanad: Multi-Unit Developments Bill 2009: Committee Stage (10 Mar 2010)

Ivana Bacik: I apologise for not being here to move the amendment and I am very grateful to my colleague, Senator Prendergast, who did so. I was attending a committee meeting. I am grateful to the Minister for indicating he has a certain sympathy for this amendment, particularly in light of the changing economic position. With the housing market more or less collapsing, the fear that this would lead to...

Seanad: Order of Business. (10 Mar 2010)

Ivana Bacik: Will the Leader indicate when the Immigration, Residence and Protection Bill is likely to come before the House? I am aware the legislation is still before a select committee and I understand an unprecedented number of amendments, some 700 in total, have been listed for the Bill. It is a matter of particular interest to learn when the legislation will come before the House as it is likely...

Seanad: Order of Business. (10 Mar 2010)

Ivana Bacik: No, it relates to crimes that are alleged to have taken place in this jurisdiction.

Seanad: Order of Business. (10 Mar 2010)

Ivana Bacik: The issue was discussed on television last night and the individual in question was convicted in 1983 in this jurisdiction. The Murphy commission indicates that 32 individuals made complaints or allegations against this man. A number of these complaints were made to the Garda. Questions need to be answered as to the reason this man was allowed to run a family friendly guesthouse in...

Seanad: Order of Business. (9 Mar 2010)

Ivana Bacik: In answer to Senator O'Toole and speaking as someone who grew up in Cork, the interests of God and Munster are often conflated.

Seanad: Order of Business. (9 Mar 2010)

Ivana Bacik: I second Senator Fitzgerald's amendment to the Order of Business, calling for a debate today on women's participation in politics. The Leader promised us such a debate this week. As yesterday was International Women's Day, it would be timely to have such a debate this week. As the House is well aware, last October the Joint Committee on Justice, Equality, Defence and Women's Rights...

Seanad: Order of Business. (9 Mar 2010)

Ivana Bacik: It is an anomaly; I see that the Leader is agreeing with me.

Seanad: Order of Business. (9 Mar 2010)

Ivana Bacik: I am sorry; I thought he was nodding in agreement. In 2010 it is no longer acceptable that we are holding to a quaint notion that Good Friday is a day on which alcohol cannot be consumed. I am not saying we should have drunkeness on the streets. However, as Senator O'Toole said, let those of us who do not believe Good Friday is a particularly special day choose to do what we want to do in...

Seanad: Order of Business (3 Mar 2010)

Ivana Bacik: On a point of order, the Leader promised he would revert to me regarding a debate on the Sub-Committee on Women's Participation in Politics.

Seanad: Order of Business (3 Mar 2010)

Ivana Bacik: I am obliged.

Seanad: Order of Business (3 Mar 2010)

Ivana Bacik: Hear, hear.

Seanad: Order of Business (3 Mar 2010)

Ivana Bacik: I second the amendment proposed by Senator Fitzgerald calling for a debate on this most disturbing report, which is of deep concern to all of us. In 2010, with all the revelations and reports we have had, we are still seeing such immense failings in our child protection system. I also seek a debate on banking on a day when the front page of the Irish Independent states AIB will impose a 0.5%...

Seanad: Order of Business (3 Mar 2010)

Ivana Bacik: It is most unedifying. In the criminal system there is much criticism of the rotating door in the prison system. It would be more damaging to see a rotating door in the Cabinet as Green Party Ministers come and go out of office in order to give everyone a share of the spoils. I also ask for a debate on third level education. As someone who has been involved in third level education for...

Seanad: Order of Business (3 Mar 2010)

Ivana Bacik: On a point of order, the Labour Party never played pass the parcel with ministerial office.

Seanad: Order of Business (3 Mar 2010)

Ivana Bacik: Will the Senator vote with us?

Seanad: Criminal Justice (Money Laundering and Terrorist Financing) Bill 2009: Second Stage (2 Mar 2010)

Ivana Bacik: Like the other speakers, I welcome the Minister of State and the Bill. I believe it was welcomed on all sides in the Dáil too on Second Stage in November, followed by the Committee and Report Stages in January and February, respectively. Like Senator Regan, however, I am somewhat critical of the Government in terms of the delay in bringing forward this legislation which we all agree is...

Seanad: Criminal Justice (Money Laundering and Terrorist Financing) Bill 2009: Second Stage (2 Mar 2010)

Ivana Bacik: I accept the Minister of State's point that the timeframe was an issue. I wish to speak briefly about the specifics of the Bill. I welcome the broader definition of "criminal conduct" and "proceeds of crime" in section 6 and the cross-border dimension. I note, and the Minister highlighted, the interesting mens rea requirement for the crime of money laundering, namely, that it can be proven...

Seanad: Criminal Justice (Money Laundering and Terrorist Financing) Bill 2009: Second Stage (2 Mar 2010)

Ivana Bacik: I beg the Chair's indulgence. There are two interesting models elsewhere. In Britain a five year strategy has been adopted in conjunction with its legislation on anti-money laundering and counter terrorist financing. In Belgium the legislation is to include a question and answer form for evaluation of clients' risk profile. That would be a useful model for us to adapt in this legislation....

Seanad: Criminal Justice (Money Laundering and Terrorist Financing) Bill 2009: Second Stage (2 Mar 2010)

Ivana Bacik: ——and whether it is appropriate for the Minister to act as monitor for designated persons but I look forward to discussing all of those issues and more on Committee Stage.

Seanad: Criminal Justice (Money Laundering and Terrorist Financing) Bill 2009: Second Stage (2 Mar 2010)

Ivana Bacik: Can one chase a red herring?
