Written Answers — Army Barracks: Army Barracks (21 Feb 2007)

Willie O'Dea: As I indicated in my reply to Parliamentary Question No. 350 on 14th February, 2007, following on the Government decision to close and sell Clancy Barracks, Dublin City Council expressed an interest in having the property made available for affordable and social housing. Meetings were held between my Department, the City Council and the then Department of the Environment and Local...

Written Answers — Defence Forces Recruitment: Defence Forces Recruitment (21 Feb 2007)

Willie O'Dea: I have been advised by the military authorities that an application for enlistment in the Reserve Defence Force from the individual concerned was made in September, 2006. Unfortunately, there was a delay in the processing of the application due to the fact that, during the course of staff redeployments at that time, the application was temporarily misplaced. I am advised that the...

Leaders' Questions (21 Feb 2007)

Willie O'Dea: Did Deputy Cuffe sell those shares yet?

Written Answers — Defence Forces Recruitment: Defence Forces Recruitment (20 Feb 2007)

Willie O'Dea: The position is that the day to day administration of recruitment to the Defence Forces is the responsibility of the Chief of Staff. I have been informed, by the military authorities, that the most recent advertisements placed seeking applications for positions in the Permanent Defence Force were for the Cadetship Competition 2007. The details of the number of applications received for this...

Written Answers — Decentralisation Programme: Decentralisation Programme (20 Feb 2007)

Willie O'Dea: The Government Decision on decentralisation provides for the relocation of the Dublin-based offices of my Department to Newbridge, Co. Kildare. A total of 200 staff will move to the new location. While the site upon which the new office accommodation will be built will be sold by Kildare County Council to the Office of Public Works and the preferred tenderer to construct the building has...

Written Answers — Departmental Staff: Departmental Staff (15 Feb 2007)

Willie O'Dea: No paid staff of the Department or the Minister's constituency office were involved in the making of these calls.

Written Answers — Defence Forces Property: Defence Forces Property (14 Feb 2007)

Willie O'Dea: At the outset I would like to say that Dublin City Council was given ample opportunity to acquire Clancy Barracks. The Government, on the 15th July, 1998, approved a programme of evacuation and sale of six barracks, including Clancy Barracks, Islandbridge, Dublin. Following on the Government decision Dublin City Council expressed an interest in having the property made available for...

Written Answers — Defence Forces Property: Defence Forces Property (14 Feb 2007)

Willie O'Dea: Personnel on being discharged from the Permanent Defence Force are obliged to vacate married quarters within a short period of the dates of their discharge. In the case of the individual in question, I am advised that he was discharged on the 29 October 2006 after five years service. He should have vacated married quarters on the 19 November 2006 but did not do so. The provision of housing...

Order of Business (14 Feb 2007)

Willie O'Dea: We will get it through with the co-operation of Deputy Costello and other Opposition Members.

Seanad: Defence (Amendment) (No. 2) Bill 2006: Report and Final Stages (13 Feb 2007)

Willie O'Dea: When this matter was raised on Committee Stage I undertook to consider it between then and the debate in the Dáil, but as the amendment has been raised again here, I have once more taken the advice of the Office of Parliamentary Counsel on the matter. There are many possible approaches to amending Acts that have not been gender proofed and each instance is examined on its own merits, rather...

Seanad: Defence (Amendment) (No. 2) Bill 2006: Report and Final Stages (13 Feb 2007)

Willie O'Dea: We are taking other measures to encourage women to join the Army but I take the Senator's point. As Senator Tuffy will be aware, this is only part of the legislation that we are introducing, following the first part of the recommendations of the committee. Further legislation will be introduced later to adopt the second part of the committee's proposals and the matter raised by the Senator...

Seanad: Defence (Amendment) (No. 2) Bill 2006: Report and Final Stages (13 Feb 2007)

Willie O'Dea: The current provisions were modelled on section 5 of the Criminal Justice Act 1993 rather than on the Criminal Procedure Act 1993 to which I may have referred on Committee Stage, and I apologise for this error. I am not aware of any amendment made, to date, regarding section 5 of the Criminal Justice Act 1993. While I have no objection to the intention of the proposed amendment, I do not...

Seanad: Defence (Amendment) (No. 2) Bill 2006: Report and Final Stages (13 Feb 2007)

Willie O'Dea: In marking the passage of this legislation through the Seanad, I thank Senators from all sides of the House who contributed to the debate. The amendments proposed and accepted have improved the Bill. In particular, the provisions relating to the appointment of the military judge and chief military judge benefited from amendment and reflect the status attaching to these positions. The Bill...

Written Answers — Defence Forces Staff: Defence Forces Staff (13 Feb 2007)

Willie O'Dea: I have been advised by the military authorities that an appeal has been made to the relevant military authority in this matter and, as a consequence, it would not be appropriate for me to comment at this stage.

Written Answers — Airport Safety Zones: Airport Safety Zones (13 Feb 2007)

Willie O'Dea: It is the policy and objective of the Department of Defence to ensure the safety of air traffic, present and future, en route to and from Casement Aerodrome. The current safety policy, a copy of which was forwarded to South Dublin County Council in 2000, reflects best international practice in accordance with International Civil Aviation Organisation standards and recommendations and...

Written Answers — EU Funding: EU Funding (13 Feb 2007)

Willie O'Dea: A proportion of expenditure by my Department on equipment for fishery protection purposes is eligible for recoupment from the EU. Such receipts are shown as Appropriations-in-Aid in the Estimates and Appropriation Accounts for the Defence Vote. The amount received each year from 2000 to 2006 is as follows: Year â'¬m 2000 2.2 2001 3.2 2002 0.2 2003 0.0 200 0.7 2005 0.9 2006 0.0

Seanad: Defence (Amendment) (No. 2) Bill 2006: Committee Stage (8 Feb 2007)

Willie O'Dea: Section 33 provides that the director of military prosecutions is referred to as the director in the Act. This minor amendment to schedule 1 deletes the words "of Military Prosecutions" so the phrase now correctly reads "on the directions of the director, the person may". The amendment simply tightens up the language.

Seanad: Defence (Amendment) (No. 2) Bill 2006: Committee Stage (8 Feb 2007)

Willie O'Dea: This matter was referred to during the Second Stage debate. This amendment inserts a new section into the Courts-Martial Appeals Act 1983 to include the referral of questions of law from a summary court martial to the court martial appeal court within the scope of legal aid. This is in line with the practice in the ordinary criminal law system. It was unfortunately omitted from the...

Seanad: Defence (Amendment) (No. 2) Bill 2006: Committee Stage (8 Feb 2007)

Willie O'Dea: The proposed amendments seek to change the text of the Bill to reflect that communications made with the Director of Military Prosecutions or a member of his staff on behalf of another person do not come within the scope of the offence of improper communication with the director. The Bill already provides that communications with the Director of Military Prosecutions made by legal and...

Seanad: Defence (Amendment) (No. 2) Bill 2006: Committee Stage (8 Feb 2007)

Willie O'Dea: The amendment would be consistent with Article 30.3 of the Constitution in respect of the prosecution of offences on indictment, which employs the phrase "in the name of the People and at the suit of the Attorney General". The Prosecution of Offences Act 1974 transferred the powers of the Attorney General regarding the prosecution of offences to the DPP. In the case, therefore, of an...
