Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Report and Final Stages. (22 Oct 2003)

Sheila Terry: I second the amendment.

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Report and Final Stages. (22 Oct 2003)

Sheila Terry: I second the amendment. I am disappointed the Minister has not brought forward an amendment dealing with what we spoke about last week, specifically my amendment regarding any representations made by the victim or next of kin of the victim regarding the proposal to direct the release of a person from prison. The Minister should take those representations into consideration when considering a...

Sheila Terry: I second the amendment.

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Report and Final Stages. (22 Oct 2003)

Sheila Terry: I move amendment No. 13: In page 5, between lines 23 and 24, to insert the following: "(5) Notice of a direction under this section shall be given to the person (or next-of-kin of that person) against whom the offence was committed.".

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Report and Final Stages. (22 Oct 2003)

Sheila Terry: I move amendment No. 14: In page 6, line 22, to delete "shall come" and substitute "comes". This is a simple amendment, which the Minister of State could not accept on Committee Stage. The Law Reform Commission recommends that, when drafting legislation, simple language in the active voice should be used. Legislation should be clear and readable and I ask him to accept the amendment.

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Report and Final Stages. (22 Oct 2003)

Sheila Terry: I thank the Minister and his staff for the time they put into the legislation and for their helpful comments and replies. I look forward to a review of the victims' charter. Perhaps more can be done under the charter to provide greater rights for victims. While it must be recognised offenders have rights, we hear too often about victims who feel they have been hard done by.

Seanad: Irish Nationality and Citizenship and Ministers and Secretaries (Amendment) Bill 2003: Second Stage. (22 Oct 2003)

Sheila Terry: I, too, commend Senator Quinn for initiating this Bill. It is overdue and I am glad he had the courage and, indeed, the time to do it. I also welcome the Minister's support for the Bill even if he intends to put down many amendments or, perhaps, introduce another Bill. The fact that the Minister will not oppose the Bill is a great compliment to Senator Quinn and the work he put into the Bill....

Seanad: Irish Nationality and Citizenship and Ministers and Secretaries (Amendment) Bill 2003: Second Stage. (22 Oct 2003)

Sheila Terry: It has taken all this time and many occurrences in the meantime to bring us to this day when something is being done about it. The worst aspect of it was the passports for sale scheme. I do not have a figure for how many passports were sold in this manner. Perhaps the Minister could supply it. It was dreadful how the criteria for granting these passports were ignored. In approximately 20...

Seanad: Irish Nationality and Citizenship and Ministers and Secretaries (Amendment) Bill 2003: Second Stage. (22 Oct 2003)

Sheila Terry: The Minister referred to Deputy John Bruton. Deputy Bruton has been greatly maligned in this regard, particularly by the previous Minister, Deputy O'Donoghue. The Minister can correct me if I am wrong but I understand that Deputy Bruton wrote to Alan Dukes about granting citizenship to people who might invest huge sums of money in this country. However, that is where it ended. Alan Dukes did...

Seanad: Irish Nationality and Citizenship and Ministers and Secretaries (Amendment) Bill 2003: Second Stage. (22 Oct 2003)

Sheila Terry: It was better than the corruption that followed.

Seanad: Irish Nationality and Citizenship and Ministers and Secretaries (Amendment) Bill 2003: Second Stage. (22 Oct 2003)

Sheila Terry: A pet food company.

Seanad: Order of Business. (15 Oct 2003)

Sheila Terry: I would like the Leader to invite the Minister for Justice, Equality and Law Reform to come into the House to outline how he is going to counter the gangland warfare that is operating in Dublin and Limerick and other parts of the country at the moment. Recently there was a sixth murder in as many months in Finglas in Dublin. Residents in that area live in fear. The investigations of these...

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I move amendment No. 2: In page 3, lines 17 to 19, to delete "such person as is specified in the direction (being a person who is serving a sentence of imprisonment)" and substitute the following "a person who is serving a sentence of imprisonment". I welcome the Minister of State. I propose the deletion of the words "such person as is specified in the direction (being a person who is serving...

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I am disappointed that the Minister will not accept my amendment. He knows that the Law Reform Commission previously criticised the wording of legislation and asked that legislators keep this point in mind when drafting legislation. This particular wording is a classic case and I would expect the commission to point out that this is not the wording it would have preferred. I have to accept...

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I support Senator Tuffy's amendments. It is time that legislation accurately reflected our laws in terms of equality and accuracy and "person" would describe either male or female. That is how we should deal with legislation and I ask the Minister to accept the amendments.

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: It might be better to discuss the other amendments first as it will be easier to deal with amendment No. 17 depending on the outcome of the other amendments.

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I move amendment No. 9: In page 4, between lines 19 and 20, to insert the following new paragraph: "(d) any representations made by the victim or next-of-kin of the victim on the proposal to direct the release of the person from prison,". On Second Stage I discussed the need to strike a balance between the rights of victims as against those of the criminal. I suggested that I would bring...
