Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Obstetric Medicine in the Netherlands: Professor Sjef Gevers and Professor Eva Pajkrt, University of Amsterdam (23 Nov 2017)

Anne Rabbitte: In this country, according to Ms Justice Laffoy and the other senior counsel we had in, they have to go before the courts. That brings gestation times into it. It was a question I raised a number of weeks ago. I am spokesperson for children in my party. We have 6,300 children in care in Ireland and somebody has to articulate these questions on their behalf. How are we to address that...

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Obstetric Medicine in the Netherlands: Professor Sjef Gevers and Professor Eva Pajkrt, University of Amsterdam (23 Nov 2017)

Anne Rabbitte: It is just one of those loopholes. I think there is going to be a huge challenge around it. It has to do with children in care. The last day, when we had our own legal professionals before the committee, they clearly told me the process at present. I do not know from a legislative point of view how we can address this anomaly in the system. It is going to be a huge issue. I found the...

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Obstetric Medicine in the Netherlands: Professor Sjef Gevers and Professor Eva Pajkrt, University of Amsterdam (23 Nov 2017)

Anne Rabbitte: I would like Professor Pajkrt to do so.

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Obstetric Medicine in the Netherlands: Professor Sjef Gevers and Professor Eva Pajkrt, University of Amsterdam (23 Nov 2017)

Anne Rabbitte: I thank Professor Pajkrt for expanding on that. My final question is really just a comment. Many witnesses have appeared before us. They have talked about people being coerced or persuaded into seeking or avoiding terminations. When women present at Professor Pajkrt's clinic, does it persuade them that going through with it is the right decision? What is her clinic's involvement?

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Obstetric Medicine in the Netherlands: Professor Sjef Gevers and Professor Eva Pajkrt, University of Amsterdam (23 Nov 2017)

Anne Rabbitte: I thank Professor Pajkrt.

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Obstetric Medicine in the Netherlands: Professor Sjef Gevers and Professor Eva Pajkrt, University of Amsterdam (23 Nov 2017)

Anne Rabbitte: May I ask a question on the statistics? Professor Pajkrt mentioned that as many people did not abort as did when they discovered that their children had Down's syndrome. Does she have statistics on that?

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Business of Joint Committee (22 Nov 2017)

Anne Rabbitte: I hear everything the speakers before me have said and I agree with what Deputy O'Connell has just said. It was to examine and have a good variation between urban and rural. We have had the World Health Organization and the best of people before us. The only reason for my fair, balanced and reasoned commentary last week was that there is a narrative out there. The last thing I want when I...

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Business of Joint Committee (22 Nov 2017)

Anne Rabbitte: That is an exaggeration. Deputy McGrath has it wrong.

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: International Context: Dr. Patricia Lohr, British Pregnancy Advisory Service (22 Nov 2017)

Anne Rabbitte: I thank Dr. Lohr for her presentation earlier. I am seeking clarification more than anything else because many of the questions have been asked. Perhaps Dr. Lohr could explain this to me. It is possibly a lack of understanding on my behalf but when a person presents for an abortion at one of the British Pregnancy Advisory Service clinics - I am just trying to tease out the idea here - is...

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: International Context: Dr. Patricia Lohr, British Pregnancy Advisory Service (22 Nov 2017)

Anne Rabbitte: I was merely curious.

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: International Context: Dr. Patricia Lohr, British Pregnancy Advisory Service (22 Nov 2017)

Anne Rabbitte: Yes, particularly for late presentations. If a person has presented at 20, 23 or 24 weeks, and this goes back to the viability, does BPAS give her the opportunity of the conversation beforehand or do women come with a definite mind that they are there to have the procedure performed?

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Termination in Cases of Foetal Abnormality: One Day More (Resumed) (22 Nov 2017)

Anne Rabbitte: I thank Ms McDermott for her presentation earlier on. I am one for direct questions as well. Ms McDermott stated earlier on that she believed the child has equal rights to those of the mother. Is that correct?

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Termination in Cases of Foetal Abnormality: One Day More (Resumed) (22 Nov 2017)

Anne Rabbitte: Where the life of the mother is at risk, what does she believe along those lines?

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Termination in Cases of Foetal Abnormality: One Day More (Resumed) (22 Nov 2017)

Anne Rabbitte: She could lose her life.

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Termination in Cases of Foetal Abnormality: One Day More (Resumed) (22 Nov 2017)

Anne Rabbitte: Is there a choice to be made between-----

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Termination in Cases of Foetal Abnormality: One Day More (Resumed) (22 Nov 2017)

Anne Rabbitte: All right. No, no, I just needed-----

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Termination in Cases of Foetal Abnormality: One Day More (Resumed) (22 Nov 2017)

Anne Rabbitte: To me, they are not, to be honest with Ms McDermott. When I talk about risk to the mother, I think about the mother whose life is at risk and who could have three other children at home. That is the life of the mother. That is why I sit on this committee. I have sat here for the past number of weeks to welcome the people here to inform me. This is the one part I battle with. I battle...

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Termination in Cases of Foetal Abnormality: One Day More (Resumed) (22 Nov 2017)

Anne Rabbitte: Intervention, yes.

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Termination in Cases of Foetal Abnormality: One Day More (Resumed) (22 Nov 2017)

Anne Rabbitte: No doctor will say that it is at present because, under the legislation, we have his or her hands tied. Legally, they are tied because there is a 14 year sentence for them to make a decision.

Joint Oireachtas Committee on the Eighth Amendment of the Constitution: Termination in Cases of Foetal Abnormality: One Day More (Resumed) (22 Nov 2017)

Anne Rabbitte: All right.
