Billy Kelleher: It is not necessarily the case that the CEO will be absent due to illness. The legislation refers to a vacancy. When a vacancy arises an employee of the organisation could fill in as acting CEO forever and a day. Vacancies should be filled by advertising and recruiting procedures based on best practice.
