Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Cooperative Societies Bill 2022: Discussion (15 Feb 2023)

Paul Gavan: That is an important point, I thank Mr. Moyne for that.

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Cooperative Societies Bill 2022: Discussion (15 Feb 2023)

Paul Gavan: I thank the Acting Chairman for his patience. I have some follow-up questions. I want to revisit the issue of asset locks because as members know asset locks have been in place for credit union members for some time and have worked extremely well. We have seen many times in the US, as in most capitalist countries, how co-operatives change their status to limited companies to the detriment...

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Cooperative Societies Bill 2022: Discussion (15 Feb 2023)

Paul Gavan: I put it to Mr. Flanagan that if we had that attitude towards the credit union sector, we would not have a credit union sector at this point.

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Cooperative Societies Bill 2022: Discussion (15 Feb 2023)

Paul Gavan: It would all have sold out. That is my concern. Do the other witnesses have a view on that before I move onto my next question?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Cooperative Societies Bill 2022: Discussion (15 Feb 2023)

Paul Gavan: I thank Mr. Moyne. That is a useful point to add. Sinn Féin welcomes many aspects of the legislation. We are passionate about co-ops. We have a policy document that has been well developed for a few years. The legislation does not specifically deal with instances of succession planning, liquidation, administration or the sale of companies. Given there are large numbers of people...

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Cooperative Societies Bill 2022: Discussion (15 Feb 2023)

Paul Gavan: That is a good point to clarify. I am concerned about what happens to small businesses when people retire. EU research has been done on this. I propose that this legislation could, perhaps in terms of taxation measures, for example, as suggested by Mr. Flanagan, play a role in encouraging businesses to survive by transferring the assets to the employees in the form of a worker co-operative.

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of the Cooperative Societies Bill 2022: Discussion (15 Feb 2023)

Paul Gavan: Does Dr. Carroll have a view on the French worker buy-out model, for example, and how that has been applied to situations of liquidation or potential administration, in terms of saving that business and keeping those jobs?

Seanad: An tOrd Gnó - Order of Business (9 Feb 2023)

Paul Gavan: We had a lively debate last week about University Hospital Limerick. At the end of the debate, the Minister for Health, Deputy Donnelly, made a quite extraordinary statement. He alleged that last week there was an average of just six patients on trolleys for the week in University Hospital Limerick. I checked the record. That is what he actually said and I think the Cathaoirleach might...

Seanad: An tOrd Gnó - Order of Business (9 Feb 2023)

Paul Gavan: Thank you.

Seanad: Nithe i dtosach suíonna - Commencement Matters: Tax Reliefs (8 Feb 2023)

Paul Gavan: I thank the Minister of State, Deputy Rabbitte, for coming to the House. I want to highlight the appalling existing arrangements that apply to the charging of VAT on vehicles modified for the use of people with significant disabilities. These modifications are absolutely necessary and can only be made in countries outside Ireland. I am delighted that we are joined in the Chamber by Ms...

Seanad: Nithe i dtosach suíonna - Commencement Matters: Tax Reliefs (8 Feb 2023)

Paul Gavan: I thank the Minister of State for the response. I want to zone in on her final comments, which I welcome in the first instance.I want to get clarity for Leigh and people like her. As I said, Leigh has taken the time to come up here today. Right now, she is being charged VAT for modifications to her vehicle, which are required. There is a story about HAP but it is not particularly...

Seanad: Nithe i dtosach suíonna - Commencement Matters: Tax Reliefs (8 Feb 2023)

Paul Gavan: Will the Minister of State make a recommendation?

Seanad: Nithe i dtosach suíonna - Commencement Matters: Tax Reliefs (8 Feb 2023)

Paul Gavan: Will the Minister of State make a recommendation on that point?

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Paul Gavan: The Senator made a fine speech. Well done. Today is my fist time dealing with the Minister of State and he is very welcome. As he will know, we have waited a very long time for the introduction of this legislation. Every customer has the right to be treated fairly and have their interests upheld. At a minimum, they should have a guarantee that they will be protected from gross...

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Paul Gavan: It might be some time before I do, Senator.

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Paul Gavan: I appreciate the Senator's optimism.

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Paul Gavan: As we know all too well, customers of banking and financial services have not been afforded that protection or been confident that individuals will be held to account when they fall victim of mistreatment, mismanagement or overcharging by financial institutions. More than a decade since the Irish banking sector plunged our economy into crisis, it is truly shocking that we are only now...

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: European Work Councils and Legislative Provisions for Dispute Procedures: Discussion (Resumed) (8 Feb 2023)

Paul Gavan: I am not asking Dr. Lavelle to speak for the Government. I am asking if he has an opinion on what is being discussed here.

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: European Work Councils and Legislative Provisions for Dispute Procedures: Discussion (Resumed) (8 Feb 2023)

Paul Gavan: I would like to bring in Mr. Altmeyer. Will he speak in terms of the reputational damage to Ireland that is occurring as a result of us not having effective EWC enforcement legislation?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: European Work Councils and Legislative Provisions for Dispute Procedures: Discussion (Resumed) (8 Feb 2023)

Paul Gavan: I thank all the speakers for their presentations. I want to put this in context and get to the nub of the issue. After those infringement proceedings began last May, I tabled a Commencement matter in the Seanad. The Minister of State in the Department of Enterprise, Trade and Employment who responded blankly told me there was no problem and nothing to see here. That was after the...
