- Seanad: Interpretation Bill 2000: Committee Stage. (29 Jun 2005)
Brian Hayes: I want to echo what Mr. Kevin Murphy, the former Ombudsman, said recently when he spoke about the need to scrutinise legislation in both Houses of the Oireachtas. He had difficult things to say to politicians and Government alike in respect of how much each Act is scrutinised and whether there is a proper scrutiny base. There are considerable question marks over that. It adds to the...

Brian Hayes: This is a victory for the plain language brigade.
- Seanad: Interpretation Bill 2000: Committee Stage. (29 Jun 2005)
Brian Hayes: The initial citation was, "the literal interpretation may be departed from and preference given to an interpretation based on the plain intention of the Oireachtas ...". Someone has ingeniously produced a new provision which states, "the provision may be given a construction that reflects the plain intention of the Oireachtas." Congratulations to those involved in that.
- Seanad: Interpretation Bill 2000: Committee Stage. (29 Jun 2005)
Brian Hayes: I move amendment No. 12: In page 7, line 25, after "instrument," to insert "so as to give the enactment or any provision of it an updated construction". This is an attempt to improve the language of the legislation. For the layman trying to find his or her way through it the difficulties are endless. This attempts to give concrete proof of the interpretation at the end of section 6.
- Seanad: Garda Síochána Bill 2004 [Seanad Bill amended by the Dáil]: Report Stage. (28 Jun 2005)
Brian Hayes: On another matter, in the House last week I asked the Leader â she, in turn, may not have made the request â for a briefing on all of the 138 amendments before the House. It was not provided, which is in marked contrast to the fact that on a similar procedure today, when we had an opportunity to discuss a maritime issue, a briefing was provided in written form to each Member of the House....

- Seanad: Garda Síochána Bill 2004 [Seanad Bill amended by the Dáil]: Report Stage. (28 Jun 2005)
Brian Hayes: I, many other colleagues and the Minister worked hard on Committee and Report Stages when this matter first came to our attention early this year. The Bill as first published had been in existence for a considerable period before it was brought to this House and on five separate occasions I had asked why it had not come before us. If it had, it would have ensured we had time to discuss the...

- Seanad: Order of Business. (28 Jun 2005)
Brian Hayes: I thank the Leader for giving way. Is it possible that the House would give notice of the grouping arrangement well in advance of 7.15 p.m? The problem is the Opposition has not seen the grouping arrangement and does not know how many groups there are. I say that with reference to all sides. There will be significant groups of amendments but we will only be able to speak once.
