- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: I move amendment No. 34: In page 24, line 5, to delete “have regard to” and substitute “must comply with”. Before I withdraw the amendment, I ask the Minister of State to consider, with his officials, the point I made about terrestrial planning legislation where two different formulas are used in certain circumstances. As my colleagues and I will probably...

Eoin Ó Broin: It is to ensure continuity of that boundary.
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: Perfect. Therefore all this does is mirror that territorial boundary. I thank the Minister of State.

- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: The adoption of amendment No. 40 would make everybody's life in the Department much easier. There is nothing wrong with lobbying, which is carried out by lots of different organisations, commercial organisations, NGOs, Deputies and Cabinet colleagues, etc. I will show why amendment No. 40 would make everybody's life easier. As the Minister of State will remember, we had discussions on the...
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: Yes. Let us all make sure that we hear each other properly. When I raised in a previous discussion whether the policy statement would be subject to strategic environmental assessment and appropriate assessment, the Minister of State said "Yes". Then I asked him where was it specified in the legislation.
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: Is amendment No. 118 a Government amendment?
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: Has the Minister of State spoken to amendment No. 118 yet?
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: Let me pause because that amendment may make a portion of my amendment redundant. I am absolutely of the view, whether it is in my amendment or amendment No. 118, that there should be a statutory obligation to do that. I am still not clear what the plan for public consultation will be, particularly in the context of a negative screening determination, if such a thing arises.
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: Amendment No. 44 relates to public consultation. If the Minister of State's response to the previous amendment is satisfactory, I am happy to withdraw the amendment. The last amendments in this group are amendments Nos. 46 and 47. I accidentally spoke on them when discussing a previous group of amendments so there is no need for me to repeat myself.
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)

- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: While the Minister of State is in clarification mode, can he point out where in section 41 the SEA and AA requirements are listed?
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: Apologies. Perhaps the Chairman will indulge us for just one moment while we look for that amendment. It amends section 31.
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: I apologise, and I may have misheard, but my original question was about the SEAs and AAs. We may have tripped over ourselves in asking about two different amendments.
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: I will just check that. For the sake of clarity, and because after two hours and 44 minutes my eyes are quite twisted, is the Minister of State saying that the import of amendment No. 117 to section 31 is, that, under all circumstances, an SEA and an AA will be required for the initial policy statement?
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: What about any subsequent revisions or changes to the statement?
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: I thank the Minister of State for his patience.
- Select Committee on Housing, Planning and Local Government: Maritime Area Planning Bill 2021: Committee Stage (19 Oct 2021)
Eoin Ó Broin: Strictly speaking, the Minister of State's response is correct in that if we really want to make these changes, there is other legislation in which we should make them. In addition, there is a review of the freedom of information legislation and changes are being made to the Regulation of Lobbying Act. I am aware that the Minister of State will not support this amendment. I would make an...
