Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of EU Legislative Proposals (1 Feb 2017)

Jim O'Callaghan: Do the witnesses think the intention behind this directive to try to introduce into Irish law an examinership type protection for smaller businesses and individuals? Is that what this seeks to do?

Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of EU Legislative Proposals (1 Feb 2017)

Jim O'Callaghan: The witnesses will know the companies can go and get examinership. They go to the court because they cannot pay their debts but they do not want to go into liquidation so they get the protection of the court and their loans are restructured, subject to the views of the creditors. Is this proposed directive similar in terms of an individual availing of that process, or does that process...

Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of EU Legislative Proposals (1 Feb 2017)

Jim O'Callaghan: Am I correct in stating that this directive will only apply to what are defined as entrepreneurs? An entrepreneur appears to be defined as a natural person exercising a trade, business, craft or profession. That could exclude a lot of people. Would that not be so?

Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of EU Legislative Proposals (1 Feb 2017)

Jim O'Callaghan: In the presentation it was mentioned that it may impact on the independence of the Judiciary. Is that because of Article 24, which mentions that they will have to have certain expertise in respective areas? I may be wrong, but I am just wondering.

Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of EU Legislative Proposals (1 Feb 2017)

Jim O'Callaghan: Can I ask just one quick question on the answer given to Deputy Brophy? If this directive is introduced and transposed into Irish law, is Ms O'Higgins saying then that that will diminish the protections that Irish people have under the legislation on examinership or under the legislation on personal insolvency?

Joint Oireachtas Committee on Justice, Defence and Equality: Scrutiny of EU Legislative Proposals (1 Feb 2017)

Jim O'Callaghan: The directive sets out the minimum requirements that we must transpose into Irish law. If we go beyond that as we have done already in the legislation on examinership and personal insolvency, why would that undermine the directive?

Criminal Justice (Offences Relating to Information Systems) Bill 2016: Second Stage (25 Jan 2017)

Jim O'Callaghan: I do not know if the Ceann Comhairle makes awards to Deputies for hard work and working long hours, but if he does, I would like to nominate Deputy Jonathan O'Brien and myself as we started our public duties in Leinster House at 9 a.m. at the Oireachtas Joint Committee on Justice and Equality and are still going some 13 hours later. He may consider that nomination.

Criminal Justice (Offences Relating to Information Systems) Bill 2016: Second Stage (25 Jan 2017)

Jim O'Callaghan: Actually, sometimes it was. I welcome the legislation. When I saw it, I was not aware that this type of offence had not already been criminalised. One would have thought information systems which played such an important part in business and ordinary personal life would be protected from attack, but that does not appear to be the case. I understand the Bill seeks to transpose into...

Establishment of Commission of Investigation into the Stardust Tragedy: Motion [Private Members] (25 Jan 2017)

Jim O'Callaghan: The Stardust fire was one of the most significant events in the history of our capital city. It was the worst tragedy to befall our capital city in the 20th century, exceeding even the Dublin bombings which took place in the 1970s. It is an event which has had enduring consequences. On a national level, after the fire took place, it had the consequence of striking fear into the hearts and...

Jim O'Callaghan: I want to address the committee on four areas. First, I will speak about how the system currently operates; second, why the system needs to be changed; third, my...

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of Judicial Appointments Commission Bill 2016: Minister for Justice and Equality (25 Jan 2017)

Jim O'Callaghan: I want to respond to the points made. In dealing with the Tánaiste's comments, I will not repeat points that I made earlier. I will respond to the three points made by Deputy Jonathan O'Brien. His first point was about having diversity in the Tánaiste's general scheme of the Bill. Section 15(4)(a) of my Bill states that the Commission must take into account "promoting gender...
