- Seanad: Protection of Life During Pregnancy Bill 2013: Committee Stage (17 Jul 2013)
Denis O'Donovan: I remind Senators that we are dealing with section 1. Senator Walsh proposed a change to the Title in an amendment that I have ruled out of order. We are dealing with section 1 as it stands. I do not want to broaden the debate into constitutional or other issues that can be dealt with very well later in the debate. Many amendments have been tabled and they are worthy of debate. I call...
- Seanad: Protection of Life During Pregnancy Bill 2013: Committee Stage (17 Jul 2013)
Denis O'Donovan: The proposal has been ruled out of order. I call Senator Gilroy. We are on section 1.
- Seanad: Protection of Life During Pregnancy Bill 2013: Committee Stage (17 Jul 2013)
Denis O'Donovan: The constitutional interpretation of section 1 is very narrowly focused. There will be ample room for points that can be made on later sections. We should not lose sight of two points: first, that the amendment proposed by Senator Walsh has been ruled out of order, and second, that we are dealing with the technical name of the Bill, be it wrong or right.
- Seanad: Protection of Life During Pregnancy Bill 2013: Committee Stage (17 Jul 2013)
Denis O'Donovan: I do not want people to expand and go beyond the parameters of the debate. Otherwise we will have all kinds of debates.
- Seanad: Protection of Life During Pregnancy Bill 2013: Committee Stage (17 Jul 2013)
Denis O'Donovan: Again, that is a point of order. The Minister to respond.
- Seanad: Protection of Life During Pregnancy Bill 2013: Committee Stage (17 Jul 2013)
Denis O'Donovan: With all due respect, neither should the Minister of State transgress. We are dealing with section 1 and I would like us to focus on that.
- Seanad: Protection of Life During Pregnancy Bill 2013: Committee Stage (17 Jul 2013)
Denis O'Donovan: Let us be mindful of the fact that we are going into areas that will be dealt with by substantial amendments further along in the debate. This is purely on the Title of the Bill.
- Seanad: Protection of Life During Pregnancy Bill 2013: Committee Stage (17 Jul 2013)
Denis O'Donovan: Amendment No. 1 in the name of Senator Jim Walsh has been ruled out of order because it is declaratory in nature.
- Seanad: Protection of Life During Pregnancy Bill 2013: Committee Stage (17 Jul 2013)
Denis O'Donovan: The ruling that has been made is that it is declaratory in nature. That rules it out. That is the decision I have been issued. If the Senator wants to speak on the section, he can.
- Seanad: Protection of Life During Pregnancy Bill 2013: Committee Stage (17 Jul 2013)
Denis O'Donovan: That is not a point of order; it is a matter for the Chair. I will certainly curtail any transgression to other sections, but because I had ruled the amendment out of order, I did allow Senator JIm Walsh to speak on the section. In doing so I am allowing him some latitude. He has had only one minute so far.
- Seanad: Protection of Life During Pregnancy Bill 2013: Committee Stage (17 Jul 2013)
Denis O'Donovan: Let us be clear on this issue. I declared the amendment tabled by Senator Jim Walsh out of order because it was declaratory in nature. Rather than talking on the amendment which has been ruled out of order, I will allow comments on the section. I remind the House that many substantive amendments will proposed during the course of the debate on the Bill. It might be prudent, therefore, for...
- Seanad: Order of Business (17 Jul 2013)
Denis O'Donovan: I, too, congratulate Senator John Gilroy and hope to be able to attend the launch, subject to the proceedings of the House. I wish him well and commend him for his efforts. We are giving a commitment that we will not oppose the Order of Business, even though we may wish to do so, because we have a full programme of legislation before us which may run until midnight. It will be an extremely...
- Seanad: Prison Development (Confirmation of Resolutions) Bill 2013: Second Stage (16 Jul 2013)
Denis O'Donovan: I welcome the Minister of State. Whereas I have some reservations about this project, I broadly welcome it. I would be disappointed, however, if there were to be an attempt to deal with all Stages tonight. I would like the Minister for Justice and Equality to outline to the House, on Committee or Report Stage, the position on the long-awaited report on the death of Gary Douch who was...
- Seanad: Protection of Life During Pregnancy Bill 2013: Second Stage (Resumed) (16 Jul 2013)
Denis O'Donovan: I have kept out of the public spotlight by and large since this matter has arisen but I honestly believe that if we must resolve this problem that has plagued society and several Governments for the past 30 years, there is a need for another referendum. If we are being totally honest, the only way to resolve this matter is to put it to the people again. Many do not want to. Some of the...
- Seanad: Protection of Life During Pregnancy Bill 2013: Second Stage (Resumed) (16 Jul 2013)
Denis O'Donovan: I rise to make a brief contribution on this important Bill. I would assert that I am pro-life for my own reasons and I do not want to ram my views down anyone’s throat. As a former member of the all-party committee on the Constitution in the late 1990s, chaired by the late Brian Lenihan, and a precursor to the one chaired by Deputy Jerry Buttimer recently, I was present for all...
- Seanad: Protection of Life During Pregnancy Bill 2013: Second Stage (Resumed) (16 Jul 2013)
Denis O'Donovan: The manner in which that occurred is not a matter for the Bill.
- Seanad: Protection of Life During Pregnancy Bill 2013: Second Stage (Resumed) (16 Jul 2013)
Denis O'Donovan: No, it is not and I am ruling that the Senator should move on.
- Seanad: Protection of Life During Pregnancy Bill 2013: Second Stage (Resumed) (16 Jul 2013)
Denis O'Donovan: Senator Paul Coghlan was in possession last night and had just started.
- Seanad: Protection of Life During Pregnancy Bill 2013: Second Stage (Resumed) (16 Jul 2013)
Denis O'Donovan: Therefore, he is entitled to the full ten minutes, although I might deduct ten seconds.
- Seanad: Order of Business (16 Jul 2013)
Denis O'Donovan: I support Senator MacSharry in regard to mental health. I praise Carl O'Brien for the wonderful articles he wrote on this subject, which were published in The Irish Times yesterday and today. Apart from political action on mental health, it is also important that the media focus on these areas. I rarely rise to compliment a journalist but Mr. O'Brien's articles bring a positive focus on...
