Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: That is a more appropriate explanation. That is not what was stated in the submission.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: An independent audit is necessary.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: Is it a software issue?

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: Effectively what Mr. Maher is saying is that some customers were overcharged but as yet nobody knows why or how that happened and also that the problem was intermittent and thus far it appears 2,000 transactions were affected.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: It is unacceptable that the problem continued for so long. In some cases, the overcharging dates back to April 2017.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: I am very concerned that the software is not sufficiently adequate to ensure such problems do not arise. Trust is hugely important. When I pass through a toll I trust that the system will deduct only the amount owed and that I will not be overcharged. Trust in the system is now broken because it appears it is faulty. Another matter was brought to my attention in recent days. I am happy...

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: Of course they do but I am speaking about cars.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: I accept that.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: It is happening and I have had a complaint. The infallibility is always on the side of the toll operator, not the customer. I have never known anybody to be undercharged at a toll yet.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: That is wisely put. Maybe the people from whom the €10 million has not been collected are not complaining. However, I am. It is unacceptable that those who do not pay are not pursued and that the money they owe has increased in Transport Infrastructure Ireland, TII's, accounts from 2015 to 2016. There is €10 million in unpaid tolls, yet users elsewhere are being overcharged....

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: The operator told me it did not know about it before January 2018 until I told it. I want TII to challenge that.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: I will give TII the data.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: How much is owed?

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: In 2016, €5.2 million was written off and €4.9 million in the previous year. This is a small reduction. It is hugely damaging to the operation that people who pay and comply get one outcome while those who do not can get away with it. While 97% sounds great, the fact is that this involves millions of euro. What steps is TII taking to get some of this money back? I...

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: I agree with the pursuit of significant repeat offenders.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: However, millions of euro are still owed.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: I thought nobody escaped that tax. Nobody should escape the toll.

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: That is a good point. Will TII send the committee a report on how it pursues repeat offenders?

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: I accept somebody might drive through a toll and forget to pay. However, there are repeat offenders. What penalties will be imposed on the operator for the overcharging in Drogheda?

Joint Oireachtas Committee on Transport, Tourism and Sport: Road Network: Transport Infrastructure Ireland (24 Jan 2018)

Fergus O'Dowd: Is that what TII calls liquidated damages? I did not realise it was going to be so small. The operator rips off customers to the value of €6,000 and then pays €3,000 in compensation. Is that all?
