Joint Oireachtas Committee on Agriculture, Food and the Marine: Burning of Land: Department of Agriculture, Food and the Marine (8 May 2018)

Éamon Ó Cuív: If 20% of my land is burned-----

Joint Oireachtas Committee on Agriculture, Food and the Marine: Burning of Land: Department of Agriculture, Food and the Marine (8 May 2018)

Éamon Ó Cuív: If the figure was 50%?

Joint Oireachtas Committee on Agriculture, Food and the Marine: Burning of Land: Department of Agriculture, Food and the Marine (8 May 2018)

Éamon Ó Cuív: The problem is that it is skewed. If I have 5 ha, 3% is 0.15 ha. My neighbour could have the corner of a field of that size.

Joint Oireachtas Committee on Agriculture, Food and the Marine: Burning of Land: Department of Agriculture, Food and the Marine (8 May 2018)

Éamon Ó Cuív: The situation is extraordinary in that we spent years negotiating for access to the hills in Sligo. Deputy Scanlon knows about it. The main area that got burnt in Connemara for which people were penalised is a very small commonage with an enormous number of shareholders. The Department said the fines should have been deducted from the payment. I do not believe that should have happened...

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: The reality is that the amount of hedge-cutting that is likely to take place in August is actually quite limited. This section limits it to roadside hedge-cutting but many fields do not come to the roadside. Any fields that do come to the roadside also have three sides of hedges that do not come to the roadside. In fact, on the narrow roads and especially on the boreens into houses, the...

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: Are we discussing section 8? Perhaps the Minister will clarify a point I raised during my speech on Second Stage. Some persons came to me who believed this amendment would allow for wholesale cutting of hedges at any time of the year. I believed that all it did was provide for the existing section 70 of the Roads Act 1993, which allows - with the permission of the local authority - the...

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: To be clear, is this just putting back in what was in the Roads Act 1993 to ensure that local authorities can give an order to remove these branches, or in the event of the landowner not doing it the local authority can do the removal and charge the landowner for doing it? Is it the case that it can only be done on the say-so of the local authority and not on the initiative of the landholder?

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: Would he or she have to get permission?

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: Was there consultation with the Department of Transport, Tourism and Sport on this?

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: I am sorry, I was not here.

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: The Minister is saying that the 6.33% figure would be the case if every roadside hedge was cut, but there are four hedges in a field with three sides to each hedge. As such, one twelfth of the hedges are road-facing. There are also fields that do not touch any roadside, so the figure drops further. When I was at school, one twelfth of 100% equated to approximately 8%. I don not believe it...

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: I will withdraw my opposition because I have been given a satisfactory explanation. As I indicated I would on Second Stage, I sought the clarification that the Minister has now given. Given that the Department of Transport, Tourism and Sport views this as a safety issue and the situation is reverting to the case under the 1993 Act in terms of safety, I will withdraw my opposition.

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: May I ask a question? Would I be right in thinking that in exercising any function the Minister has a legal obligation to have regard to every Council directive anyway? Therefore, as a Minister, she also has an obligation to-----

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: Amendment No. 32.

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: I am just looking for clarification on that point. Am I also right in thinking that in making any policy decision, the Minister has to have regard for all Government policies?

Select Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Heritage Bill 2016: Committee Stage (Resumed) (8 May 2018)

Éamon Ó Cuív: Therefore, this amendment is moot.

Written Answers — Department of Culture, Heritage and the Gaeltacht: Clár Bonneagair agus Infheistíochta Caipitil (8 May 2018)

Éamon Ó Cuív: 500. To ask the Minister for Culture, Heritage and the Gaeltacht an ndéanfaidh sí pobal na Gaeilge i nGlas Naíon, Baile Átha Cliath a chosaint ó dhochar a d'fhéadfadh tógáil MetroLink a tharraingt orthu, ó tharla go bhfuil sé beartaithe suíomh mór tógála a thógáil in aice le Scoil Mobhí agus Scoil...

Famine Memorial Day Bill 2016: Second Stage (3 May 2018)

Éamon Ó Cuív: Go raibh míle maith agat, a Cheann Comhairle. Ní dhéanfaidh mé nós de seo. Bhí mé gafa le agallamh ar na meáin. I welcome this Bill and we will be supporting it on Second Stage. I was chair of the initial Famine commemoration committee that organised the event in Skibbereen referred to earlier. At that time, we considered the issue of a date but...

Topical Issue Debate (Resumed): Northern Ireland (2 May 2018)

Éamon Ó Cuív: I thank the Minister for his succinct answer. Certain issues are within the control of the political system in Northern Ireland. One is the closed and unjust system under which a licence is revoked and one does not know the charges one faces and is not present for the inquiry. A second issue is administrative delay. The Tánaiste was correct when he stated the hearing was expected...

Topical Issue Debate (Resumed): Northern Ireland (2 May 2018)

Éamon Ó Cuív: I dtosach báire glacaim buíochas leis an Tánaiste as ucht teacht isteach go pearsanta anseo. I thank the Tánaiste for coming in. He is aware of this case. To summarise it on the public record, as Deputy O'Sullivan has said, Tony Taylor is in prison following a revocation of licence. The problem with all of this procedure is that the person whose licence is revoked in...
