- Seanad: Civil Law (Missing Persons) Bill 2016: Report and Final Stages (28 Jun 2018)
Colm Burke: I welcome the amendments. It is extremely important to create the register in order to have a clear record. The proposed new Part 5B of the Civil Registration Act 2004 sets out all of the information clearly, including the date and place of presumed death and the place of birth of the missing person. It is welcome that all of the relevant information will be added to the register and that...
- Seanad: Civil Law (Missing Persons) Bill 2016: Report and Final Stages (28 Jun 2018)
Colm Burke: I agree with the amendments. We included the coroner issue in the original Bill because we were talking about two procedures. I can see why the Department and the Minister have chosen to add clarity by providing for these issues to be dealt with by one stream. In the circumstances, it is appropriate that they be dealt with by the courts only.

Colm Burke: I welcome the amendment. The issue of insurance will arise but it is important that there is some safety mechanism in place. It is important that a person who takes the decision to apply for such a court order will be able to effect the necessary protection from his or her point of view.

- Seanad: Civil Law (Missing Persons) Bill 2016: Report and Final Stages (28 Jun 2018)
Colm Burke: May I make a point regarding Part 3, amendment No. 12 of the Act of 2004, which I raised earlier? It states that the Act of 2018 means the Civil Law (Missing Persons) Act 2018, whereas at the start of the Bill we were changing the wording to the Civil Law (Presumption of Death) Act. Could we get clarification on that issue?

Colm Burke: I thank the Minister for coming forward with amendments and giving a very detailed explanation of each one. I thank his officials, in particular Ms Regina Terry, for their work, and all of those in the Department and the Office of the Attorney General who provided legal back-up support in bringing forward the amendments. It is a very technical Bill and it is important that we get it right....

Colm Burke: I thank the witnesses for their presentation. I apologise for not being here for all of it. Unfortunately, I had to be in the Seanad for an item. I want to revisit the staffing issue. This is a challenge across the board in the health service, in areas such as maternity, orthopaedics, etc. We face a challenge in recruitment. At present, 40% of medical practitioners who register with...

- Joint Oireachtas Committee on Health: New Standard Operating Procedure for Assessment of Need under the Disability Act 2005: Discussion (27 Jun 2018)
Colm Burke: Why is that specific area standing out? Is there a particular managerial issue? What is the problem in North Lee and South Lee? That is the area I am in, particularly North Lee. Last Friday night I was with a family and their teenage son. In April, it was established that he needed to be seen by a consultant. It is now ten weeks later and they have not even been given an appointment. I...

Colm Burke: I apologise for missing the presentation but I was trying to resolve a medical issue for someone. I asked the groups that presented earlier about the availability of people with the required qualifications and they stated adequate numbers were available to fill any vacancies or shortfall. My understanding from the HSE presentation is that the officials feel that is not the case. Can they...

- Seanad: Commencement Matters: Nursing Home Services (20 Jun 2018)
Colm Burke: I thank the Minister of State for coming to the House to deal with this matter. At present, there are 23,500 people in private nursing homes under the fair deal scheme. These private nursing homes provide a valuable service to the country and excellent care to the many people who need it. While it is positive that we have reached full employment, the nursing home sector is experiencing...
