David Norris: It does seem logical to request the Minister of State to withdraw the amendment since he is obviously not completely decided as he is still in discussions. Accordingly, it seems prudent and practical to withdraw the amendment and resubmit it on Report Stage if his officials can clarify the matter to his satisfaction. I support Senator Thomas Byrne on this point.

David Norris: As I understand it, the Minister of State is saying that in a situation where there is no specific provision for an appeal, an appeal is not specifically precluded either; therefore, an appeal could be made. Perhaps I do not understand him correctly?
