Seanad: Defamation Bill 2006: Committee Stage (4 Dec 2007)

Ivor Callely: As Ms Justice Denham said, I believe the jury should be able to compare the value of what courts usually award to people in personal injury actions as compensation in a notional remedy in both incidences. The lame do not walk after an award of compensation and the defamed do not cease to have been defamed after an award of damages.

Seanad: Defamation Bill 2006: Committee Stage (4 Dec 2007)

Ivor Callely: I can deal with it at that stage if the Leas-Chathaoirleach so wishes.

Seanad: Defamation Bill 2006: Committee Stage (4 Dec 2007)

Ivor Callely: However, it is equally covered here. While I will not read what section 1 states, it gives the standard provision as Senator Walsh said. May I continue a Leas-Chathaoirligh?

Seanad: Defamation Bill 2006: Committee Stage (4 Dec 2007)

Ivor Callely: Am I right in reading that section 1 deals with the Act?

Seanad: Defamation Bill 2006: Committee Stage (4 Dec 2007)

Ivor Callely: I am not too sure if I am being defamed myself, a Leas-Chathaoirligh, because you do not know what I am about to say. I understand that section 1 deals with the commencement of the operation of the Act and I am dealing with issues regarding the operation of the Act.

Seanad: Defamation Bill 2006: Committee Stage (4 Dec 2007)

Ivor Callely: Am I permitted to deal with aspects of the commencement of the Defamation Bill as an Act and the provisions and purposes contained in the Act?

Seanad: Defamation Bill 2006: Committee Stage (4 Dec 2007)

Ivor Callely: I am about to conclude my contribution as there is not much left of what I want to say. As I was saying before I was interrupted, an order of damages is an artificial form by which a court gives a remedy to an injured person. Juries no longer decide on the value of compensation in personal injuries actions. In the event of a person——

Seanad: Defamation Bill 2006: Committee Stage (4 Dec 2007)

Ivor Callely: I will raise it when I come to the relevant section. I ask the Leas-Chathaoirleach to let me know when we come to the relevant section.

Seanad: Defamation Bill 2006: Committee Stage (4 Dec 2007)

Ivor Callely: I ask the Leas-Chathaoirleach when that part arises.

Seanad: Business of Seanad (4 Dec 2007)

Ivor Callely: It would be different if it were Dublin.

Seanad: Order of Business (4 Dec 2007)

Ivor Callely: I am prompted to respond to the two previous speakers on the nursing home issue. I have stated publicly in the past in regard to the HSE that the jury is out and that I hope the verdict will be delivered shortly. The previous situation in regard to nursing homes was that 14 health boards were applying 14 different sets of regulations. This meant that some elderly people had to dispose of...

Seanad: Order of Business (4 Dec 2007)

Ivor Callely: Yes, there must be adequate time to discuss it. The anomalies in the current system are unfair. There are constant calls for space to be provided for quality bus corridors to encourage people to use buses. Much of our road space has been given to bus transport. However, for the first time, Operation Freeflow has been put in place without the provision of bus park and ride facilities. The...

Seanad: Order of Business (4 Dec 2007)

Ivor Callely: I have sufficient copies of the motion and I ask that they be forwarded to the Clerk and to each political grouping. I propose that the motion be approved without debate and that a debate take place whenever it can be accommodated.

Seanad: Order of Business (4 Dec 2007)

Ivor Callely: Thank you.

Seanad: Order of Business (4 Dec 2007)

Ivor Callely: Hear, hear.

Seanad: Overseas Missions: Statements (Resumed) (29 Nov 2007)

Ivor Callely: It is heartening to hear the contributions so far. Like other speakers, I welcomed the decision to send Irish troops to take part in the EU force that is to support the UN operation in Chad and the Central African Republic. As many have said, we should not lose sight of the fact that this mission, like all others of its kind, will be difficult. The Irish troops, comprising 400 Permanent...

Seanad: Order of Business (Resumed) (28 Nov 2007)

Ivor Callely: Will the Leader seek clarity on an issue I have raised in this House regarding the Health Service Executive and the reimbursement prices to pharmacists? As late as last night I was advised that the HSE has deferred the implementation date of 1 December 2007 for the new reimbursement prices. When I contacted pharmacists I learned they were unaware of this deferral. This decision is...

Seanad: Order of Business (22 Nov 2007)

Ivor Callely: The Health Service Executive, HSE, and the Irish Pharmaceutical Union, IPU, are on a collision course that would have a detrimental impact on the supply of medication. I understand Senator O'Toole's call for clarity and debate on the issue. The Government has agreed complex pricing structures, with the Pharmaceutical Distributors Federation of Ireland, PDF, the manufacturing side, the...

Seanad: Order of Business (Resumed) (1 Nov 2007)

Ivor Callely: It is difficult to blame them.

Seanad: Order of Business (Resumed) (1 Nov 2007)

Ivor Callely: Previous speakers commented on the HSE and the health services. Most would agree many thousands of frontline and support teams provide tremendous health and social services to hundreds of thousands of recipients on a weekly basis and the issue is the administration of services and the role of the HSE. The jury is out on the functions and efficacy of the HSE.
