Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: Amendments Nos. 32 and 33 are related and may be discussed together, by agreement. Is that agreed? Agreed.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: These amendments concern whether a plan should be laid before the Oireachtas. I will allow the Senator to speak on the general issue when we debate section 17.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: It would be more appropriate to address the entire section. I will allow the Senator to make a more substantial contribution in that context.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: Senator David Cullinane's comments were more general in nature and I will allow him to contribute later, but the Minister of State should respond specifically to amendments Nos. 32 and 33.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: Is Senator Barrett happy with the response? I ask him to speak to amendment No. 31, in particular, as the others will be dealt with later.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: I am trying to be fair.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: I am not sure that is a point of order but I agree with the Senator's comment. The thrust of Senator Healy Eames's contribution relates to sections 15 and 16. I would like Members to confine their remarks to the amendments and sections as we deal with them.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: This is a general point. We are dealing with the extension of the service level agreement for 30 years. If I have to constrain one Member, I must constrain others. I cannot make chalk of one and cheese of another. The Senator's point is general. It is relevant to the legislation but not to the amendment.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: The Senator is misunderstanding my point.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: When an amendment is being discussed, I want Members to speak to it or to sections when we deal with them and not to raise issues that will come up later.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: The Senator is making broad points about local governance and powers.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: I have read it twice.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: The Senator's contribution is not relevant to the transfer date, which is dealt with in this amendment. I also stopped Senator Ó Domhnaill during his contribution. It may be an interesting issue, but I must ensure Senator Bradford is within the confines of this matter.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: I do not want to have to keep reminding Members, but they should stick to the amendment under discussion. Many of the points being made will be rehashed and are more appropriate to other sections.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: In fairness, this amendment concerns the specific issue of a transfer date, and I cannot let Senator Healy Eames go all over the shop about what councillors are saying.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: Irrespective of that, the Senator cannot make a Second Stage speech. I must control matters from the Chair.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: The amendment deals with the transfer date.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: I can see where the Senator is coming from, but most of the points she is making are amply covered with in the other 70 or 80 amendments that must be dealt with.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: If they are not relevant to the section, the Minister of State does not have to answer them. We cannot have a plethora of questions referring to subsequent amendments or sections when it is more appropriate to deal with them at a later stage.

Seanad: Water Services (No. 2) Bill 2013: Committee Stage (10 Dec 2013)

Denis O'Donovan: Amendment No. 5 in the name of Senator Brian Ó Domhnaill is out of order as it is declaratory in nature.
