Pat Rabbitte: If the Minister says it is unusual to put this into legislation, I will take his word for it. However, there is some concern in respect of the particular circumstances in which a defendant would challenge it, in that it does not appear to be explicit. However, the Minister seems to be saying it is implicit and if that is the case, I will withdraw the amendment.

Pat Rabbitte: If there is no obligation on the recipient of the document to present in the other jurisdiction, we can take it that no sanction can be imposed if he or she does not turn up. The Minister is saying that it is solely the responsibility of the requesting state to ensure adequate time is allowed.
