Health Services (29 May 2008)

Pat Rabbitte: This is an issue of two young paraplegics, not bungalows.

Health Services (29 May 2008)

Pat Rabbitte: That is an insulting answer.

Legal Services Ombudsman Bill 2008: Second Stage (Resumed) (29 May 2008)

Pat Rabbitte: I thank Deputy O'Rourke for rushing in to the bearna baoil when I was detained elsewhere due to other business. I assure her it is not a case of the other Opposition party, as she referred to us, not wanting to speak. This Bill has been stripped out from the Civil Law (Miscellaneous Provisions) Bill. This was a suggestion the Fine Gael spokesperson, Deputy Flanagan, and I put to the...

Legal Services Ombudsman Bill 2008: Second Stage (Resumed) (29 May 2008)

Pat Rabbitte: If the National Consumer Agency could take time off from the supermarkets, finding out what the rest of us already know, and conduct a survey of people who are dealing with the legal profession, it would say this is a welcome measure but that it is limited enough. The background against which one has to measure it is the Competition Authority report. That report is very instructive but I do...

Legal Services Ombudsman Bill 2008: Second Stage (Resumed) (29 May 2008)

Pat Rabbitte: Recent events have undoubtedly alarmed the public and have done damage to the legal profession. Like Deputy Paul Connaughton, members of the profession I have dealt with have been honourable people. I forget the phrase Deputy Connaughton used but it was to effect that they do not do it for nothing. I am prepared to go along with that too. Some woeful weaknesses have been shown up in the...

Legal Services Ombudsman Bill 2008: Second Stage (Resumed) (29 May 2008)

Pat Rabbitte: It is prominent in the news for a short time and then dies away. One suspects there is a similar situation with regard to the Army deafness cases. One must be fairly naughty before one is struck off by the Law Society or the Bar Council. How much time have I left?

Legal Services Ombudsman Bill 2008: Second Stage (Resumed) (29 May 2008)

Pat Rabbitte: That is exceptionally well timed. I am getting better at judging it all the time.

Legal Services Ombudsman Bill 2008: Second Stage (Resumed) (29 May 2008)

Pat Rabbitte: The Master of the High Court referred to what he described as an abuse of privilege. He referred to the use of mumbo jumbo by lawyers of the "it's the law, you wouldn't understand" variety to keep a client at bay or to seek to over-complicate issues, perhaps to justify a higher fee. There is a certain amount of mumbo jumbo associated with all professions but access to justice and certainly...

Written Answers — Proposed Legislation: Proposed Legislation (28 May 2008)

Pat Rabbitte: Question 194: To ask the Minister for Justice, Equality and Law Reform when it is intended to publish the report of the casino regulation committee, which was submitted to Government in April 2007; if it is intended to proceed with the plan to establish an informal committee of Houses of the Oireachtas Members to consider the report and related matters; and if he will make a statement on the...

Written Answers — Garda Stations: Garda Stations (28 May 2008)

Pat Rabbitte: Question 184: To ask the Minister for Justice, Equality and Law Reform if he will close further Garda stations; if so, the stations involved; the timescale involved; and if he will make a statement on the matter. [21075/08]

Inquiries into Garda Activities. (28 May 2008)

Pat Rabbitte: Question 83: To ask the Minister for Justice, Equality and Law Reform his views on the sixth report of the Morris tribunal published on 8 May 2008; the action he will take arising from the report; and if he will make a statement on the matter. [21210/08]

Inquiries into Garda Activities. (28 May 2008)

Pat Rabbitte: How can the Minister say that if certain measures had been in place in the late 1990s there may have been no necessity for the Morris tribunal when Mr. Justice Frederick Morris said that what he uncovered in Donegal is not peculiar to Donegal? I ask that the Minister respond to this conclusion.

Inquiries into Garda Activities. (28 May 2008)

Pat Rabbitte: What is the Minister's response to Mr. Justice Morris's conclusion that the deficiencies, malpractices, misconduct and indiscipline he discovered in Donegal over six years were not peculiar to Donegal? I ask the Minister to answer the following question rather than reading out whatever is in the file. Never mind the file. Has he had any reports from other parts of the country about the...

Inquiries into Garda Activities. (28 May 2008)

Pat Rabbitte: Is it the case that the Garda Ombudsman Commission may not deal with allegations of routine dereliction of duty within the Garda Síochána? I have had a number of contacts from within the Garda since the latest Morris report was published. At least three of these cases detail routine dereliction of duty, malpractice, misconduct and indiscipline, matters proper to the management structure...

Freedom of Information. (28 May 2008)

Pat Rabbitte: Question 85: To ask the Minister for Justice, Equality and Law Reform when he will extend the remit of the Freedom of Information Act 1997 to cover An Garda Síochána especially in view of repeated suggestions from the Information Commissioner that this should be done; and if he will make a statement on the matter. [21211/08]

Freedom of Information. (28 May 2008)

Pat Rabbitte: Does the Minister not agree it is perverse to plead overdue Garda reforms as a reason for not extending the FOI Act to the force? He is known in the House as a cautious and conservative politician. If he wants to make a name of himself in asserting real accountability, he should extend the Act to the Garda. What is his response to the Information Commissioner's statement that Ireland is...

Freedom of Information. (28 May 2008)

Pat Rabbitte: I would like to have a cup of tea with the Minister to go over his fascinating trip down memory lane, which is utterly——

Freedom of Information. (28 May 2008)

Pat Rabbitte: The Minister is only flim flamming. What is his reply to the Information Commissioner's repeated request that the FOI Act be extended to the Garda? Nobody is suggesting we put the security of the State at risk and we are not asking for files on subversive activity. What is his response to her recent report?

Freedom of Information. (28 May 2008)

Pat Rabbitte: That is a lamentable reply and it is regrettable the new Minister has a philosophical and ideological opposition to the FOI Act being extended to the Garda. This is an instrument of accountability and if we have learned anything from the Morris tribunal and elsewhere, there is a necessity to improve accountability within the Garda. I ask the Minister to reconsider his position.

Garda Reserve Force. (28 May 2008)

Pat Rabbitte: Why did only 271 of the 3,750 applicants for the Garda reserve last year make the grade?
