- Joint Oireachtas Committee on Justice, Defence and Equality: Bail (Amendment) Bill 2017: Discussion (5 Dec 2018)
Jim O'Callaghan: I do not want to take too much time but wanted to say to Deputy Ó Laoghaire that for section 2(a) to be triggered under the proposed Bill, one would still have to have a conviction for a relevant offence within the period of five years. There would not be a situation where somebody could be refused bail without having been convicted of a relevant offence. That is my assessment.

Jim O'Callaghan: I thank our guests for attending, for their submissions and for the efforts they have made in this area. I listened very carefully and, while I disagree with some parts of what was said, I will take them on board, as I will the comments of my colleagues. I am slightly concerned that we got into a broader discussion about penal policy, rather than the specifics of the Bill, and this is...

Jim O'Callaghan: 258. To ask the Tánaiste and Minister for Justice and Equality if there are still sworn gardaí and sergeants performing administrative tasks that could otherwise be carried out by a suitably qualified civilian, thus freeing up gardaí for more operational roles in view of the recent comments by a person (details supplied); when these administrative roles will be completely...

Vote 24 - Department of Justice and Equality (Supplementary) (29 Nov 2018) Jim O'Callaghan: I have three questions pertaining to the Supplementary Estimate. The largest increase outside of Garda pay and administration arises in respect of the justice and equality Vote, with an increase of €15.6 million for criminal legal aid. I note the comments the Minister made in this regard. Does this increase in the number of certificates being granted arise as a result of an increase...

- Select Committee on Justice and Equality: Criminal Law (Sexual Offences) (Amendment) Bill 2018: Committee Stage (29 Nov 2018)
Jim O'Callaghan: The Minister of State is not the first Independent Member to have an interest in justice legislation but, unlike the others, he has a good chance of getting agreement in certain areas. The substantive part of the legislation is about amending the Punishment of Incest Act 1908. After the Criminal Law (Sexual Offences) Act was enacted last year we had the anomalous position whereby men...

Jim O'Callaghan: I move:That leave be granted to introduce a Bill entitled an Act to amend the Data Protection Act 2018 in order to protect a child's personal data from being processed for marketing purposes and to provide for related matters. - Ceisteanna Eile - Other Questions: Gambling Legislation (29 Nov 2018)
Jim O'Callaghan: I thank the Minister of State for the reply but the Government's delay in this area is simply unforgivable. As I said in the opening question, it was in 2011 that the then Minister, Deputy Shatter, announced plans to change the law on gambling. In 2013, the Department of Justice and Equality published the general scheme of a Gambling Control Bill which was expected to update the 1956...
- Ceisteanna Eile - Other Questions: Gambling Legislation (29 Nov 2018)
Jim O'Callaghan: The Minister of State is right that it was in January 2018 that the Cabinet approved several proposals to update the 2013 general scheme. It approved the proposal to establish an independent regulatory authority, which we support, for control and regulation of the gambling industry. We are told that this interdepartmental working group has met on five occasions since January 2018. What...

- Ceisteanna Eile - Other Questions: Gambling Legislation (29 Nov 2018)
Jim O'Callaghan: In 2011, the then Minister for Justice and Equality, Alan Shatter, announced plans for new legislation on gambling. Unfortunately, however, no new legislation has been enacted by the Houses of the Oireachtas. It is important that we progress legislation in respect of gambling, which is causing significant social problems and which must be regulated. What is the reason for the delay with...
