Public Accounts Committee: 2019 Financial Statements of An Bord Pleanála (13 May 2021)

Colm Burke: On the issue of appeals from local authorities, the annual report states that in 2019, 29,117 decisions were made by local authorities, of which 2,076 were appealed to An Bord Pleanála, equating to a percentage of 5.6%. My figures differ from that because 5.6%, which is 2,076 appeals, would add up to 36,000 applications to local authorities. I am not sure how the 5.6% figure was...

Public Accounts Committee: 2019 Financial Statements of An Bord Pleanála (13 May 2021)

Colm Burke: The figures are higher for those local authority areas compared to others and there are other substantial local authority areas like Cork, Waterford and Limerick. To reduce the workload of An Bord Pleanála, should it not be identified why its workload has increased because of decisions taken by these four local authorities, in particular?

Public Accounts Committee: 2019 Financial Statements of An Bord Pleanála (13 May 2021)

Colm Burke: Does Mr. Walsh have figures on the percentage of decisions that have been appealed where An Bord Pleanála has upheld the appeal, in other words, has ruled that the appeal was valid? Is there a breakdown of those figures?

Public Accounts Committee: 2019 Financial Statements of An Bord Pleanála (13 May 2021)

Public Accounts Committee: 2019 Financial Statements of An Bord Pleanála (13 May 2021)

Colm Burke: No, I am speaking about appeals that came in as a result of decisions made by the local authority on which An Bord Pleanála then made a decision one way or the other, which subsequently ended up in judicial review.

Public Accounts Committee: 2019 Financial Statements of An Bord Pleanála (13 May 2021)

Colm Burke: Yes. I have the number of appeals received from local authorities, which is more than 2,000. An Bord Pleanála then made a decision one way or the other. What I want to know is how many of these decisions ended up being judicially reviewed.

Public Accounts Committee: 2019 Financial Statements of An Bord Pleanála (13 May 2021)

Colm Burke: Mr. Walsh might give me a note on it. How many strategic housing cases that ended up in judicial review with decisions made by the High Court have been appealed to the Court of Appeal?

Public Accounts Committee: 2019 Financial Statements of An Bord Pleanála (13 May 2021)

Colm Burke: No, if it was a High Court decision, the appeal would be made to the Court of Appeal. I want to know the number of judicial reviews in the High Court, on which decisions were made, that subsequently ended up in the Court of Appeal.

Public Accounts Committee: 2019 Financial Statements of An Bord Pleanála (13 May 2021)

Colm Burke: Could I also get figures as to the numbers currently awaiting decisions from the High Court and the Court of Appeal?

Ceisteanna ar Reachtaíocht a Gealladh - Questions on Promised Legislation (12 May 2021)

Colm Burke: In 2016, I introduced the Civil Law (Missing Persons) Bill 2016. There is one part of the jigsaw missing in this area, namely, a central database for unidentified human remains that are found. We have had a number of cases in the past few years, such as the recent case of the late Denis Walsh in Galway. Mr. Walsh's remains were found in 1996 but the family was not informed until 2021 - 25...

Joint Oireachtas Committee on Health: Updates on Breastfeeding: Discussion (12 May 2021)

Colm Burke: I thank our guests for their presentation and the work they are doing in this area. I am married to someone who has worked in maternity services for many years, so I have for 25 years been getting a daily briefing on the challenges in the maternity services. To give an example of where we have come from, when my wife was applying for a job in Dublin many years ago, she was asked how she...

Joint Oireachtas Committee on Health: Updates on Breastfeeding: Discussion (12 May 2021)

Colm Burke: I wonder is it a case that someone gives advice in the morning and whether there is a note put in? Is it a case that there are not proper follow-up notes put in place. For instance, that if nurse A or whoever is attending - whether it be a doctor or a nurse - giving advices, sets out on a chart what advice was given so that whoever comes on at 8 p.m. will know exactly the line that was...

Joint Oireachtas Committee on Health: Updates on Breastfeeding: Discussion (12 May 2021)

Colm Burke: I have only one minute left. Pacify, which is a company based in the US, is looking to come to Ireland where it is offering 24-hour support to women who want to breastfeed. Obviously, it sees a gap in the market in Ireland if it wants to come in. In relation to support if a mother has a difficulty, say, at 10 p.m., and she is at home, what range of services are available for someone at...
