- Seanad: Immigration Bill 2002: Report Stage (Resumed) and Final Stage. (4 Feb 2003)
Joanna Tuffy: I move amendment No. 16: In page 10, line 16, to delete "no" and substitute "in the case of an appeal withdrawn under section 9, no". As I have already said to the Minister, the provision for failure to co-operate is very serious. While we accept that there should not be a provision for someone to appeal the withdrawal of his own application, there could be circumstances in which somebody...

- Seanad: Immigration Bill 2002: Report Stage (Resumed) and Final Stage. (4 Feb 2003)

My colleagues and I have tabled this amendment because we believe it important that an applicant should have the right to...
- Seanad: Immigration Bill 2002: Report Stage (Resumed) and Final Stage. (4 Feb 2003)
Joanna Tuffy: I thank the Minister for giving of his time to this debate. I also thank him for accepting amendments tabled by the Labour Party and also the amendments he has made in light of issues we have raised. I agree with Senator Terry that the purpose of our amendments is to ensure the system in place is fair and humane and that asylum seekers are not deterred from coming to Ireland. I hope the...
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: I move amendment No. 27 to amendment No. 15: After paragraph (e) (ii), to insert the following new subparagraph: "(iv) the insertion after subsection (3) of the following subsection: '(3A) The Tribunal may extend the time for appeal under this section if reasonable cause is shown by the appellant.'.". It would be reasonable to extend the time of appeal in this manner. I would like to hear the...

- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: Amendment No. 24 would allow people to have advance notice so that they could make humanitarian representations. I ask the Minister to comment on that.
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: While I do not have a problem with the section or the amendment in general, I ask the Minister to accept the amendment to amendment No. 23, the purpose of which is to ensure the guidelines issued by the chairperson of the tribunal would be made public and that the Houses of the Oireachtas could address any problems which may arise.
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: I move amendment No. 25: In page 7, before section 6, to insert the following new section: 6.âThe Illegal Immigrants (Trafficking) Act, 2000 is amended: (a) in section 5(2)(a) by the deletion of '14' and the substitution of '35', (b) in section 5(3)(a) by the insertion after the third and fourth references to 'the High Court' of 'or the Supreme Court'.". The amendment proposes to...
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: If amendments were accepted they would give rise to constitutional challenges. Article 26 is a good procedure but, on the other hand, it is good for people to be able to test the constitutionality of legislation by applying it to real facts and events. Will the Minister consider the issue of providing for leave to appeal to the Supreme Court?
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (30 Jan 2003)
Joanna Tuffy: Despite the Minister's comments, I am still not clear as to the purpose or meaning of this amendment. I reserve my position on it. I am not in support of it. Amendment put and declared carried. Sections 6 and 7 agreed to. NEW SECTION.

The law on immigration and asylum goes back to 1935 and has been...
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (29 Jan 2003)
Joanna Tuffy: I move amendment No. 1 to amendment No. 12: In subsection (3)(a), to delete "both, or" and substitute "both". I have no difficulty with the idea of legislating to prevent the employment of illegal persons, but the provision in this section is extreme. Many Irish people have worked illegally in other countries over the years. We need controls, but we also need balance and this section is not...
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (29 Jan 2003)
Joanna Tuffy: I would be more inclined to accept the Minister's comments on the issue of collusion between an illegal alien and an employer if people had more options to come here to work. These options are limited under the current system. On the points made by Senator Morrissey, employers need employees, which is surely the primary reason an employer would employ someone. The Senator is confusing the...
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (29 Jan 2003)
Joanna Tuffy: I move amendment No. 3 to amendment No. 12: In subsection (9), after "the member" to insert "reasonably". An arrest should be allowed on the basis of reasonable suspicion, not on mere suspicion. This is also a requirement of the European Convention on Human Rights. I would like the Minister to comment.
- Seanad: Immigration Bill, 2002: Committee Stage (Resumed). (29 Jan 2003)
Joanna Tuffy: I move amendment No. 4 to amendment No. 12: In subsection (11), after "This section does not apply to a non-national" to insert "who is entitled to be in the State and in particular to a non-national". The section lists four exceptions but it is wrong to allow only those reasons and not to provide for other possibilities. The purpose of the amendment is to protect a non-national who is...
