Seanad: Order of Business (15 Nov 2006)

Terry Leyden: They were entitled to visit the nursing homes in question. We were regular visitors to public nursing homes. Some Senators on the other side of the House were with me when we visited public nursing homes.

Seanad: Order of Business (15 Nov 2006)

Terry Leyden: If we were not satisfied with the conditions in those homes, we would take action. Responsibility in this regard rests with the former members of the then health boards, rather than with the Taoiseach. If the members of the health boards were not carrying out their duties, they should have been doing so.

Seanad: Order of Business (15 Nov 2006)

Terry Leyden: I support the holding of a debate on this matter.

Seanad: Order of Business (15 Nov 2006)

Terry Leyden: We should not frighten people who are in nursing homes at present. The most important inspectorate of all consists of the family members who visit their loved ones in private or public nursing homes, as well as the doctors and other professionals who tend to the residents of such homes. An inspectorate will not solve everything, regardless of whether it is established under new legislation....

Seanad: Patents (Amendment) Bill 1999: Committee and Remaining Stages (9 Nov 2006)

Terry Leyden: It is an order of the House. I cannot change it. We have no choice on the matter.

Seanad: Patents (Amendment) Bill 1999: Committee and Remaining Stages (9 Nov 2006)

Terry Leyden: I appreciate the Senator's wishes. However, we discussed the matter with the Leader of the House and she feels Bills such as this should be given proper consideration. I welcome the departmental officials who are here today. When they have an opportunity to examine the Bill in detail they may discover a matter which must be dealt with. I am under instruction——

Seanad: Patents (Amendment) Bill 1999: Committee and Remaining Stages (9 Nov 2006)

Terry Leyden: I am under instruction from the Leader of the House not to take Report Stage. If the Minister of State requests it I will not object.

Seanad: Patents (Amendment) Bill 1999: Committee and Remaining Stages (9 Nov 2006)

Terry Leyden: From previously being in the position of the Minister of State, I understand it is important to give 100% co-operation. Under the circumstances, if the Minister of State feels the Department is satisfied we can deal with Report Stage, and it would be of benefit to pass the Bill, I will concur with his request. The Leader of the House requires Bills to be given detailed consideration....

Seanad: Patents (Amendment) Bill 1999: Committee and Remaining Stages (9 Nov 2006)

Terry Leyden: I propose that Report Stage be taken now.

Seanad: Patents (Amendment) Bill 1999: Committee and Remaining Stages (9 Nov 2006)

Terry Leyden: I thank the Minister of State, Deputy Michael Ahern, for this Bill. It is technical but important and will have major repercussions on the protection of patents in this country. Perhaps after the Bill is passed the Minister of State will promote patents and encourage people to take them out. Sometimes people create important inventions but neglect to go through the proper patent process....

Terry Leyden: Is Senator Tuffy pressing the amendment?

Seanad: Address by the European Union Ambassador to the United States (8 Nov 2006)

Terry Leyden: He might tell too much.

Seanad: Order of Business (1 Nov 2006)

Terry Leyden: I request the Leader to arrange an early debate on pensions, particularly pertaining to the Bank of Ireland, where a second class scheme is proposed for new employees, while the chief executive of that bank receives €2.5 million per annum in addition to a significant pension scheme and perks. His pension is boosted regularly yet this second class scheme has been arranged. I join the Irish...

Seanad: Patents (Amendment) Bill 1999: Second Stage (26 Oct 2006)

Terry Leyden: ——I introduced the original Bill in the Dáil. At that time I stated, "Patent law has been revised only once since the foundation of the State. That revision was in 1964 and the Patents Act of the same year is still the current law on the subject." I was aware of the Bill's significance, as having a good patent law led to the success of the economy to some extent. I also stated: I...

Seanad: Patents (Amendment) Bill 1999: Second Stage (26 Oct 2006)

Terry Leyden: I am not questioning the Minister of State's interpretation. The earlier Bill was brought to this House by former Minister for Industry and Commerce, Des O'Malley, in January 1992. I am not sure where I was at that time, but that year there were certain events happening and much trauma within the Fianna Fáil Party. A patents Bill is before the House again. It is interesting that Senator...

Terry Leyden: There was another Staunton, or Stanton, since. The Official Report of the debate does not contain the Christian name of the contributor.

Seanad: Patents (Amendment) Bill 1999: Second Stage (26 Oct 2006)

Terry Leyden: Peter Barry, the former deputy leader of the Fine Gael, made a great contribution to the debate on the 1991 Bill when he spoke of his experience as a business person. I commend this Bill to the House and wish the Minister of State well.
