- Seanad: Criminal Justice (Public Order) Bill 2002: Committee Stage. (20 May 2003)
Joanna Tuffy: I move amendment No. 8: In page 7, subsection (2), line 30, after "period" to insert "not exceeding 30 days". I propose this amendment because, in relation to the closure order, or a subsequent closure order, there is currently provision in section 5(2)(b)(i) and (ii) that such an order cannot exceed seven days in the case of the first order, or, in the case of a second or subsequent order,...
- Seanad: Order of Business. (15 May 2003)
Joanna Tuffy: I support Senator Ryan's amendment to the Order of Business in order that we can discuss the proposal to reintroduce third level fees. Deputy Batt O'Keeffe admitted in yesterday's Irish Independent that participation at third level by those in lower and middle income groups had increased substantially.
- Seanad: Order of Business. (15 May 2003)
Joanna Tuffy: Participation by all socio-economic groups has increased since the abolition of third level fees. The Government is not only trying to hit middle income earners but also the PAYE sector. No matter what the income threshold is, PAYE workers would be hit unfairly.
- Seanad: Criminal Justice (Joint Investigation Teams) Bill 2003: Second Stage. (14 May 2003)
Joanna Tuffy: I thank the Minister of State for being in the Chamber and his presentation. The Labour Party broadly welcomes the Bill, which is based on co-operation in criminal law rather than harmonisation of criminal law. It is the right approach to leave intact as much as possible our sovereignty as regards criminal law and the principles which underpin it, while maximising measures at European level...
- Seanad: Order of Business. (13 May 2003)
Joanna Tuffy: I also wish to raise with the Leader the figures on homelessness, house price statistics and the Simon Community report published yesterday. I would like a discussion on the reason the figures regarding homelessness â some counties have a zero rating â were disputed by the Simon Community in terms of its experience and the use of its services in the counties concerned. I support Senator...
- Seanad: Order of Business. (15 Apr 2003)
Joanna Tuffy: I again want to raise with the Leader the need for an ongoing debate on the war in Iraq and the situation in the Middle East generally. I note the statements about Syria made by US figures only yesterday and how it is evident that a bigger project than the action on Iraq is under way as far as the United States is concerned. It is important that Ireland is to the forefront in making clear...
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: On what basis?
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: I do not really understand that.
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: I do not understand why the amendments have been listed if they are not in order.
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: I shall speak on the section anyway. I am sorry that amendment No. 1 was not acceptable. The purpose of it was to bring our own policing operation up to the same standard as the Police Service of Northern Ireland. In the Republic of Ireland, we have all been very keen to press home the importance of implementing the Patten recommendations and how significant they are in terms of policing in...
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: I would not like what I said to be interpreted in the manner that Senator Walsh has suggested. I absolutely accept that our police service is up to a good standard in terms of the work it does, but we do need to modernise our structures. The types of structures that have been brought into the Police Service of Northern Ireland are something we could model our structures on in terms of the...
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: It might seem clear but if it is, why is it is necessary to state the person will be under the direction and control of the Commissioner and have the powers, duties, rights and obligations of a member of the Garda SÃochána? That would seem obvious also but it has had to be spelled out in the legislation. Not inserting the amendment is an omission.
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: I will withdraw it but ask the Minister of State to look at it again. Amendment, by leave, withdrawn.
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: I support the amendment.
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: I raised the issue of section 3(4) yesterday but the Minister of State did not refer to it in his reply. Will he clarify the reason those parts of the normal Garda legislation do not apply to a seconded person, a matter which relates to paragraphs (a), (b) and (c)?
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: My understanding is that the person concerned would not be disciplined by the Garda SÃochána in any case. The disciplinary action would be carried out by the PSNI. I question the value of the subsection but at the same time I appreciate what the Minister of State has outlined.
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: I support the general point made by Senators Jim Walsh and Terry. I presume the programmes to which we referred will provide opportunities for women members of the two forces to have experience in the other police force. Perhaps this measure could be built on.
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Committee and Remaining Stages. (9 Apr 2003)
Joanna Tuffy: I thank the Minister of State, Deputy O'Dea, for coming to the House to debate the Bill. It is an important part of the developing relationship between the UK, the Republic of Ireland and Northern Ireland. I appreciate the need for the timely passing of the legislation, but I also reiterate the need for reforming legislation concerning the structures of accountability for the Garda...
- Seanad: Order of Business. (8 Apr 2003)
Joanna Tuffy: I too welcome the talks in Northern Ireland between the British Prime Minister, the American President and the Taoiseach about the peace process in the North. It is important to remember that this is happening in the context of the war in Iraq. The Taoiseach must make clear Ireland's disapproval of the war and dissociate us from any question of approval of the illegal actions of the UK and...
- Seanad: Garda Síochána (Police Co-Operation) Bill 2003: Second Stage. (8 Apr 2003)
Joanna Tuffy: I thank the Minister for being present and for his contribution. I welcome the general thrust of the Bill. It obviously derives from implementation of the Good Friday Agreement and the Patten report recommendations. As a general principle, it is positive that members of each police force should be able to apply for certain posts in the other police force and have opportunities for secondment....
