Seanad: Budget 2014: Statements (15 Oct 2013)

John Gilroy: The Senator was totally against it.

Seanad: Budget 2014: Statements (15 Oct 2013)

John Gilroy: I welcome the Minister of State back to the Seanad and thank him for coming to the House. I wish to address one point that my good friend and colleague, Senator Darragh O'Brien, made. It is certainly a novel and unique way of supporting a measure by voting against it. I could read his contribution to him if he would like.

Seanad: Budget 2014: Statements (15 Oct 2013)

John Gilroy: I will not waste my time doing so now but I will read it on the Order of Business tomorrow.

Seanad: Budget 2014: Statements (15 Oct 2013)

John Gilroy: Since this Government was elected every budget we have had to introduce has been a difficult one and we accept that. When I say "difficult" I mean it has been difficult for the people of Ireland. Some €31 billion has been taken out of the economy since 2008. That has been a staggering blow to our people but it has been met with fortitude and resilience. People have endured...

Seanad: Budget 2014: Statements (15 Oct 2013)

John Gilroy: That is a decision for the people to make but that is my opinion. Some measures announced in the budget are difficult but necessary and I will deal with one or two of them in the short time available. I believe that nobody would argue that young people are not better off being in education, training or employment. There has been an extension, unfortunately, of the €100 reduced...

Seanad: Irish Sign Language: Motion (9 Oct 2013)

John Gilroy: I welcome the members of the deaf community and their advocates to the Visitors' Gallery. I also welcome the Minister of State. It is good to see her again. I welcome the fact that the Government is accepting this good and worthy proposal. I must admit my knowledge of this subject is rather incomplete, but in the course of researching for the debate I was amazed by some of the information...

Seanad: Order of Business (8 Oct 2013)

John Gilroy: As a former psychiatric nurse, I would like to draw the attention of the House to the fact that this is Irish Nurses and Midwives Week, which gives the profession the opportunity to showcase its continually developing role in our rather challenged health system. The expanding role of the nursing and midwifery profession is taking on a more collaborative aspect. This week provides an...

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)

John Gilroy: The House must have regard to first principles. I was astonished to hear Senator Byrne and some of his colleagues say that we need not have regard to the Constitution while making law in the House.

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)

John Gilroy: Senator Byrne certainly said it.

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)

John Gilroy: If that is the case, this House should be abolished on the spot.

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)

John Gilroy: The very first principle of good law here is that it conforms to the Constitution. The Attorney General is an independent officer who gives independent legal advice to the Government. The Attorney General has given advice that this may not be constitutional.

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)

John Gilroy: We are asking to bring in legislation that has a question mark over it.

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)

John Gilroy: I commend Senator Quinn on introducing the legislation and I apologise for my rushed statement. Regardless of whether I am a member of the Government parties-----

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)

John Gilroy: -----if this was what I thought the right thing to do, I would support it. It is not because I am in Government.

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)

John Gilroy: If we were to bring in the law and it was challenged in two years time and found to be unconstitutional, we would have opened up the State to be liable for compensation.

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)

John Gilroy: That is the exact opposite of what a good law should be, irrespective of the good intentions of the Senator.

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)

John Gilroy: An astonishing contribution.

Seanad: Upward Only Rent (Clauses and Reviews) Bill 2013: Second Stage (2 Oct 2013)
