Investment Funds, Companies and Miscellaneous Provisions Bill 2005 [Seanad]: Report and Final Stages. (24 Jun 2005)

Noel Treacy: The current version of the Bill would regard this as section 40(2). I will quote from it: The Companies (Recognition of Countries) Order 1964 (S.I. No. 42 of 1964) is revoked to the extent that it is for the purposes of section 367 of the Act of 1963. I accept the validity of the amendment proposed by Deputy Howlin. However, I am advised that the present formulation of this Bill is...

Investment Funds, Companies and Miscellaneous Provisions Bill 2005 [Seanad]: Report and Final Stages. (24 Jun 2005)

Noel Treacy: The Bill refers to Article 2 of the Companies (Recognition of Countries) Order 1964, so there is a recognition of that order, SI 42 of 1964 which, as the Bill says, is amended by the substitution of "section 250" for "sections 250 and 367". This proposal, as contained in the Bill — obviously having come through the due process of legal advice, the Office of the Attorney General, the Office...

Investment Funds, Companies and Miscellaneous Provisions Bill 2005 [Seanad]: Report and Final Stages. (24 Jun 2005)

Noel Treacy: If an amendment brought forward from the Opposition has a legal import, we are obliged to take legal advice on it. We did so in this instance and the legal advice is that it is unnecessary to make this change. However, in view of the case made by Deputy Howlin, I will ask the eminent officials present to have further discussions with the Parliamentary Counsel, and if any further change is...

Investment Funds, Companies and Miscellaneous Provisions Bill 2005 [Seanad]: Report and Final Stages. (24 Jun 2005)

Noel Treacy: I move amendment No. 12: In page 51, lines 3 to 10, to delete all words from and including "State" in line 3 down to and including "2A." in line 10 and substitute the following: "State"— (I) the only securities of which for the time being are authorised (or during the period of 5 years referred to in paragraph (b) were authorised) to be traded by a recognised stock exchange on a market...

Investment Funds, Companies and Miscellaneous Provisions Bill 2005 [Seanad]: Report and Final Stages. (24 Jun 2005)

Noel Treacy: I move amendment No. 13: In page 54, after line 42, to insert the following: "87.—(1) Section 33AN of the Central Bank Act 1942 (inserted by the Central Bank and Financial Services Authority of Ireland Act 2004) is amended by inserting the following definitions after the definition of 'contravene': '"designated enactment" does not include Part 4 or 5 of the Investment Funds, Companies and...

Investment Funds, Companies and Miscellaneous Provisions Bill 2005 [Seanad]: Report and Final Stages. (24 Jun 2005)

Noel Treacy: I am speaking of a new section after section 86. We are proposing to add a new section.

Garda Síochána Bill 2004 [Seanad]: Report Stage (Resumed). (23 Jun 2005)

Noel Treacy: The show must move on.

Order of Business. (23 Jun 2005)

Noel Treacy: Along the dotted line.

Order of Business. (23 Jun 2005)

Noel Treacy: What would the Deputy like him to eat?

Order of Business. (22 Jun 2005)

Noel Treacy: The Deputy forgot the hot air Bill.

Order of Business. (22 Jun 2005)

Noel Treacy: It is on its way.

Order of Business. (22 Jun 2005)

Noel Treacy: The pipe is being laid.

Order of Business. (16 Jun 2005)

Noel Treacy: The Deputy should not be jealous.

Order of Business. (16 Jun 2005)

Noel Treacy: He was out of the country.

European Constitution. (2 Jun 2005)

Noel Treacy: I propose to answer Questions Nos. 2 and 4 together. The Government very much regrets the outcome of the referenda in France and the Netherlands on the European constitution. However, we fully respect the democratic right of the people of each country to make their own decision, as we respect the decisions of those other member states that have already ratified the constitution. The European...

European Constitution. (2 Jun 2005)

Noel Treacy: To answer the last question first, it is a matter for each member state to decide how it may ratify the EU constitution. I cannot guess what the United Kingdom will do.

European Constitution. (2 Jun 2005)

Noel Treacy: The United Kingdom will take up the EU presidency on 1 July and will clearly play a major part at the European Council meeting on 16 and 17 June. We await the suggestions it will bring to the table regarding how we can move ahead. Ireland will take its own decision as a sovereign nation with its own Government and this Parliament. We will take our own decision in due course, based on what we...

European Constitution. (2 Jun 2005)

Noel Treacy: I agree with some of the sentiments expressed by Deputy Allen. I thank him and his party, as I do Deputy Michael Higgins and his party for the powerful and solid support and endorsement they have given for the EU constitution over the past 12 months. I do not know where Deputy Allen got the idea that a decision had been made. Nobody said the decision was made. We have not made a decision. We...

European Constitution. (2 Jun 2005)

Noel Treacy: No decision has been made. We have given clear answers. Since I took up my post on 30 September of last year, it was clear that a decision on a referendum would be made during the year ahead.

European Constitution. (2 Jun 2005)

Noel Treacy: We made a clear decision that we would proceed and it was on that basis that we published the legislation. However, we never said when that referendum would be held — we have not made that decision. I do not want anybody to be under the misapprehension that we made a decision on a date as we have not done so.
