Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Committee Stage (16 Feb 2023)

Michael McDowell: As there is an appeal, one cannot judicially review, therefore, the process that led to the appeal. The problem with that arises in the context of a possible unfairness in the process, such as the absence of compliance with a duty to disclose all documents or, alternatively, the fact that the person simply could not afford to be involved in a lengthy investigation. To say that judicial...

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Committee Stage (16 Feb 2023)

Michael McDowell: If I am wrongly found guilty of a contravention and then appeal it to that body and have my lawyers there, can the tribunal at that stage award me my costs or is that all on my own account?

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Committee Stage (16 Feb 2023)

Michael McDowell: Fair enough. A person might have waded through blood, legally speaking, and then been exonerated. If that person is not then entitled to the costs of his or her vindication, there is something very unfair about it.

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Michael McDowell: First, I note this legislation started in Dáil Éireann and is coming to this House where it will effectively be amended and it will then, apparently, be approved by Dáil Éireann. There are a few points that I would like to raise, although maybe it is a bit late to do so as it has arrived at this stage in this House. What we are doing here is conferring on the Central...

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Michael McDowell: Who pays for that process?

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Michael McDowell: It is not agreed. We only got five minutes each. The speaking time allocated is a serious disgrace to this House.

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Michael McDowell: I know the Cathaoirleach does not like me mentioning it but five minutes on this Bill is a real disgrace to this House.

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Michael McDowell: Yes, and that was disgraceful too.

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Michael McDowell: It shows the contempt of the person who said five minutes each is enough.

Seanad: Central Bank (Individual Accountability Framework) Bill 2022: Second Stage (8 Feb 2023)

Michael McDowell: I am never listened to. Five minutes is absurd. It is a rubber-stamp assembly, and you know that.

Seanad: Protection of Private Residences (Against Targeted Picketing) Bill 2021: Second Stage (26 Jan 2023)

Michael McDowell: I support the idea of preventing people from picketing the homes of Members of the Oireachtas because they are their homes and Members are entitled to the same privacy that anybody else is at their home. It struck me that way back in 1994, a Criminal Justice (Public Order) Act was passed which provides in section 5: (1) It shall be an offence for any person in a public place to engage in...

Seanad: Protection of Private Residences (Against Targeted Picketing) Bill 2021: Second Stage (26 Jan 2023)

Michael McDowell: Kildare is the best place to have it.

Seanad: Protection of Private Residences (Against Targeted Picketing) Bill 2021: Second Stage (26 Jan 2023)

Michael McDowell: On a point of order, the Minister of State, in his closing remarks, made reference to a money message being required. This Bill does not require a money message, full stop, and anybody in the Department or in government who thinks this type of legislation does require it is deluding himself or herself. Money messages should not be used as a kind of veto card for Private Members' legislation.

Seanad: Wind Energy: Statements (25 Jan 2023)

Michael McDowell: I welcome the Minister. I wish to say a few words about this important topic. We need to acknowledge a number of things. As he said, in 2004, I believe we had the first significant wind farm in Europe built off the coast of Arklow. That was Ireland moving ahead. However, Ireland is now behind the curve. As he also said, we are in a race, but we are behind in the race and we need to...
