Seanad: Rural Development Policy: Statements. (18 Feb 2003)

John Paul Phelan: I agree with much that Senator White and many other Senators have said. I welcome the Minister to the House. He has an important portfolio and I wish him well. Like most of the other speakers, I have been encouraged by what the Minister has said since he took office. His heart is in the right place and he is a man who knows what rural affairs are all about.

Seanad: Capital Acquisitions Tax Consolidation Bill 2002: Report and Final Stages. (18 Feb 2003)

John Paul Phelan: I welcome the Minister of State at the Department of Finance, Deputy Parlon, to the House. I welcome this Bill but I have a concern in regard to the area of penalties for breaches of the legislation. I understand that the penalty for failure to make a return will be only €2,500 and if somebody makes a fraudulent return it will be about €6,000 or €7,000. Those sums are not significant...

Seanad: Finance and Related Matters: Statements. (18 Feb 2003)

John Paul Phelan: That is not what he said.

Seanad: Finance and Related Matters: Statements. (18 Feb 2003)

John Paul Phelan: It was 800 years.

Seanad: Finance and Related Matters: Statements. (18 Feb 2003)

John Paul Phelan: Hear, hear.

Seanad: Finance and Related Matters: Statements. (18 Feb 2003)

John Paul Phelan: Most of what I wish to say on this topic has been said already. I was particularly taken by Senator Quinn's contribution and I agree with most of his speech. The wide divergence of views expressed in this debate shows that economists have a difficult job because they must study a problem from many different perspectives before making a decision.

Seanad: Finance and Related Matters: Statements. (18 Feb 2003)

John Paul Phelan: Many Senators have mentioned social partnership, from which nobody can doubt that we, as a nation, have benefited tremendously since it was introduced. I was particularly taken by the contribution of Senator Minihan and that of the Minister of State, a party colleague of his. I was also interested in the comments of the Tánaiste in regard to the current social partnership agreement. The...

Seanad: Finance and Related Matters: Statements. (18 Feb 2003)

John Paul Phelan: That is only one point.

Seanad: Unclaimed Life Assurance Policies Bill 2002: Committee Stage (Resumed) and Remaining Stages. (13 Feb 2003)

John Paul Phelan: As this is the last amendment, we probably could have concluded Committee Stage last night. I have already spoken briefly on the amendment. Section 17(2) states: Each insurance undertaking shall furnish a certificate of compliance to the regulatory authority, not later than one month after the end of each financial year, in the form and manner that the regulatory authority may specify,...

Seanad: Unclaimed Life Assurance Policies Bill 2002: Committee Stage (Resumed) and Remaining Stages. (13 Feb 2003)

John Paul Phelan: I thank the Minister of State for coming to the House today and spending most of yesterday afternoon with us. I thank his colleague, the Minister of State at the Department of the Environment and Local Government, Deputy Gallagher, who also attended the debate. I agree that this is important and worthwhile legislation. I am glad the Minister for Finance has consulted the Attorney General and...

Seanad: Protection of the Environment Bill 2003: Second Stage (Resumed). (13 Feb 2003)

John Paul Phelan: I welcome the Minister to the House again. I will try to be brief and avoid rehashing the words of other speakers. I would be in dereliction of my duty as a councillor and as a Senator elected by councillors were I not to voice my concern about and disapproval of the section of the Bill which transfers to managers powers in the area of waste management charges, which have been held by...

Seanad: Protection of the Environment Bill 2003: Second Stage (Resumed). (13 Feb 2003)

John Paul Phelan: The managers passed them.

Seanad: Protection of the Environment Bill 2003: Second Stage (Resumed). (13 Feb 2003)

John Paul Phelan: Ask Senator Walsh.

Seanad: Unclaimed Life Assurance Policies Bill 2002: Second Stage. (12 Feb 2003)

John Paul Phelan: I welcome the Minister of State to the House. He is an able substitute for the Minister for Finance who cannot be with us this morning.

Seanad: Unclaimed Life Assurance Policies Bill 2002: Committee Stage. (12 Feb 2003)

John Paul Phelan: I move amendment No. 1: In page 11, subsection (2)(b), line 31, after "Chapter 2" to insert the following: "which shall apply even if the proceeds of such unclaimed policies have already been transferred to the Dormant Accounts Fund".

Seanad: Unclaimed Life Assurance Policies Bill 2002: Committee Stage. (12 Feb 2003)

John Paul Phelan: I move amendment No. 2: In page 12, subsection (3)(d), line 2, after "policies" to insert "provided the regulation does not adversely affect the interest of the policy holder". Section 7 states the aim is "to reduce the administrative and financial burden of maintaining unclaimed policies". The amendment seeks to avoid a situation where a financial institution or an insurance company could...

Seanad: Unclaimed Life Assurance Policies Bill 2002: Committee Stage. (12 Feb 2003)

John Paul Phelan: It would not do any harm. The purpose of the amendment is specifically to mention the policyholder in the section. The policyholder is not mentioned in the provision as it stands. I accept the Minister of State's response but the inclusion of the words "policy holder" would not have a detrimental effect. I urge him to reconsider.

Seanad: Unclaimed Life Assurance Policies Bill 2002: Committee Stage. (12 Feb 2003)

John Paul Phelan: I move amendment No. 3: In page 12, subsection (1), lines 5 to 7, to delete all words from and including ", except" in line 5 down to and including "policy," in line7. Under this section policyholders who may have more than one policy with an insurance company do not have to be notified more than once. If a policy has reached its conclusion and in two or three years another policy was to be...

Seanad: Unclaimed Life Assurance Policies Bill 2002: Committee Stage. (12 Feb 2003)

John Paul Phelan: I agree with Senator McDowell. When one considers that the companies have had the benefit of unclaimed funds for a number of years, it is not an undue burden to expect them to try to make contact with policyholders on more than one occasion. While newspaper advertising is a good idea, there are many different daily newspapers. Some years ago, it may have been enough to place an advertisement...

Seanad: Unclaimed Life Assurance Policies Bill 2002: Committee Stage. (12 Feb 2003)

John Paul Phelan: Again I agree with Senator McDowell. The Minister said that it would be of benefit to the assurance companies to offload these policies. If that is the case, then surely we need to have more protection for the consumer. If it would be to the benefit of the assurance companies to offload the accounts to the fund which will be established, and if they cut corners and do not try to look up every...
