Public Accounts Committee: 2016 Annual Report and Appropriation Accounts of the Comptroller and Auditor General
Chapter 3 - Cost of Bank Stabilisation Measures as at the end of 2016
Irish Bank Resolution Corporation Liquidation
(14 Dec 2017)

Marc MacSharry: No one appears to be using them. I do not want to delay on this matter, but I want to go further down the list of parliamentary questions. Mr. Carville called out for Deputy David Cullinane the hourly rate for partners. I want a breakdown of how many partners are being used and for how many hours to perform certain tasks. The Minister, or perhaps the witnesses on his behalf, wrote back to...

Marc MacSharry: I disagree, which is why I would love to see the contract.

Chapter 3 - Cost of Bank Stabilisation Measures as at the end of 2016
Irish Bank Resolution Corporation Liquidation
(14 Dec 2017)

Marc MacSharry: If it is not reflected in the contract or anywhere else, why are we doing it?

Public Accounts Committee: 2016 Annual Report and Appropriation Accounts of the Comptroller and Auditor General
Chapter 3 - Cost of Bank Stabilisation Measures as at the end of 2016
Irish Bank Resolution Corporation Liquidation
(14 Dec 2017)

Marc MacSharry: If a freedom of information request was received in the Department for information on Mr. Carville's salary, he would be informed, but the Department would get the information out as quick as it could. However, we are not allowed to tell people how much we are paying for a product or service and how many hours it takes them to do it.

Marc MacSharry: Mine too, but I am saying I am not asked whether it would be all right; I am told that it is being sent. That is the way it should be, but Mr. Carville and I are not getting €222 million. The liquidators are and I think the public are entitled to know. The Comptroller and Auditor General and the Department of Finance have no role in the procurement of the joint special liquidators....

Marc MacSharry: Is Mr. Carville in a position, notwithstanding the case, to answer the parliamentary questions I asked in September and on which I touched earlier, or will he say it is still claimed the information is commercially sensitive and that he cannot tell me?

Public Accounts Committee: 2016 Annual Report and Appropriation Accounts of the Comptroller and Auditor General
Chapter 3 - Cost of Bank Stabilisation Measures as at the end of 2016
Irish Bank Resolution Corporation Liquidation
(14 Dec 2017)

Marc MacSharry: Mr. Carville does not have to respect it. What is the definition of "commercially sensitive"? It is something, apparently, that we are allowing the contractor, KPMG, to determine and Mr. Carville is saying, "Fair enough."

Marc MacSharry: It is a little like the promissory notes.

Chapter 3 - Cost of Bank Stabilisation Measures as at the end of 2016
Irish Bank Resolution Corporation Liquidation
(14 Dec 2017)

Marc MacSharry: It is a little like the movie, "Dumb and Dumber".

Marc MacSharry: "That, Sir, is as good as cash. I will tell you as soon as it suits me to tell you." Mr. Carville is professionally sceptical; that is his training as an accountant. He studied for many years and was the top of the class. We are trying to be professionally sceptical, but what we are seeing is that there is no defined process and that there are no procedures. We took out the bit that...

Marc MacSharry: That is a joke. We cannot allow the public to know how much it is getting for its euro. That is laughable and unacceptable. The committee has a job to do. The Department of Finance is not alone. Time and again departmental officials have queued to tell us that information is commercially sensitive and what is the legal advice, etc. It actually does not matter that Mr. Hall took the case...

Online Advertising and Social Media (Transparency) Bill 2017: Second Stage [Private Members] (13 Dec 2017)

Marc MacSharry: I thank the Minister for taking the time and I congratulate my colleague, Deputy Lawless, for his Private Members' Bill. It is very useful. The Government should accept it and use pre-legislative scrutiny and Committee Stage to improve it if it feels there are anomalies in the Bill. Deputy Lawless has outlined the many positives in the Bill. I will focus on the strategic spin unit....

Home Care Packages: Motion [Private Members] (12 Dec 2017)

Marc MacSharry: I commend my colleagues in the Rural Independent Group on using their Private Members' time to debate this issue. Last week at the Committee of Public Accounts, we had the pleasure of hearing from Mr. John McKeon, Secretary General of the Department of Employment Affairs and Social Protection. Having asked the same question on several occasions in this House and before that in the Seanad, I...

Electoral (Amendment) (Dáil Constituencies) Bill 2017: All Stages (12 Dec 2017)

Marc MacSharry: This is a shambles, as is the case every time a Bill of this nature is published. We are bound by Article 16 of the Constitution and the practice, which is a horrible word often used in the House, is that all Members will say that the Bill is great and accept it and on we go. I ask the Minister of State, who I have known for a long time, to be the pioneering Minister who facilitates a...

Written Answers — Department of Housing, Planning, and Local Government: Local Authority Funding (12 Dec 2017)

Marc MacSharry: 532. To ask the Minister for Housing, Planning, and Local Government if an assistantsSecretary in his Department gave a commitment later in the first quarter of 2015 when they met with the chief executive and management team of the council that they would find a way of getting the allocation back to Sligo once the financial plan for the council had been approved (details supplied). [53391/17]

Written Answers — Department of Housing, Planning, and Local Government: Local Authority Funding (12 Dec 2017)

Marc MacSharry: 533. To ask the Minister for Housing, Planning, and Local Government if a meeting with the chief executive of the council on 7 September 2016 when the issue of repayment was again raised, an Assistant Secretary of his Department referred to their recollection of the matter being that on approval of the financial plan and adherence by the council to the terms of the plan over a two or...

Written Answers — Department of Housing, Planning, and Local Government: Local Authority Funding (12 Dec 2017)

Marc MacSharry: 534. To ask the Minister for Housing, Planning, and Local Government if the change to the criteria was never communicated to Sligo County Council in view of the fact it is now two years since the signing of the plan and the agreed adjusted targets have been achieved; and if the €750,000 will be remitted to Sligo County Council immediately. [53393/17]

Public Accounts Committee: Comptroller and Auditor General 2016 Report
Chapter 16: Regularity of Social Welfare Payments
Chapter 17: Management of Social Welfare Overpayments
Chapter 18: Department Reviews of welfare Schemes, Social Welfare Appeals Process, Social Insurance Fund
(7 Dec 2017)

Marc MacSharry: I welcome the witnesses and congratulate Mr. McKeon on his appointment. I wish the Department a happy birthday, as it is 70 years old. Sometimes, our discussions are robust and abrupt, so I will cut in if I get an answer and move on to something else. I looked through the appeals office's annual report for 2016. Of 13,754 appeals, 7,871 were fully allowed. That is 57%. Does that not...

Chapter 16: Regularity of Social Welfare Payments
Chapter 17: Management of Social Welfare Overpayments
Chapter 18: Department Reviews of welfare Schemes, Social Welfare Appeals Process, Social Insurance Fund
(7 Dec 2017)

Marc MacSharry: I have the precise figures here. They are in the report.

Chapter 16: Regularity of Social Welfare Payments
Chapter 17: Management of Social Welfare Overpayments
Chapter 18: Department Reviews of welfare Schemes, Social Welfare Appeals Process, Social Insurance Fund
(7 Dec 2017)

Marc MacSharry: Does this mean that some of the Department's deciding officers are not interpreting legislation correctly? Are they making incorrect decisions or does it mean that appeals officers are using discretionary powers?
