Seanad: Pension Provisions. (2 Jul 2004)

Sheila Terry: I thank the Minister for staying on and dealing with this matter. This is an issue I have raised a number of times in the Seanad, but today I want to speak about the wind-up of pensions. We have spoken a lot about the pension timebomb, but the biggest timebomb will go off when people who have been paying into pension funds all their working lives reach retirement and discover their pension is...

Seanad: Commissions of Investigation Bill 2003: Second Stage. (1 Jul 2004)

Sheila Terry: I welcome the Minister. The tribunal and public inquiry system is critical to the functioning of a democratic State. The core principles of any investigation must be that it is effective, efficient and has the full confidence of the public. Despite much excellent work from the current tribunals, there is clear evidence that public confidence in the tribunal model as a means of excavating and...

Seanad: Order of Business. (1 Jul 2004)

Sheila Terry: Yesterday Senator Henry and I attended a conference at the Dóchas Centre, the women's prison at Mountjoy. It was an interesting experience which raised many questions. One of the most obvious and urgent issues is the relocation of Mountjoy Prison — to where will it be moved? The Dóchas Centre will also be relocated. The Minister for Justice, Equality and Law Reform should come to the...

Seanad: Order of Business. (1 Jul 2004)

Sheila Terry: ——and the provision of prison places in general. Do we even need to increase the number of prison places, as the Minister is suggesting? We urgently need a debate about prisons in general. Why are so many young girls imprisoned for theft? I am not trying to demean the effect of such crimes, but 95% of the women in the Dóchas Centre have been convicted of theft. We have also heard of the...

Seanad: Order of Business. (29 Jun 2004)

Sheila Terry: Last week a well known and reputable company in Dublin issued a letter to its employees stating it was no longer in a position to honour its commitment to a pension plan for them and that it would be winding it up. I have raised the pensions issue in the House on a number of occasions but it is reaching a new level when a company, which is doing well and whose directors paid themselves...

Seanad: Order of Business. (29 Jun 2004)

Sheila Terry: Will the Leader ask the Tánaiste and Minister for Enterprise, Trade and Employment, Deputy Harney, to examine the issue? She can find out from the pensions board which companies are doing this to their employees while the directors are pocketing profits and leaving their employees without pension plans.

Seanad: Order of Business. (24 Jun 2004)

Sheila Terry: Did the Leader fly with Ryanair?

Seanad: Order of Business. (24 Jun 2004)

Sheila Terry: Last night on the television news we saw horrific pictures and heard about the growing number of children who are being trafficked from eastern Europe to this country. It is a matter of serious concern. While legislation is in place to combat such trafficking, it is obviously being breached if large numbers of children are being brought here illegally. The Minister for Justice, Equality and...

Seanad: Transfer of Execution of Sentences Bill 2003: Report and Final Stages (Resumed). (23 Jun 2004)

Sheila Terry: I thank the Minister and his staff for the time and effort put into this Bill. Certainly it will lead to greater co-operation between member states and will ensure people serve their due sentences. The whole legal process will be better served as a result of the enactment of this legislation.

Seanad: Autism Services: Statements (Resumed). (23 Jun 2004)

Sheila Terry: Everybody here is of one mind on this subject and we all wish to see an improved service for the parents of autistic children. None of us appreciates our healthy children until we meet somebody who has an autistic child. I met some of these parents during the recent campaign and they have so many different concerns about their children's futures depending on the current age of each particular...

Seanad: Criminal Justice (Joint Investigation Teams) Bill 2003 [Seanad Bill amended by the Dáil]: Report and Final Stages. (23 Jun 2004)

Sheila Terry: I thank the Minister for tabling the amendment. I have no problem with it and agree with its contents.

Seanad: Transfer of Execution of Sentences Bill 2003: Report and Final Stages. (23 Jun 2004)

Sheila Terry: I second the amendment.

Seanad: Transfer of Execution of Sentences Bill 2003: Report and Final Stages. (23 Jun 2004)

Sheila Terry: I move amendment No. 1: In page 3, between lines 25 and 26, to insert the following: "'relevant authority' means the person designated in the relevant country concerned who performs functions the same as or similar to those performed by the Minister under this Act;".

Seanad: Transfer of Execution of Sentences Bill 2003: Report and Final Stages. (23 Jun 2004)

Sheila Terry: The concept of a relevant authority is central to the Bill and should be clarified at the outset. I have taken these words out of section 5 as they are more appropriate to the definitions section. The words I propose to delete in amendment No. 5 are clearly more appropriate to the definitions section, which is why I propose they are not removed but relocated in section 2 so the reader can...

Seanad: Transfer of Execution of Sentences Bill 2003: Report and Final Stages. (23 Jun 2004)

Sheila Terry: I defer to the Minister.

Seanad: Transfer of Execution of Sentences Bill 2003: Report and Final Stages. (23 Jun 2004)

Sheila Terry: I move amendment No. 2: In page 4, between lines 18 and 19, to insert the following: "2.—The purpose of this Act includes the giving effect to the following—— (a) Article 2 of the Additional Protocol to the 1983 Council of Europe Convention on the Transfer of Sentenced Persons, and (b) Articles 67 to 69 of the Schengen Convention.". It is always useful to find a purpose provision in a...

Seanad: Transfer of Execution of Sentences Bill 2003: Report and Final Stages. (23 Jun 2004)

Sheila Terry: I thank the Minister but perhaps we should have consistency in all our Bills. Section 5 of the Water Services Bill 2003 contains a purpose provision, on which my amendment is modelled, and section 2 of the Air Navigation and Transport Act 2004 contains a purpose provision. It may be time to look at this again to achieve consistency in our Bills.

Seanad: Transfer of Execution of Sentences Bill 2003: Report and Final Stages. (23 Jun 2004)

Sheila Terry: I move amendment No. 4: In page 4, line 19, after "sentences" to insert ", including those imposed outside the State".

Seanad: Transfer of Execution of Sentences Bill 2003: Report and Final Stages. (23 Jun 2004)

Sheila Terry: I thank Senator Tuffy for seconding my amendments. In our legislation there is a presumption against extra-territorial effect. In order to rebut this presumption, very clear words must be used. I propose this amendment in order to guarantee that this Bill will apply to sentences imposed outside the State and I hope the Minister accepts the amendment.

Seanad: Transfer of Execution of Sentences Bill 2003: Report and Final Stages. (23 Jun 2004)

Sheila Terry: Again, I defer to the Minister and withdraw the amendment.
