- Seanad: Registration of Wills Bill 2006: Committee and Remaining Stages (13 Dec 2006)
Joanna Tuffy: This is a good amendment but there are problems in the Bill. I say that in good faith because I welcome the fact that Senator Leyden has brought it forward. The Minister of State's father played a major role in the Succession Act which is very good legislation. If people do not make a will the spouse and children are provided for because of our legislation for people who die intestate.
- Seanad: Registration of Wills Bill 2006: Committee and Remaining Stages (13 Dec 2006)
Joanna Tuffy: We do not know how many people will register, should the Bill be enacted. The Minister of State said he would consider setting up a register for guardianship agreements. Such a register exists in Scotland and hardly anyone registered those agreements. Registration systems can be problematic in that sense. I referred to the superstition people have regarding wills. Part of it is that they...
- Seanad: Registration of Wills Bill 2006: Committee and Remaining Stages (13 Dec 2006)
Joanna Tuffy: I disagree slightly with Senator Browne on the point he has made about wills. I made the point earlier. There is nothing wrong with not making a will. There are advantages to making a will. As a result of the reforming legislation brought in by the late Brian Lenihan, one is provided for fairly even when there is no will. It is important to say that. When a will is made there are huge...
- Seanad: Genealogy and Heraldry Bill 2006: Second Stage (12 Dec 2006)
Joanna Tuffy: I thank the Irish Genealogical Society for providing information to the Labour Party to help us draft this Bill. My contribution relies on much of that information. The legislative basis of this issue was last debated here in 1996-97. The problem that confronted Members then was whether the Genealogical Office was already established in law and needed to be abolished in its old form before...
- Seanad: Order of Business (12 Dec 2006)
Joanna Tuffy: I have read reports in the newspapers, including The Irish Times, to the effect that the Government might delay a referendum to deal with the fall-out from the statutory rape controversy and the age of consent. It is no secret that I oppose the lowering of the age of consent. I have said this any time the issue has been debated here. I agree with the Rape Crisis Centre that we may need to...
- Seanad: Prisons Bill 2006: Report Stage (Resumed) and Final Stage. (5 Dec 2006)
Joanna Tuffy: I move amendment No. 41: In page 26, line 33, after "law" to insert "or order of any court". The Minister indicated he might be supportive of this amendment so we resubmitted it. The purpose of the amendment is to make it clear that the accused will also be present for the purposes of any court order in addition to being present for the purposes of any enactment or rule of law. For example,...
- Seanad: Prisons Bill 2006: Report Stage (Resumed) and Final Stage. (5 Dec 2006)
Joanna Tuffy: I second the amendment.
- Seanad: Prisons Bill 2006: Report Stage (Resumed) and Final Stage. (5 Dec 2006)
Joanna Tuffy: I thank the Minister and his staff for their work on this Bill and for the amendments he accepted from me.
- Seanad: Prisons Bill 2006: Report Stage. (5 Dec 2006)
Joanna Tuffy: In respect of the amendments I tabled, I welcome the Minister's effective acceptance in amendment No. 13 of the point I made in amendment No. 14, which I will withdraw. As for amendment No. 15, Labour Party Members tried to include the United Nations Committee against Torture because they believed this section gives a right to visit a prisoner to the Council of Europe Committee for the...
- Seanad: Prisons Bill 2006: Report Stage. (5 Dec 2006)
Joanna Tuffy: I move amendment No. 15: In page 13, line 8, after "Commission" to insert ", United Nations Committee against Torture". Has the Minister anything to say in respect of this amendment?
- Seanad: Prisons Bill 2006: Report Stage. (5 Dec 2006)
Joanna Tuffy: Yes. Perhaps the Minister might also comment on my point about psychologists.
- Seanad: Prisons Bill 2006: Report Stage. (5 Dec 2006)
Joanna Tuffy: I move amendment No. 1: In page 6, line 16, after "force" to insert "at a material time". We tabled this amendment because the definition of "prison rules" is somewhat flawed in that it applies only to rules in force. Thus, if new rules were made repealing old rules the old rules would no longer be in force and would not be prison rules for the purpose of any ongoing disciplinary...
- Seanad: Prisons Bill 2006: Report Stage. (5 Dec 2006)
Joanna Tuffy: I cannot make any further arguments about it. I withdraw the amendment. If my colleagues want to retable it in the Dáil, they will do so.
- Seanad: Electoral (Amendment) Bill 2006: Second Stage (30 Nov 2006)
Joanna Tuffy: I have no problems with most of the provisions in the Bill. The exception is section 11, which extends the deadline to 9 December for any person wishing to make a correction to the draft register. That is not a long enough extension and the Bill will barely have passed before the extension expires. I do not think there has been enough time for the message to reach people that an...
- Seanad: Further and Adult Education: Statements (30 Nov 2006)
Joanna Tuffy: I too wish the Minister of State well in her future endeavours and commend her work in this and the youth work area. I recently received a statement from the National Youth Council of Ireland which was happy with the increases provided for youth work in the recent Estimates. Our education system should be based on the concept of lifelong learning, which includes adult and further education....
- Seanad: Domestic Violence: Statements (29 Nov 2006)
Joanna Tuffy: The debate has been organised as part of an international campaign on violence against women. This is a worldwide problem and it is symptomatic of the inequality experienced by women in many societies where, at its most extreme, female genital mutilation is very much part and parcel of being a woman. It is important that we do what we can to address the inequality experienced by women...
- Seanad: Domestic Violence: Statements (29 Nov 2006)
Joanna Tuffy: The Australian example should be examined. It has overhauled its system to remove as many family law cases from the courts and into the alternative dispute resolution arena as possible and to promote co-parenting, parenting plans and so on. Issues of abuse or domestic violence should be appropriately dealt with and court cases should be fast-tracked and given priority in the system. Our...
- Seanad: Prisons Bill 2006: Committee Stage (28 Nov 2006)
Joanna Tuffy: Amendment No. 48 aims to deal with a problem in the section which requires the Minister to move a draft resolution of both Houses containing a drawing. We feel that it may be cumbersome to insert a drawing in the resolution, as the Bill now demands, so we suggest the alternative of identifying a drawing which may not necessarily be contained in the resolution but which could be laid before...
- Seanad: Prisons Bill 2006: Committee Stage (28 Nov 2006)
Joanna Tuffy: Can the Minister ensure that the buildings are nice? Many buildings go up which are a blight on the landscape yet when one raises that with county managers they say that is because the law is not strong enough to help them require good design. If this was in the Minister's control he could try to do that. Perhaps in future these buildings will not all be used as prisons and could be given...
- Seanad: Prisons Bill 2006: Committee Stage (28 Nov 2006)
Joanna Tuffy: What about the buildings?
