Seanad: Order of Business. (2 Jul 2004)

James Bannon: The Senator should tell it to the farmers of County Sligo.

Seanad: Residential Tenancies Bill 2003: Second Stage. (2 Jul 2004)

James Bannon: I welcome the Minister here today for the debate on this long overdue and important Bill. Following yesterday's guillotining of Report Stage in the Dáil and despite the amount of time given over to it, the Bill now appears before us with 37 Government amendments having been passed without debate. Most of these amendments are substantial and involve considerable additions and changes to the...

Seanad: Residential Tenancies Bill 2003: Second Stage. (2 Jul 2004)

James Bannon: Is the Government planning to operate a tax amnesty for landlords and is it perhaps planning to rectify some problems in the private rented sector whilst turning a blind eye to others? As the register of landlords and tenancies will not be open to the public under the Freedom of Information Act it appears we will never know. So much for transparency and the law being seen to apply to all on...

Seanad: Order of Business. (2 Jul 2004)

James Bannon: I ask the Leader to invite the Minister for Agriculture and Food, Deputy Joe Walsh, to the House to prove that he has not abandoned farmers or allowed the Department of the Environment, Heritage and Local Government to railroad over the most intensive farmers in the State. Regarding the nitrates directive, he is trying to throw the national interest and good science out the window. We have...

Seanad: Order of Business. (2 Jul 2004)

James Bannon: The Senator's application must have been refused last night.

Seanad: Order of Business. (2 Jul 2004)

James Bannon: Fianna Fáil should thank the electorate for giving it a resounding result in the local and European elections.

Seanad: Order of Business. (2 Jul 2004)

Seanad: National Monuments (Amendment) Bill 2004: Second Stage. (1 Jul 2004)

James Bannon: That is a knee-jerk reaction to the Carrickmines case.

Seanad: National Monuments (Amendment) Bill 2004: Second Stage. (1 Jul 2004)

James Bannon: What consultation took place?

Seanad: National Monuments (Amendment) Bill 2004: Second Stage. (1 Jul 2004)

James Bannon: The Government has not listened in the past.

Seanad: Water Services Bill 2003: Report and Final Stages. (1 Jul 2004)

James Bannon: Perhaps the Minister will give us an indication of which pre-1922 Acts are being referred to. He must have a list of old Acts provided by departmental officials. Any Government should be able to find this out; the research facilities are there.

Seanad: Water Services Bill 2003: Report and Final Stages. (1 Jul 2004)

James Bannon: I thank the Minister and his officials for coming to the House and dealing with this Bill. The amendments put down by my own party were for the betterment of the Bill and I am glad the Minister accepted some of them and took our concerns into account. There is an onus on the Minister to ensure that waste management plans are in place in the various regions, along with sludge management...

Seanad: National Monuments (Amendment) Bill 2004: Second Stage. (1 Jul 2004)

James Bannon: I welcome the Minister of State. He never rises in this House without referring to my native county of Longford. I thank him for that and would point out that I am a member of Longford Historical Society. Indeed, I was a member of the county council when we moved a resolution for the retention and refurbishment of the 1798 courthouse, a landmark in the centre of Longford town. We recently...

Seanad: Water Services Bill 2003: Report and Final Stages. (1 Jul 2004)

James Bannon: I move amendment No. 15: In page 51, line 21, after "damage" to insert ", either directly or indirectly,". This reasonable amendment would add to the standing of the Bill. I propose that the words "either directly or indirectly" be added to the section. As I said on Committee Stage, such a provision would strengthen the Bill and make it clearer. I ask the Minister of State to accept it.

Seanad: Water Services Bill 2003: Report and Final Stages. (1 Jul 2004)

James Bannon: I move amendment No. 16: In page 51, lines 28 and 29, to delete "Unless otherwise provided for in this Act or in any other enactment, no" and substitute "No". I propose the deletion of the initial words of this section. Legislation is supposed to bring greater clarity to matters but section 46, as drafted, does not do so. I pointed this out when we discussed a similar amendment on Committee...

Seanad: Water Services Bill 2003: Report and Final Stages. (1 Jul 2004)

James Bannon: I move amendment No. 17: In page 52, lines 32 and 33, to delete all words from and including "that" in line 32 down to and including "functions" in line 33. This section provides for ministerial discretion, which I would have thought is inherent in every power. Why are we providing for ministerial discretion in the Bill? Am I to presume that the other powers of the Minister in the Bill are...

Seanad: Water Services Bill 2003: Report and Final Stages. (1 Jul 2004)

James Bannon: I move amendment No. 18: In page 53, line 16, after "agreement" to insert "in relation to the discharge of its functions under this Act". As I said the last day, we need to delimit the scope of agreements into which a water services authority can enter. I propose that it may only enter into agreements which relate to the discharge of its functions under the Act. As was the case with the...
