Seanad: Fines (Payment and Recovery) Bill 2013: Report and Final Stages (8 Apr 2014)

Feargal Quinn: I move amendment No. 6: In page 27, lines 5 and 6, to delete all words from and including "Protection," in line 5 down to and including line 6 and substitute the following:"Protection.".This amendment seeks to ensure that "such persons as may be prescribed" do not have access to personal information. It is not right that the Government can at some later date include additional people that...

Seanad: Fines (Payment and Recovery) Bill 2013: Report and Final Stages (8 Apr 2014)

Feargal Quinn: I understand what the Minister of State has said. I did not anticipate that, where there was no hostility, the court should have a Garda on duty, even if he or she is not required. I take the point in regard to that area. Certainly the State has confidence in a sheriff being able to do that work on that basis. It was not the intention that the court's rule could be frustrated on that...

Seanad: Fines (Payment and Recovery) Bill 2013: Report and Final Stages (8 Apr 2014)

Feargal Quinn: I move amendment No. 3: In page 12, line 11, to delete "(if necessary by the use of reasonable force)".The same applies to amendment No. 3. The intention was there. What we were trying to achieve was understandable and what I hoped would be achieved, but it certainly does not make sense to enforce it if it is only going to frustrate the order of the court. I withdraw the amendment.

Seanad: Fines (Payment and Recovery) Bill 2013: Report and Final Stages (8 Apr 2014)

Feargal Quinn: I move amendment No. 5: In page 18, after line 41, to insert the following:"(9) The employer to whom the attachment order is directed shall be entitled to withhold 5 per cent of the sums so deducted on behalf of the court, whether in lump or for every contribution, in order to cover the employer's administration costs.". I am frustrated by every piece of law we introduce in this area adding...

Seanad: Fines (Payment and Recovery) Bill 2013: Report and Final Stages (8 Apr 2014)

Feargal Quinn: I thank the Minister of State for the explanation. I want to make it clear that I was not making any effort to allow people to avoid paying their fines. I felt that the threat of jail or taking a person's home was over the top. I will not press the amendment.

Seanad: Fines (Payment and Recovery) Bill 2013: Report and Final Stages (8 Apr 2014)

Feargal Quinn: I move amendment No. 2:In page 12, line 9, to delete "alone or accompanied by such and" and substitute "accompanied by".Section 8(3) states: "The recovery order shall authorise the receiver (alone or accompanied by such and so many members of the Garda Síochána as he or she considers necessary) to". The amendment would ensure that the receiver is accompanied by a member of the...

Seanad: Fines (Payment and Recovery) Bill 2013: Report and Final Stages (8 Apr 2014)

Feargal Quinn: I move amendment No.1: In page 7, between lines 9 and 10, to insert the following:“ “property” specifically excludes any dwelling, mobile or fixed;”.I welcome the Minister of State and know he is in good humour and will accept every amendment that has been tabled. When he was a former and very enthusiastic Member of this House, I often heard him argue that the...

Seanad: Fines (Payment and Recovery) Bill 2013: Report and Final Stages (8 Apr 2014)

Feargal Quinn: I thank Senator Wilson.

Seanad: Building Control (Carbon Monoxide Detection) Bill 2014: Second Stage (8 Apr 2014)

Feargal Quinn: I appreciate the fact that the Minister has grabbed hold of this issue and agreed to accept this Bill. He is quite right when he says it can be improved. That is exactly what Committee Stage is for. I thank everybody else who got involved in the debate, particularly Senator Barrett who seconded the Bill. Senators Ó Domhnaill, Keane and Cullinane made some very valid points. I was...

Seanad: Building Control (Carbon Monoxide Detection) Bill 2014: Second Stage (8 Apr 2014)

Feargal Quinn: Senator Norris raised the question of cost. At the moment, it costs approximately €25 to buy one of these units in a shop.

Seanad: Building Control (Carbon Monoxide Detection) Bill 2014: Second Stage (8 Apr 2014)

Feargal Quinn: Not only is a life worth €25 but, as Senator Barrett has pointed out to me, a value of more than €1 million is attached to each person's life in transport project evaluations. We do not know how many deaths of this nature take place. It is hard to tell because carbon monoxide is a silent killer. The figure of 73 fatalities mentioned by the Minister suggests that the...

Seanad: Building Control (Carbon Monoxide Detection) Bill 2014: Order for Second Stage (8 Apr 2014)

Feargal Quinn: I move: "That Second Stage be taken today."

Seanad: Building Control (Carbon Monoxide Detection) Bill 2014: Second Stage (8 Apr 2014)

Feargal Quinn: I move: "That the Bill be now read a Second Time." I welcome the Minister for the Environment, Community and Local Government, Deputy Phil Hogan, to the House. It seems he decided to come without his officials. I like to see a man working alone and able to handle these matters on his own. The Bill I am bringing forward today deals with an important issue and its proposals have the...

Seanad: Order of Business (8 Apr 2014)

Feargal Quinn: It is a historic day, of which we should all be very proud. I am reminded, in particular, of the late Sam McAughtry who died approximately ten days ago. I am not sure if we will have an opportunity to pay tribute to him but he was a Member of this House. I was here when he joined us in 1996 and spoke so strongly. He described himself as a hybrid Unionist and stated that "I am happy to...

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Investment Commitments to SME Sector: National Treasury Management Agency (8 Apr 2014)

Feargal Quinn: To be involved in this process what is the business background of the team, do they come from banking, finance or economics?

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: Investment Commitments to SME Sector: National Treasury Management Agency (8 Apr 2014)

Feargal Quinn: Mr. O'Callaghan's presentation was very impressive and interesting. Most of us were not aware of what the agency is doing. I find that in business one has to have a target. Mr. O'Callaghan stated earlier that a business expects to get its money back plus a little more, which is a little vague. Perhaps he would elaborate further on that. I agree that the ISIF needs full confidence. Mr....

Seanad: SME Envoy Networks: Statements (3 Apr 2014)

Feargal Quinn: I welcome the Minister of State and I am delighted he is here again. I am also delighted with the steps he has taken and to hear about what is going on. It was also interesting to hear Senator Mary White's story and experiences, particularly with Lir Chocolates. I fear that the envoy network will become a talking shop. I was president of EuroCommerce, which represents the retail, wholesale...

Seanad: Building Control (Carbon Monoxide Detection) Bill 2014: First Stage (3 Apr 2014)

Feargal Quinn: I move: That leave be granted to introduce a Bill entitled an Act to provide for the installation of life-saving carbon monoxide detection devices in dwellings; to provide for certification of compliance; to provide for offences and penalties to apply in respect of instances of non-compliance and to provide for related matters. There have been a number of deaths in recent times and this is an...

Seanad: Building Control (Carbon Monoxide Detection) Bill 2014: First Stage (3 Apr 2014)

Feargal Quinn: On Tuesday.

Seanad: Order of Business (3 Apr 2014)

Feargal Quinn: I wish to move an amendment to the Order of Business: "That No. 9 be taken before No. 1." This concerns the carbon monoxide detection Bill. Senator Bacik has mentioned the economy and it is good that the jobless rate has come down. We have a long way to go if we are to get back to where we were but it is the best figure for five years. There are some other good figures related to the...
