- Seanad: Order of Business. (21 Nov 2002)
Brendan Ryan: On the Order of Business, can the Leader tell me when the Report Stage of the Digital Hub Development Agency Bill will be taken or is it still uncertain? It is ordered for next Tuesday, but I understandâ
- Seanad: Order of Business. (21 Nov 2002)
Brendan Ryan: It is ordered for next Tuesday. That does not matter. The Leader can let me know some other time. An bhfuil aon scéal faoi Bhille na dteangacha oifigiúla atá ar an gclár le sé seachtain anois agus nár luadh fós? Tá an Bille um inimirce ar an gclár le tamall fada chomh maith agus gan aon dul chun cinn déanta air. An bhféadfadh an Ceannaire eolas a thabhairt don Teach mar gheall ar...

Brendan Ryan: How much time do I have?
- Seanad: Book of Estimates, 2003: Statements. (21 Nov 2002)
Brendan Ryan: In deference to the Chair's indulgence, I probably will not take the ten minutes. I do not want to go into the details of the Estimates again because my colleague, Senator McDowell, did so with both a skill and an expertise that I would not have. The fundamental debate taking place here â I note it is taking place inside Fianna Fáil with considerable vigour â is about the position on the...
- Seanad: Digital Hub Development Agency Bill, 2002: Committee Stage (Resumed). (20 Nov 2002)
Brendan Ryan: I apologise to the Minister for my late arrival. The reason is mundane â the train from Cork was an hour late for the first time in about five years. I am sure the Minister did not miss me and no discourtesy was intended in any case. I agree with Senator Quinn. However, a number of issues need to be addressed, the first of which is the one he has raised. The second is the value of the...
- Seanad: Digital Hub Development Agency Bill, 2002: Committee Stage (Resumed). (20 Nov 2002)
Brendan Ryan: I appreciate the Minister's response on the last two amendments. Is he satisfied that directors of an agency such as this should be allowed to accept gifts of travel or holidays etc.? It is not very seemly, even if it is legally correct, for people to be brought on trips or holidays by companies connected with the business related to the functions of the agency. The proper ethos of an agency...
- Seanad: Digital Hub Development Agency Bill, 2002: Committee Stage (Resumed). (20 Nov 2002)
Brendan Ryan: I ask the Minister about subsection (4), which provides that where the Minister is satisfied that a member of the agency has failed to comply with subsection (1), the declaration of interest and the disclosure of a possible conflict of interest by a member, he may remove that member from office or take such other action as he considers appropriate. Why is there discretion? If a member of an...
- Seanad: Digital Hub Development Agency Bill, 2002: Committee Stage (Resumed). (20 Nov 2002)
Brendan Ryan: Why does the Minister think that there is no need for a definition of an interest, similar to that in section 24, which refers to the interests of a member of the staff? I know it is somewhat different but the definition of "interest" in section 24 applies only to that section. Why does a similar definition not apply here? Perhaps it is an oversight which can be remedied on Report Stage.

Brendan Ryan: I am not trying to be awkward.
- Seanad: Digital Hub Development Agency Bill, 2002: Committee Stage (Resumed). (20 Nov 2002)
Brendan Ryan: We can look at it. We can never proscribe downright evil. If people want to find a way around something they will find it. Question put and agreed to. SECTION 27. Government amendment No. 30: In page 20, lines 11 to 14, to delete subsection (4) and substitute the following new subsection: "(4) In this section 'confidential information' includesâ (a)information that is expressed by the...
- Seanad: Digital Hub Development Agency Bill, 2002: Committee Stage (Resumed). (20 Nov 2002)
Brendan Ryan: I have no desire to be confrontational. The difference I see is that the existing clause prohibits the disclosure of information deemed by the agency to be confidential, whereas this amendment covers information deemed either by the agency or the Minister to be confidential. I am happy that the Minister is reluctant to be too prescriptive, but it seems extraordinarily prescriptive not to...
- Seanad: Digital Hub Development Agency Bill, 2002: Committee Stage (Resumed). (20 Nov 2002)
Brendan Ryan: I have to stray on to the section to a small extent to explain one of the problems I have with the amendment.
- Seanad: Digital Hub Development Agency Bill, 2002: Committee Stage (Resumed). (20 Nov 2002)
Brendan Ryan: The Chair will have to bear with me before he decides whether I am misbehaving, as the point I wish to make relates to both the amendment and the section. Section 27 states, "a person shall not, without the consent of the Agency, disclose confidential information." As only the agency can decide what may be disclosed, it is surely illogical to allow the agency and the Minister to determine the...
