- Public Ownership of the National Broadband Network: Motion [Private Members] (23 Oct 2019)
Seán Sherlock: I move: That Dáil Éireann: —notes the Report of the Oireachtas Joint Committee on Communications, Climate Action and Environment entitled ‘Report on an investigation to examine the National Broadband Plan process thus far and how best to proceed and the best means to roll out rural broadband’, which was laid before both Houses of the Oireachtas on the 27th...

- Committee on Public Petitions: Decisions on Public Petitions Received (23 Oct 2019)
Seán Sherlock: The point is well made. I will move on. The decision is that we will forward a copy of the response from the Department of Finance to the petitioner and close the petition. Is that agreed? Agreed. Petition No. P00023/19 is from Mr. Wayne Hester. He would like to see 30 April designated a public holiday in honour of Riverdance. It is decided that we will forward a copy of the response...
- Committee on Public Petitions: Decisions on Public Petitions Received (23 Oct 2019)
Seán Sherlock: Petition No. P00034/19 is from Ms Tanya O'Neill, who would like to see new labelling on all non-recyclable packaging stating that it is not recyclable. We have agreed that we would forward a copy of the response from the Department of Communications, Climate Action and Environment to the petitioner. We will not quite close the petition yet but will give it further consideration.
- Committee on Public Petitions: Decisions on Public Petitions Received (23 Oct 2019)
Seán Sherlock: The proposal before us is that we communicate with Repak and perhaps ask it to consider the content of the petition and respond on the work it is doing. To be fair, the response from the Department is comprehensive in answering the issues raised by the petitioner. We are going off on a tangent to the extent that it is not possible to adhere to what is being specifically sought in the...
- Committee on Public Petitions: Decisions on Public Petitions Received (23 Oct 2019)
Seán Sherlock: Is there a proposal before us to keep the petition open?
- Committee on Public Petitions: Decisions on Public Petitions Received (23 Oct 2019)
Seán Sherlock: A report was published by the relevant committee in October 2018. Like every other public representative here, we are all inundated with people contacting us about a range of issues in this area, from assessments to issues concerning bricks and mortar and the provision of capital expenditure. If we look at the issue narrowly through the prism of Clondalkin, I propose that we close the petition.
- Committee on Public Petitions: Decisions on Public Petitions Received (23 Oct 2019)
Seán Sherlock: There is a wider issue and the solution may be as simple as this committee communicating with the Department and the relevant line committee, as per Standing Orders, asking if there has been any response or update to the 2018 report. It is such a live issue. The numbers are increasing all the time. I propose that we close the petition but write to the Chairman of the Joint Committee on...
- Committee on Public Petitions: Decisions on Public Petitions Received (23 Oct 2019)
Seán Sherlock: That is agreed. It is deemed that Petition No. P00042/19 is inadmissible, as per Standing Orders, and we will inform the petitioner as to the reasons. Is that agreed? Agreed. I understand Deputy Buckley wants to raise an issue under any other business.
- Committee on Public Petitions: Decisions on Public Petitions Received (23 Oct 2019)
Seán Sherlock: I propose that we discuss the matter in private session, before we adjourn. Is that agreed? Agreed.
- Committee on Public Petitions: Decisions on Public Petitions Received (23 Oct 2019)
Seán Sherlock: I refer Deputy Buckley to the discussion we have just had on the petition we received from the Save Fermoy Weir and Save Our Salmon group. We are in receipt of correspondence from the group rebutting in a comprehensive document the submissions laid before the committee and spoken to by individual stakeholders on 3 July. It is proposed that we note the correspondence from the stakeholders in...
- Select Committee on Children and Youth Affairs: Child Care (Amendment) Bill 2019: Committee Stage (23 Oct 2019)
Seán Sherlock: I seek advice on the issue. Amendments in my name and those of Deputies Rabbitte and Funchion have been ruled out of order. They were tabled in good faith. To my mind we have not received a comprehensive justification as to why they have been ruled out of order. I seek permission to hear from the Minister as to that justification.
- Select Committee on Children and Youth Affairs: Child Care (Amendment) Bill 2019: Committee Stage (23 Oct 2019)
Seán Sherlock: I understand from the Minister's Second Stage speech that the Bill contains a presumption in favour of the appointment of a guardian ad litem. If so, I do not see how from a resource point of view of putting a charge on the Exchequer our amendments run contrary to that. What we are seeking to do through our amendments is buttress the existing system.
- Select Committee on Children and Youth Affairs: Child Care (Amendment) Bill 2019: Committee Stage (23 Oct 2019)
Seán Sherlock: I beg the Chairman's indulgence before the Minister replies. The other issue I have is the constitutionality of the legislation under Article 42A.4.1o, which reads: (i) brought by the State, as guardian of the common good, for the purpose of preventing the safety and welfare of any child from being prejudicially affected, or (ii) concerning the adoption, guardianship or custody of, or...
- Select Committee on Children and Youth Affairs: Child Care (Amendment) Bill 2019: Committee Stage (23 Oct 2019)
Seán Sherlock: It is important.
- Select Committee on Children and Youth Affairs: Child Care (Amendment) Bill 2019: Committee Stage (23 Oct 2019)
Seán Sherlock: This issue has been highlighted by the Child Care Law Reporting Project. In some areas of the country, guardians are only appointed in a small number of cases. The justification for our amendments has to do with the prediction that the current iteration of the Bill will have no significant impact on that phenomenon. That is our worry. I wish to declare at this stage that, if we do not...
