Mick Wallace: Under the Bill it is proposed to substitute the words "within the period of 12 months" for "within the period of 6 months", but in certain circumstances, particularly in the case of issues of a very serious nature, a case could be made to extend the period to two years, if the conduct in question merited it.

Mick Wallace: It makes a mockery of the notion of strengthening GSOC if a veto is left in place. It is imperative that under no circumstances should the Minister have a veto in this situation. I will table an amendment to that section when the time comes.

Mick Wallace: Yes. It relates to the issue of substituting "the Garda Authority" for "the Minister". I wish to challenge, with an amendment, the idea of the Garda Síochána Ombudsman Commission being able to investigate the Commissioner only with the consent of the Minister.

Mick Wallace: On that topic, expecting things to be done in the spirit of things is one reason GSOC has been so fettered for a number of years. From discussions with GSOC, I am aware that this is a huge problem for the commission. It is far too open-ended and the potential for non-co-operation without a serious restriction being put in place is too easily abused on the part of the police force.
