Committee on Environment, Culture and the Gaeltacht: Select Sub-Committee on the Environment, Community and Local Government: Environment (Miscellaneous Provisions) Bill 2014: Committee Stage (26 May 2015)

Ann Phelan: Section 34 amends the Dog Breeding Establishments Act 2010 by making two minor typographical corrections to existing provisions and clarifying one existing provision. There are no new or changed policies being introduced as a result of the proposed changes, which are intended simply to avoid any criticism impact if these matters are raised as part of a court action. I understand what Deputy...

Committee on Environment, Culture and the Gaeltacht: Select Sub-Committee on the Environment, Community and Local Government: Environment (Miscellaneous Provisions) Bill 2014: Committee Stage (26 May 2015)

Ann Phelan: I want to point out to the committee that while the Government is not presenting any amendments to the Bill at this stage in the process, it intends to propose a number of amendments on Report Stage in the Dáil. This will require a motion to be tabled to amend the Long Title and scope of the Bill. These amendments will cover a range of issues, including further amendments to waste...

Committee on Environment, Culture and the Gaeltacht: Select Sub-Committee on the Environment, Community and Local Government: Environment (Miscellaneous Provisions) Bill 2014: Committee Stage (26 May 2015)

Ann Phelan: The sections about which Deputy is asking amend motor tax legislation to extend the period for making a declaration of non-use of a motor vehicle on change of ownership, or on registration, from ten days to 21 days. It is good news that the current ten-day period of registration will now be extended to 21 days. This is in keeping with many other things. For example, 21 days are allowed for...

Committee on Environment, Culture and the Gaeltacht: Select Sub-Committee on the Environment, Community and Local Government: Environment (Miscellaneous Provisions) Bill 2014: Committee Stage (26 May 2015)

Ann Phelan: The motion that is to be tabled will amend the Long Title and scope of the Bill. The amendments will be introduced thereafter. I am not in a position to give any details of the amendments at this stage, other than to say they will be made available at an early stage so that the Deputies will have plenty of time to look at them.

Committee on Environment, Culture and the Gaeltacht: Select Sub-Committee on the Environment, Community and Local Government: Environment (Miscellaneous Provisions) Bill 2014: Committee Stage (26 May 2015)

Ann Phelan: This Bill is quite technical. There are some typographical issues. It will really be a question of dotting the i's and crossing the t's. The scope of the Bill does not allow for the Bill to be changed in any huge way. The Bill itself is very technical. We will be proposing amendments. The Deputies will have plenty of time to consider them.

Committee on Environment, Culture and the Gaeltacht: Select Sub-Committee on the Environment, Community and Local Government: Environment (Miscellaneous Provisions) Bill 2014: Committee Stage (26 May 2015)

Seanad: Commencement Matters: Wind Energy Guidelines (26 May 2015)

Ann Phelan: I thank the Senator for raising this important issue. Proposals for wind energy developments are subject to the statutory requirements of the Planning and Development Act 2000, as amended, in the same manner as other proposed developments.Planning applications are made to the relevant local planning authorities, with a right of appeal to An Bord Pleanála. In the case of wind...

Seanad: Commencement Matters: Wind Energy Guidelines (26 May 2015)

Ann Phelan: My knowledge of the planning process is that whatever is introduced does not apply retrospectively. If, therefore, a new guideline were to be introduced today, it would not apply to planning applications made previously.I also suggest to the Senator that if he seeks a moratorium on it, perhaps he needs to speak to the local authorities because, as indicated in the response and as the...

Written Answers — Department of Environment, Community and Local Government: Departmental Funding (26 May 2015)

Ann Phelan: I propose to take Questions Nos. 919, 960 and 962 together. The funding Scheme to Support National Organisations (SSNO) in the community and voluntary sector aims to provide multi-annual funding to national organisations towards core costs associated with the provision of services. Applications for a new round of funding, which commenced on 1 July 2014, were subject to an appraisal...

Written Answers — Department of Environment, Community and Local Government: Leader Programmes Administration (26 May 2015)

Ann Phelan: I propose to take Questions Nos. 951 and 979 together. Article 38 of Regulation 1974/2006 states that running costs of local action groups (LAG) under the LEADER element of the Rural Development Programme 2007-2013 are eligible for support, but up to a limit of 20% of the total expenditure. At present the national average is 20%. Approximately €17million remains to be paid out on...

It is hoped that State Aid exemptions can be agreed across a range of interventions including conservation, heritage, training and village renewal and...

Written Answers — Department of Environment, Community and Local Government: Leader Programmes Administration (26 May 2015)

Ann Phelan: I refer to the reply to Question 519 of 6 May 2015, which sets out the position in relation to this matter. The position remains unchanged.

An Bille um an gCeathrú Leasú is Tríocha ar an mBunreacht (Cearta Geilleagracha, Comhdhaonnacha agus Cultúir) 2014: An Dara Céim [Comhaltaí Príobháideacha]: - Thirty-fourth Amendment of the Constitution (Economic, Social and Cultural Rights) Bill 2014: Second Stage [Private Members] (19 May 2015)

Ann Phelan: I thank the Deputies for the wide range of comments and analyses which have been made tonight, and I certainly accept their bona fides.
