Steven Matthews: What is the point? We need to be careful about the language we use in planning much of the time. At the moment, something small or insignificant can be corrected.

Steven Matthews: Yes. That is fine and I think we all consider that to be sensible. However, as it is written at the moment, the Bill states that, "any error of law" can be corrected. Do we have to define what that error could be and what impact it could have on the decision? If it is a significant error, the decision could have been different. If it is an insignificant error, is it not already covered?

Steven Matthews: That is not clear. The legislation refers to the amended decision. To say "any error" is to allow too wide a description. It is very much open to interpretation.

Steven Matthews: Some of the objectives associated with the rationale for the planning consolidation were to provide certainty and clarity. The way the measure is written creates further uncertainly. It would be very problematic to leave it as it is written.

Steven Matthews: With regard to what can be included in conditions for the design of developments, some of the developments designed are just pedestrian-unfriendly. Driving into winding, cul-de-sac estates, you see that pedestrian permeability is a last-minute thought.
