Seanad: Dog Breeding Establishments Bill 2009: Committee Stage (Resumed) (9 Mar 2010)

Joe O'Reilly: I have one observation to make on the amendment. Given that there is a punitive dimension to the Bill with significant fines for non-adherence to its provisions, surely inspectors will have a quasi-judicial function. Since they will have to be objectively independent, a court case is possible in this regard. It does not add up. I hope the Minister of State will respond to this point.

Seanad: Dog Breeding Establishments Bill 2009: Committee Stage (Resumed) (9 Mar 2010)

Joe O'Reilly: The point made by Senator Burke about the spread of diseases is of importance. Proper practice should be observed in this regard. I will not labour the point, but I would like a response from the Minister about the possibility of a challenge to the legislation. I genuinely fear a challenge on the basis that people with a vested interest cannot act as objective inspectors. I fear that the...

Joe O'Reilly: They are not inspecting the businesses.

Seanad: Dog Breeding Establishments Bill 2009: Committee Stage (Resumed) (9 Mar 2010)

Joe O'Reilly: No; it should be an objective process which does not include interest groups.

Joe O'Reilly: On a point of information, surely any inspector should not be a representative of a vested interest-----

Joe O'Reilly: -----and should be objective.

Seanad: Dog Breeding Establishments Bill 2009: Committee Stage (Resumed) (9 Mar 2010)

Joe O'Reilly: And fines.

Seanad: Community Development. (9 Mar 2010)

Joe O'Reilly: On 25 November 2009 the Department of Community, Rural and Gaeltacht Affairs gave the go-ahead to start winding down and closing 180 community projects. Twenty to 30 of those projects are already closed down, supposedly as part of a review procedure. I understand 11 are appealing to the Labour Relations Commission through their union. The funding for community development programmes is...

Seanad: Community Development. (9 Mar 2010)

Joe O'Reilly: While I fully appreciate that this is not the Minister of State's brief, I am anxious that he convey my opinion to the Government and the relevant Minister. We are not referring to not sending funding through the local county structures. There is no problem in that regard or concerning the reductions. Rather, we want the funding to be spent by the CDPs and given to them directly. If...

Seanad: Order of Business (4 Mar 2010)

Joe O'Reilly: I welcome the Minister of State. It is the first time we have encountered each other in this role. We studied history together in UCD and I am delighted to meet him in this context. I support the sentiments expressed by Senator Norris. As a lover of words, I flatter myself by thinking I am something of a wordsmith on occasion. I fully share the Senator's view that "undenatured" is not a...

Seanad: Order of Business (4 Mar 2010)

Joe O'Reilly: Yes. All of my amendments are predicated on issues I raised on Second Stage. The first was indigenous production of the raw materials required for the production of bio-fuels, the indigenous processing of bio-fuels and, on a national and international level, not allowing the production, use or introduction of quotas of bio-fuels to interfere in an adverse fashion with the food supply or put...

Seanad: Order of Business (4 Mar 2010)

Joe O'Reilly: All they produce in County Kilkenny is Smithwick's.

Seanad: Order of Business (4 Mar 2010)

Joe O'Reilly: The reasons behind my tabling these amendments were based on dealing with the jobs crisis by creating jobs at bio-fuel producer and post-producer level and achieving a reduction in carbon emissions to keep in line with our Kyoto Protocol and EU requirements. We won the arguments and the Minister of State has accepted them. However, it is disappointing that he cannot accept the amendments....

Seanad: Dog Breeding Establishments Bill 2009: Committee Stage (Resumed) (3 Mar 2010)

Joe O'Reilly: I agree with colleagues on the charge issue. We cannot justify a double charge, which is unsustainable in terms of natural justice and every other kind of justice. It is not an option for the sustainability of the industry. I ask the Minister to clarify the point. I refer the Minister to section 12 of the Greyhound Trainers' Regulations 1961: 12.—(1) The kennels of any person applying...

Seanad: Order of Business (2 Mar 2010)

Joe O'Reilly: I formally second Senator Harris's proposal for a debate on older people. He is correct in saying we need to harness the wisdom and experience of older people, particularly in these recessionary times, in terms of how to cope with the recession as a reality and also in terms of strategies for dealing with it. There is immense wisdom there to be tapped into. We also need to address in that...

Seanad: Order of Business (25 Feb 2010)

Joe O'Reilly: No, it is a red deer.

Seanad: Order of Business (25 Feb 2010)

Joe O'Reilly: At the outset, I formally second the proposal by Senator Buttimer to have a renewed debate on education and in so doing, to repudiate any attempt to muzzle my good colleague and Fine Gael spokesperson on education, Senator Healy Eames.

Seanad: Order of Business (25 Feb 2010)

Joe O'Reilly: I also wish formally to second the request for a debate by Senator Wilson on the TETRA system. While I welcome the system as such, the interference with television reception is not acceptable. Steps must be taken to deal with this matter and householders should not be left out of pocket. Senator Wilson did a good job of mentioning a list of towns in counties Cavan and Monaghan and...
