Pádraig Mac Lochlainn: Apologies have been received from Deputy Michael Kitt, Deputy Helen McEntee, Deputy Anne Ferris, Senator Jimmy Harte and Senator Ivana Bacik. I ask those present, including members, media and people in the Gallery, to switch off all mobile devices or put them into safe mode to avoid interference with the broadcast. This is a meeting of the Joint Committee on Public Service Oversight and...
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Ireland's Compliance with Article 2 of the European Convention on Human Rights: Discussion (10 Jun 2015)
Pádraig Mac Lochlainn: A particular focus is the requirement for a proper and adequate official investigation into deaths resulting from the actions of State agents, both from the use of lethal force and also in situations arising from the negligence of agents which leads to a death - when Articles 1 and 2 of the European Convention on Human Rights are read together. We welcome a distinguished panel of experts to...

- Joint Oireachtas Committee on Public Service Oversight and Petitions: Ireland's Compliance with Article 2 of the European Convention on Human Rights: Discussion (10 Jun 2015)
Pádraig Mac Lochlainn: I thank Mr. Finucane and all of our witnesses for their comprehensive and thought-provoking presentations. Before I open up the meeting to questions from members, it is important that I clarify that the issue of Article 2, taken in conjunction Article 1, does not only pertain to deaths at the hands of State agents and so on but to all deaths in suspicious circumstances. This is really...
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Ireland's Compliance with Article 2 of the European Convention on Human Rights: Discussion (10 Jun 2015)
Pádraig Mac Lochlainn: I have a number of questions but before I ask them, might I get agreement from both committees that we send the transcript of today's hearings to the Minister and senior Department officials, asking them to take on board the calls and observations that have been collectively made here? In recent days, I spoke to family members of a loved one who died in the last decade. I will not give...
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Ireland's Compliance with Article 2 of the European Convention on Human Rights: Discussion (10 Jun 2015)
Pádraig Mac Lochlainn: The case to which I referred is way outside Dr. Farrell's jurisdiction and, as he said, the vast majority of deaths are not in suspicious circumstances but would he agree that where deaths have taken place in controversial, contested or suspicious circumstances, families sometimes can be failed by the system? That is my point.
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Ireland's Compliance with Article 2 of the European Convention on Human Rights: Discussion (10 Jun 2015)
Pádraig Mac Lochlainn: Dr. Farrell has said we need the new Act and new coroners' rules, in fairness. The case I am referring to is in the west of Ireland. The family has advised me that it has not been updated by the coroner for a number of years. Would Mr. Farrell acknowledge that?
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Ireland's Compliance with Article 2 of the European Convention on Human Rights: Discussion (10 Jun 2015)
Pádraig Mac Lochlainn: That is fair point. Thank you, Dr. Farrell.
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Ireland's Compliance with Article 2 of the European Convention on Human Rights: Discussion (10 Jun 2015)
Pádraig Mac Lochlainn: I will bring in Mr. Kelly presently, but I want to get a response to my previous question first. Let us suppose the members of the deputation were in front of the Minister for Justice and Equality. What three issues would you ask her expedite to bring us into compliance, as you see it? We will start with Mr. Kelly and then work our way around.
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Ireland's Compliance with Article 2 of the European Convention on Human Rights: Discussion (10 Jun 2015)
Pádraig Mac Lochlainn: Dr. Mavronicola, you wanted to deal with a previous question. Perhaps you could respond to both questions.
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Ireland's Compliance with Article 2 of the European Convention on Human Rights: Discussion (10 Jun 2015)
Pádraig Mac Lochlainn: It is particularly important for us to have received the presentation made by Dr. Farrell as a practitioner and to have seen the challenge from various perspectives. The panel in attendance today has given us the full balance of perspectives. This will be very important for us at the next stage of our work, which will involve trying to bring in the change. I really appreciate the...

Pádraig Mac Lochlainn: I thank all of our witnesses and guests for being here today for this immensely helpful session. The submissions will be published. The Joint Committee on Public Service Oversight and Petitions will meet again in private...
- Draft Commission of Investigation (Certain matters concerning transactions entered into by IBRC) Order 2015: Motion (9 Jun 2015)
Pádraig Mac Lochlainn: It has been a remarkable number of weeks and it has been even more remarkable to hear Ministers, the Taoiseach and Government backbenchers downplaying the seriousness of the attempt by Denis O'Brien to silence our media in this State and prevent them from reporting a speech by Deputy Catherine Murphy in this Chamber. I took a look at the profile Denis O'Brien likes to give to the world....
- Leaders' Questions (9 Jun 2015)
Pádraig Mac Lochlainn: It is an art form.
- Leaders' Questions (9 Jun 2015)
Pádraig Mac Lochlainn: A poor question.
- Other Questions: Defence Forces Medicinal Products (9 Jun 2015)
Pádraig Mac Lochlainn: My concern on this issue, as with many other issues, is that the lawyers in the Department, or those advising the Department, will say that if the Minister changes tack at this stage, he admits liability in regard to cases that are before courts. The Minister repeatedly says that nobody has contracted malaria but, with respect, that is not the point. The point is that for people with...
- Ceisteanna - Questions - Priority Questions: Naval Service Operations (9 Jun 2015)
Pádraig Mac Lochlainn: Like me, the Minister would have been proud of the words of the President, Michael D. Higgins, when he was in Lebanon regarding Europe's failure to deal with the refugee crisis and the unacceptable catastrophe of thousands of people drowning in the Mediterranean. Italy and Malta cannot be expected to shoulder the responsibility. This is a European responsibility. I note that there has been...

Pádraig Mac Lochlainn: 108. To ask the Minister for Defence if he will report on the work done by the LE Eithne and its crew, since the ship was deployed to the Mediterranean; his plans to expand the role that the LE Eithne is fulfilling in the region, especially in relation to the recently agreed European Union naval force operation in the Mediterranean.
